Kris Humphries has the edge going in as Kim Kardashian’s baby daddy….wooops!!! did I just say that….

Well findings reveal that if he (Kris) were to lay claim to the kid, Kim and Kanye would have to present “clear and convincing evidence” to a judge that Kanye did the “ish”…..yeah! the ish that conceived “KimYe”.

Furthermore, Radar Online reports that Kim Kardashian likely will still be married to 72-day fling Kris Humphries at the time of the birth of her and Kanye West’s new baby.

Kim and Kris have been separated for more than a year, but that don’t matter much in California, where the husband of a pregnant woman is PRESUMED to be the father. Fact is … it wouldn’t be hard to prove, since Kris hasn’t gone near Kim for a long, long time and it appears the baby was conceived while Kim and Kanye were in Rome 3 months ago.

Amid the divorce proceedings, Kris Humphries is also asking that Kardashian return the 20.5-carat, $2 million Lorraine Schwartz diamond engagement ring he gave her. Naturally, Kardashian is refusing. Because the Kardashian camp is not giving in to Humphries’ demands, the divorce cannot be finalized until the two appear in court. And also unless Kardashian submits to Humphries’ request that she admit their brief marriage was a fraud, then their divorce proceedings will still be ongoing upon the arrival of the Kimye progeny.

Seeing as Humphries’ demand is not likely to be satisfied, the divorce lawyers will reportedly set a date for the trial on a romantic Feb. 15 one day after Kardashian and West surely find some luxurious way to ring in Valentine’s Day. Also because of Humphries’ basketball schedule, the earliest date that a trial could come is June.
