What I'm not understanding here is that is the lessor company registered under Part C of CAMA? The legal giant does not sound convinced about that. There's nowhere in our law that says a Pastor cannot venture into business.

well he is not telling you pastors cannot do business under different entity, but the private jet was a gift to serve as evangelism purposes for church, and the church is registered as non-profit organization, so you cannot turn it to a profit making business.

Our politicians and so called social critics are either confused or they seek to confuse gullible Nigerians. One may ask how many churches and mosques operated schools and universities do provide free and not for profit services. They all charge higher fees than government schools. The likes of Falana do not see anything wrong with that and the fact that they were supposed to provide not-for-profit services.

We need to honestly separate these pseudo-activists from the real activists. Gani remains the only true social critic that Nigeria ever had. The rest are politicians.

President of the Christian
Association of Nigeria, Pastor Ayo
Oritsejafor, of breaching the
provisions of the Company and
Allied Matters Act through the use of
a private jet belonging to a company
in which he had interest to smuggle
$9.3m cash to South Africa.
Falana said by the provisions of
CAMA, the jet which was allegedly
registered for the facilitation of
evangelism could not be leased to
another company for commercial
purpose, as CAN had said while
defending Oritsejafor.
The lawyer said this in a paper he
delivered at a seminar organised for
the Economic and Financial Crimes
Commission’s prosecutors by the
Justice Research Institute in Abuja.
He described as diversionary, the
statement credited to CAN that the
jet had been leased to another
company, apparently to deny
Oritsejafor’s involvement in the jet’s
mission to South Africa.
He said, “Pastor Ayo Oritsejafor, the
President of the Christian
Association of Nigeria, whose private
jet was used to ferry the money to
South Africa, has denounced those
who have dared to challenge the
involvement of a plane bought for
evangelism in the alleged smuggling
of laundered money.
“In spite of the diversionary
statement of CAN, the influential
pastor cannot dismiss the scandal
with a wave of the hand. With
respect, the explanation by CAN that
the jet was leased to another
company is an admission of the
breach of the law.
“A jet registered for the facilitation of
evangelism cannot be leased to
another company for commercial
purposes, as churches are
registered under part C of the
Company and Allied Matters Act as
non-profit making organisations.”
He noted that many Nigerian pastors
had been indicted in the United
Kingdom for investing church funds
in violation of the Charity Act.
He, therefore, said the CAN President
should apologise to Nigerians if he
was lucky to escape prosecution for
a breach of the provisions of CAMA.
The lawyer said, “In recent time,
some of our pastors have been
indicted in the United Kingdom for
investing church funds in business
in violation of the Charity Act.
“If Pastor Oritsejafor is lucky that he
is not prosecuted for breaching the
CAMA, he owes Nigerians a public
apology. The CAN leadership cannot
afford to engage in attacking its
political opponents in a matter
pertaining to the breach of the law.”
Falana also called for the adoption
of the recommendation of the
National Conference that the office
of the Attorney-General of the
Federation should be separated
from that of the Minister of Justice
and those of the attorneys-general
of various states be separated from
that of the commissioners for
justice.

isrecole: Please Learned Senior Advocate,can you pinpoint the Section of the Corporate and Allied Matters Act(CAMA) Pastor Ayo Oritsejafor contravened? My legal opinion is that,since the Church was registered under Part C of the Act,it becomes a Juristic person. So what stops a legal entity from dealing with another legal entity. Sir,even if you lift the veil, no fraud has been committed by Pastor Ayo Oritsejafor because the man of God gave good reason why the jet was leased out. With due respect Sir,if you can't come up with another plausible ground,I beg to say;you are wrong sir!!!

I can see the blindness of legal opinion here.

Few questions for you:

1. Does our Aviation Act permits usage of any Jet which differs from specific purpose it's been purchased for?

2. Upon leasing out d jet, what are d implications of transactions on it both from Tax n Financial Angel of it?

3. Does our law tax religion houses n their property?

4. Also, why does FG considered d jet to best for.d.scandal where better options were available......note d.jet was leased out on August 2nd, 2014? ...

National Civil Aviation Policy 2013 states

*For private aircraft owned or leased by individuals, only the family members of the owner/lessee of the aircraft will be permitted on board as passengers.

*For private aircraft owned or leased by companies or corporate entities, only the employees and members of the Board of Directors of the company will be permitted on board as passengers.

Yet some people see it that Ayo has not contravene our law.

The $9.3m Money-Laundering-Cash-for-Arm Deal is many questions demanding for answers.

Yet, some folks see it as normal or right thing.

*For aircraft belonging to non-scheduled or scheduled operators, only the employees and members of the Board of Directors of the company or the corporation may be permitted on board as passengers;

all operators will declare the identities of all passengers on non-revenue charter flights in the appropriate general declaration forms prior to obtaining ATC clearance.

GOD does not show partiality, so stop signaling pastors as special before GOD. Follow the Bible.

Consider David, a man after GOD's heart; he committed adultery and murder. When prophet Nathan informed him of his misdeeds, why didn't David accuse Nathan of judging him, or started shouting, "touch not my anoited?" Instead of that, David repented of his wrongdoings.

If anyone does what is wrong, whether the person is a pastor or not, there is nothing wrong in disassociating and humbly condemning the misdeeds.
