Churches, mosques should pay tax – Falana
NOVEMBER 27, 2012 BY ENIOLA AKINKUOTU

Human Rights lawyer, Femi Falana (SAN), has canvassed that churches and mosques should begin to pay tax in the country.

Falana, who expressed worry about the role of religious bodies in the fight against corruption, spoke against the backdrop of the acquisition of a jet by the President of the Christian Association of Nigeria, Pastor Ayo Oritsejafor, said to have been donated by the cleric’s church members.

He stated this while delivering a lecture, ‘Asking the unasked questions: society, corruption and punishment in Nigeria’ in Lagos on Monday.

The SAN, who represented Prof. Wole Soyinka at a workshop entitled ‘the dynamics of cashless economy and emerging methods in financial crimes,’ said both society and the government had failed in the fight against corruption.

He said, “Pastor Ayo Oritsejafor, the President of the Christian Association of Nigeria, someone who just acquired his own jet a couple of weeks ago, took a swipe at Pastor Tunde Bakare for condemning their crave for jets and opulent life. He (Oritsejafor) said everything a pastor could get for evangelism should be acquired, not minding the economic situation of the people

“If this is the case then, the tax authorities must extend their dragnets to all religious centres where substantial income is generated on a regular basis in the name of God. The prosperity pastors, who are buying jets to preach the gospel to those who wallow in abject poverty should be assessed according to their wealth and be made to pay commensurate taxes.

“After all, they pay appropriate fees for parking their jets at local and international airports at home and abroad.”

Falana also noted that death penalty was logical but not necessary in curbing corruption.

According to him, death penalty for crimes such as robbery has not served as a deterrent and will not work in this regard.

He said, “Notwithstanding the horrendous effect of corruption in the society, we should not be frustrated to support the campaign for the brutalization of humanity through the death penalty.

“Even in Nigeria, our experience with murder and armed robbery has proved that death penalty is not a deterrent for violent crimes.”

Femi Falana is on Point.

Most of you will not believe how much most of these churches realise from Gullible Nigerians.
Someone who participated in church offering collection recently told me about the kind of money to account after each Sunday in a popular church.
According to him, he says he has seen a 120 Million Naira GTB cheque.

Sometimes 6 or 7 of them won't even finish counting church offerings for a whole day.
Sad thing is most of these church donors don't even engage in any charitable giving. Even the said church doesn't. All they do is acquire new private jets each time a new version is out.

I support this 1000000000000000000%. Anyone who argues otherwise is still living in times of Jesus, when the meaning of church was synonymous to charity.

I really wonder if its possible. No matter what some pastors do this days and abuse the Doctrines of God, i don't think it should warrant for a religious institution to be taxed

See the problems these pastors are giving honest religious bodies? Which type of profit do mosques make that they will now start paying tax for? This falana is an idîot. He mentioned that the reason for starting tax payment is because pastors are buying private jets, why is he now involving imams and mosques in the matter? Imams do not buy private jets so they should not be made to suffer for the actions of pastors.
If falana has a problem with those churches that buy jets then he should have dealt punishment to the churches and not to churches and mosques.
Rubbish.

Look at it this way, these churches use government resources, they use water (if it exists), use power (if it exists) and are part of the larger society that pays tax. Your arguement will be valid if churches participate in alleviating the wellbeing of its citizenry. But churches owning property worth millions of dollars, buying private jet, essentially living the high life.... Come on, give a break... It pays to be a pastor these days, just get your people to contribute money and there you have free monies to spend

This should based on average collections. Most mosques collect just enough to maintain her facilities because collections are optional.

The billionaire churches should definitely pay taxes but those that earn barely enough should not have to.

Paying tax!!! .....................to what end?

The percentage tithe will only go up proportionately to make compensation for taxes paid......

i.e MORE TITHES will be paid

In fact, a member of the congregation may volunteer to "take care" of the taxes for the next one year........this is also a form of tithe for him....
.......The situation then returns to the original.....and everything appears like there is no tax.......and most members of congregation stilll remain "just as wretched".....

.......Given the ideology and situation of Nigerians, this isn't too much to predict....

Our present personal income tax act does not exempt pastors or other church workers who earn salary from Pay-As-You Earn('PAYE') tax which is meant to be collected by the various state government. The Church are also mandated by the Federal Inland Revenue Service and Corporate Affairs Commission to file their Annual audited accounts. We should separate the church from the pastors.State government should intensify efforts to collect PAYE tax from the staffs of Church and their audited accounts should be published and given to the members of the Church.Church members are also stakeholder in the Church of God.There is no need to tax the Church tithes and offerings.

Yes, religious bodies should pay taxes. Jesus and his disciple (Peter) paid taxes to Caesar. The churches are not involved in corporate social responsibility. The roads leading to some of the worship centres are really bad and they would not do as much as sandfill them in spite of several millions they generate all year round. The poor can't even afford their universities. It's time they rendered accounts for tax assessment.

I do support this move..

All religous bodies that collect monies from their congregation should pay taxes to the government..

All religous bodies should also have atleast two charities that they must sponsor.

All Leaders of religous bodies must declare their assets every 6 months..

A limit must be placed on the net worth of all religous leaders..

Religion should not be allowed to be exploited.

And all the Custom duty waivers given to some churches should be cancelled and those duties recalled, you cannot be asking for duty waiver for Jeeps and other luxury Goods.I think it is time for the senate to assume the power to grant waivers to themselves and not the president.this would make it more difficult and would most likely be in the open with the senators.Custom waivers is one of the methods perfected by some unscrupulous "pastropreneurs" to bled our system. How can a pastor be given a custom waiver for a Jeep and other luxury goods

Bad belle wan finish them all. Tithing is not by force. Tax is suppose to at the point where an entity earns and not a charitable cause the people pay what they believe in(tithe) to. It is funny how same politicians who cripled our public system are the ones 'beefin' the alternative system the people willingly contributed to.

The fact remains that every religious institution in this country MUST be taxed if ordinary citizen can pay tax then theirs shouldn't be a different case Because they can afford it!!

Even if they do not have to pay taxes, let them at least publish their accounts and source of every donation of N50,000.00 and above.

The stage will now be ripe to know how honest our churches and mosques are. I envisage a lot of under quoting grin Let us know those that will hide money launderers.

Are they buying it form the money their congregation gives them? NO!!!
If you see any Imam buying a jet, then they bought it with their own money that they worked for, not money that was scammed form brain dead congregations of foolish church-going sheep.
Imams work, they have jobs outside of preaching unlike your thieving pastors that sit back and quote bible verses while you morons throw your tithes at them to feed fat on.

The money realized from Friday offerings are
1. Not compulsorily taken from the congregation, it is voluntary.
2. Given to charity.
3. Not given to the Imam for his personal use.
And how dare you compare Friday offerings to the payments churches get?
You people collect tithes, first fruits and whatever foolish dues your church associations charges the members coupled with offering from your Monday to Friday church programs. If it is not youth meeting offering then it is Bible study offering.

All church goers who earn must pay tax cos it's biblical ! But a church that lives on charity, offerings and tithes that isn't compulsory in most churches if not all shouldn't be taxed at all.
See below where even our master Jesus paid both the IMPERIAL TAX and the TEMPLE TAX:
The temple tax was a tax imposed by Moses for the tabernacle upkeep.

''After Jesus and his disciples arrived in Capernaum, the collectors of the two-drachma temple tax came to Peter and asked, “Doesn’t your teacher pay the temple tax?”

25 “Yes, he does,” he replied.

When Peter came into the house, Jesus was the first to speak. “What do you think, Simon?” he asked. “From whom do the kings of the earth collect duty and taxes—from their own children or from others?”

26 “From others,” Peter answered.

“Then the children are exempt,” Jesus said to him. 27 “But so that we may not cause offense, go to the lake and throw out your line. Take the first fish you catch; open its mouth and you will find a four-drachma coin. Take it and give it to them for my tax and yours.

See below the instruction regarding payment of the IMPERIAL TAX which is the kind of tax FALANA seek from the church instead of the members of the church:
''They came to him and said, “Teacher, we know that you are a man of integrity. You aren’t swayed by others, because you pay no attention to who they are; but you teach the way of God in accordance with the truth. Is it right to pay the imperial tax[b] to Caesar or not? Should we pay or shouldn’t we?”

But Jesus knew their hypocrisy. “Why are you trying to trap me?” he asked. “Bring me a denarius and let me look at it.” They brought the coin, and he asked them, “Whose image is this? And whose inscription?”

“Caesar’s,” they replied.

Then Jesus said to them, “Give back to Caesar what is Caesar’s and to God what is God’s.”
From what we have above,it is not wrong to pay either the terbanacle tax if we are told to do so in our churches by any church leader who does not understand that sons do not pay such tax but subject do OR neither are we not expected to pay the IMPERIAL TAX (FASHOLA TAX,the state or country tax)Which i pay as a christian since i started working. But christ never instructed the terbanacle or chruch to pay any any of the two taxes. BUT JUST NOT TO OFFEND THEM,IF THEY FALANA/FASHOLA NEEDS IT,LET'S GIVE IT TO THEM becos the bible said we should obey all authorities so long as it does not contradict or will be in dissonance with our salvation !
God bless us.
