Central, Kenya: A man who unzipped his
trousers and exposed his private parts to two
minors was Thursday sentenced to a 10-year
jail term by a Nyeri court.
Nicholas Kabira who is alleged to be mentally
unstable was found guilty of attempting to
defile the 12-year old and 11-year old girls at
Kandara area on April 18, 2012.
The prosecution called five witnesses while
Kabira presented four witnesses before the
Nyeri the resident magistrate Joanne
Wambilyanga.
The minors said they were playing when
Kabira
approached and asked them if they wanted
him to give them Sh50.
When they said they did not want the money
Kabira unzipped his trousers and asked them
to take off their clothes forcing them to run
away and call for help.
The girls reported the incident to Mr Harun
Ng’ang’a who runs a butchery in the
neighbourhood and pointed out at Kabira, the
court heard.
Mr Ng’ang’a picked up Kabira and took him to
his butchery where he interrogated him.
“He asked Kabira what the problem was,” said
Ms Wambilyanga.
“Kabira responded and said that he usually
had
dreams of having relationships with young
children,” noted the magistrate.
Kabira followed the 11-year old to her
parents’ house and unzipped again forcing her
to lock herself in the house.
In his defence, Kabira admitted he saw the
girls on the material day but denied doing
anything wrong.
His brother, Mr Silas Gitahi said Kabira had a
mental problem that usually made him violent
and always want to take off his clothes.
Dr Moses Richo said Kabira had been treated
at
the Nyeri Provincial General Hospital on
December 18, 2011 and that his mental
disorder was erratic.
The magistrate noted that Kabira concentrated
on his mental state while he did not deny
seeing the girls or being interrogated in the
butchery by Mr Ng’ang’a.
“The medical practitioner who was his witness
did not give evidence on his state of mind on
April 18 2012,” ruled Ms Wambilyanga.
The magistrate further ruled that Kabira was
of
sound mind and knew what he was doing
adding that the act meant he would have
defiled the minors if they had not run away.
Ms Wambilyanga said the two girls knew
Kabira well as they lived in the same
compound.
She then sentenced him to ten years for each
count.
