Supreme Court Throws Out Petition Against Oshiomhole’s Quailification

The Supreme Court has set aside the ruling of the Court of Appeal which upheld a petition filed by the governorship candidate of the People’s Democratic Party (PDP) in the last Edo state governorship election, challenging the academic qualification of Mr Adams Oshiomhole.

Justice Bode Rhodes-Vivour who delivered the lead judgment said the appellate court erred in its ruling since the petitioner did not make the issue of qualification a ground in his petition before the tribunal.

He also added that it was a blunder on the part of the petitioner not to make the issue of qualification a ground for challenging the election of Governor Oshiomhole rather than smuggling it through the back door.

The Judge noted that since a petitioner is bound by his petition, there is no ground on which the petition will stand and as such the ruling of the Appeal Court was struck out and the ruling of the tribunal upheld.

The court however ordered the tribunal to hear paragraph 30 of the petition which sought to disqualify votes in five out of the 18 local government areas in Edo state as a result of alleged electoral malpractice and corruption

Prowise: Its a pity the judgement went this way. Though, Arhiabvere didn't file his petition properly, the fact remains that Oshiomhole doesn't have the genuine certificate. Given his boisterous character he would have long displayed it aleast to shame Arhiabvere if he actually had one. But what did he do? He spent millions, if not billions, of naira in legal fees to have the petition struck out. Whether the petition was properly filed or not; or whether its a pre-election matter or not, a substantive constitutional matter is the issue here. This is miscarriage of justice fueled by emotiöns and political interests. In a slightly similar case, involving Obama, he honourbly displayed hìs birth certificate to put to rest questiöns regarding his birth place.
This is a bad judicial precedent for upholding the tenents of our cönstitutiön. We shouldn't let emotiöns to becloud our sense of reasoning and judgement on sancrosant issues. Goodluck Oshiomhole!

Oshiomholeh filed a certificate before INEC. The onions is on the accuser to prove His case and not the accused.

utumunta: D issue was thrown out on technical grounds a la; issues nt raised at 1st instance cannot be entertained on appeal. We xpected d judgement and it does nt exonerate Oshiomhole, or otherwise, of d allegation.
