Woman Uses Toy Gun In Lagos Alleged Robbery by Tolexander: 8:37pm On May 27, 2013
Lagos – A 25-year-old woman, Esther Obianuju, who allegedly attempted to rob a woman of her valuables with a toy gun, was on Monday arraigned in Lagos.

Obianuju is facing a two-count charge of conspiracy and attempted robbery at a Lagos High Court, Igbosere.

The accused, whose address is unknown, however, pleaded not guilty to the charges.

The prosecutor, Mr W.A. Quadri, told the court that the accused committed the offences on Nov. 2, 2012, at No. 159A, Akerele Extension, Surulere, Lagos, at 2.45 p.m.

He said that Obianuju, who was armed with a toy gun, conspired with others and attempted to rob the complainant, one Miss Rukayat Abdulsalat, of her valuables.

Quadri, a state counsel, sought an adjournment to enable the prosecution to gather witnesses and evidence.

According to him, the offences contravene Sections 296 and 298 of the Criminal Law of Lagos State, 2011.

Mr Sporgeon Ataene, counsel to the accused, informed the court that a bail application had been filed and urged the court to consider it.

Justice Christopher Balogun, after listening to both parties, adjourned the case to June 11 for the hearing of the bail application.

He fixed July 9 for the substantive criminal trial. (NAN)

if the toy gun is capable of instilling fear on the victim which definitely will form part of the mens rea of the crime... u wont blame the judge for sentencing her according to law if the prosecution prove their case beyond reasonable doubt.

You are a liar. it is not that bad, justice should and will be done. What was her intention of using a toy gun to try and steal? How would the victim know it was a toy gun? if the intention was to steal and disposses and she achieved it does the fact it is a toy gun change the crime committed. I am near certain you have either engaged or plan on engaging in this manner of crime hence your quick support of the accused. law is based on precedents and the law will take its course else people like you will continue to pepetrate evil in our society.

She could possibly be facing the death penalty, as she essentially committed armed robbery. According to the Nigerian criminal code, armed robbery is punishable by death.
However, the suspect could be given a more lenient sentence, if the judge deems the toy gun as a harmless weapon.

I bet that this case will be fasten, and the lady sentenced for life, all becaus she is a petty thief.... I've always said it, that the very besw way to elude the present Nigeria law is to steal real big money. (like ibori, farouk, pension chief etc.) the worst that can happen is that you could be sentence 4 just two years with option of bail ...which u will only pay little from the much you stole.
All will need in this country is God's divine intervention
