President Goodluck Jonathan has urged an Abuja Federal High Court to dismiss a suit by former Osun State Governor Olagunsoye Onyinola, seeking to stop the National Judicial Council (NJC) from re-instating the suspended President of the Court of Appeal, Justice Isa Ayo Salami.

In a joint Counter-Affidavit with the Attorney General of the Federation and Minister of Justice, Mohammed Adoke (SAN), Jonathan said the suit constitutes a gross abuse of court process.

Besides, the NJC urged the court to dismiss the suit because the plaintiff lacks the locus standi to institute the action.

Describing the suit as mischievous and a witch-hunt, the council said the suit was an extension of grievances nursed by Oyinlola against Justice Salami following the nullification of his election by the Governorship Election Appeal Tribunal in November 2010.

Justice Abdul Kafarati yesterday fixed January 24 for ruling after hearing the preliminary objections.

The plaintiff is seeking an order of perpetual injunction restraining President Jonathan from acting on the recommendation of the NJC to reinstate Justice Salami, contending that the recommendation is null and void.

Without any intention of derailing this thread, lets look at the nullification of Oyinlola's tenure from another angle.

The court kicks him out of office for a rigged election. Erelu Obada was Deputy Governor to Oyinlola during his 7 1/2 stolen mandate. In other climes, at the very least, she would have descended into political oblivion; but "hey presto"......she mysteriously reappears (apologies to Harry Houdini)as Minister of State for Defence in Boko Haram stricken Nigeria!!!!

Sorry to say this bro,you are dumb to analyze biased and subjectively.Please endeavour to weigh facts accurately before jumping into lame conclusions.Is the said 'Justice' behind the enthronement of'ACNship' in the South West or the reflection and choice of the people who have seen the hypocrisy and stark enormity of PDP's sabotage of the democratic institution.Saying Justice Salami is the instrument wielded by ACN bla bla bla could only reflect how our elections are marred with riggings on the PDP side..

eldoradoxx: Salami brought the name of judiciary to the mud by lying on oath and advertising his lies on pages of newspaper. Am happy that eminent jurist made up of old retired justices of supreme court and court of appeal who looked into the allegations he leveled agaonst the former CJN Kastinal Alu, came up with recommendation for his suspension for taking the ignoble part in ridiculing the judiciary. Judiciary is a conservative place, because what ever is said or done in public affects the perception of the man in d village as to the quality of justice he will get there, where he feels there is no justice, he can take laws into his hands and state of anarch will reign when everyone decides to do so because they don't believe there is justice in court process. Salami went to far in accusing CJN of corruption in that he claimed he was asked to pervert justice in Sokoto state tribunal appeal whereas the only advise CJN gave was that he should stay judgement pending full investigation of a petition filed before CJN by one of the parties. Why didn't he resort to internal measures of investgating and discipling judge NJC? He went straight to the media with his case. He should just retire from suspension, I even heard his collegues in Court of Appeal find him to difficult to work with
