Landlady Sues Dead Tenant – Laughter in Court

There was a mild drama at the Ejigbo Magistrate’s Court, Lagos State, Southwest Nigeria, Tuesday when the court was told that the respondent in a civil matter before it died before the suit was filed.

The respondent, Bosu Felix Agunbiade, died eight years ago.

The landlady, Mrs. Funmilayo Oshinaike of 5, Araromi Street, Ejigbo, Lagos, dragged her dead tenant to the court to recover arrears of rent totalling N450, 000 and take possession of the apartment.

Elizabeth Agunbiade, wife of the respondent, who was present, told the court that her husband died eight years ago and her landlady knew, but still went ahead to file the suit.

She said she was not served with any court paper.

But the landlady told the court that she filed the suit in Agunbiade’s name because he was his tenant.

P.M.NEWS learnt that after tenant’s death, his family continued to live in the apartment. Two years ago, the rent was hiked and the widow was unable to pay.

Elizabeth’s revelation that her husband died eight years ago provoked laughter in court, with the magistrate wondering why a dead man should be dragged to court.

She later asked the widow to prove her claims at the next court appearance.

The matter has been adjourned till 5 February, 2013.

Lol, this should be an eye opener to other property agents/owners out there, the landlady should have known better to change the name in the tenancy agreement form to reflect the physical being. smiley

Why do they have to drag you to court before settling your debt??

The fact that her husband is dead should have no bearing on the matter of payment. She continued to live in the apartment long after he was gone, so pony up!!

If the landlady had kicked her out saying the person whose name is on the lease is no longer living there, this yeye tenant woman woulda cried foul, she would no doubt have gone around bad mouthing the landlady for kicking a "poor widow" out of the apartment.

There is no sentiment in this matter. . .PAY THE WOMAN WHAT SHE'S OWED!!

thank you. this is a debt issue and must be paid by the next of kin. if it was gratuity/pension, wont she collect on behalf of the dead husband.
the landlady not backdown. this is why landlords ask for money upfront and we shout.

The landlady should have added the woman's name to the lease. Worse still she should have asked them to move out after the tenant's demise.

This is a classic legal issue. The conflict between customary laws and grandfathered English laws, which for our convenience we renamed and called common law.

It sounded funny and unbelievable to the audience sitting in a courtroom, established and modeled after British legal system, and chaired by a wig-wearing magistrate, that a deceased person would be sued for non-payment of debts. This goes to show that we are naturally out of harmony with the common laws our leaders imposed to govern our conduct and beahvior in socirty.

Under common law, a deceased person.....in the capacity of their estate, can be sued to recover debts.

Under customary law, a deceased person cannot be sued to recover debts.

The conflict between our nature and customs to the demands placed on us by the adaptation of foreign and unnatural practices continously exposes our ignorance and incompetence to organize a prrfect social order for progress and performance.
