Man remanded in prison for intimidating housewife with text messages

A middle-aged man has been remanded in prison by a magistrate’s court in Kwara State for using text messages to intimidate a married woman.

The accused, Toyin Hassan, was alleged to have used text messages to entice Mrs. Idowu Ahmed, contrary to Section 389 of the Penal Code and criminal intimidation, contrary to Section 397 of the the code.

According to the First Police Information, the woman reported to the police at the Share Police Station that the accused, who shared a compound with her, had been threatening her life through text messages and also any time the accused saw her with another man.

The police confirmed that it was the same accused who lured the woman out of her previous marriage to marry her but later abandoned her.

The magistrate, Mr. Azeez Oguntoye, in his ruling, said that to release the accused on bail would amount to aiding the accused’s intention and in effect, endangering the peace of the community of Share as a result of which the application of the accused seeking bail was refused.

He ordered that the accused be remanded at the Federal Prison, Lafiagi, and the case was adjourned till today.

I hope they stop the cat chase and remand husbands that abuse their wives verbally and physically in jail. We'll get there someday sha.

what if someone else have used your phone to send the text?

what level of punishement is to be given for such text message offence?

how do we define when a 'text message' becomes a crime?

thats exactly the point: your cellphone is not a weapon.

you dont need special licence to have a cell phone as compare to weapon; so at what point those it becomes a crime for which owner is liable?

No, your cellphone is a weapon. You can hit somebody on the head with it continuously till he/she is dead. The service providers keep call records and take your information before giving you the cell phone(for countries that have proper id) for a reason. You are liable for any misuse, terroristic messages etc as long as the phone is registered to you OR in Nigeria's case, they can track calls on the phone and zero in on you.


Lol, Cell phone is a weapon of mass destruction(for men anyway because that's how chics get them whenever they want to trifle)

If we are to go by your definition above; every thing is weapon. we both know this is not true.

Cellphone is not a weapon. The purpose is to make calls.

will people also be liable for calling wrong number or sending text to wrong number accidentally?

Except there are other hidden developments, i dont see why the man should not be granted bail, even if it is an offence to send threatening text messages, at least it's not an imbailable offence. this is simply a case of oppression
