I don't know why I have much confidence in him then. He looks like a genius that he is and addressed the press very well.

I watched him on NTA news back then. The man was so confident and phenomenon.

Quite an unfortunate saga it was back then. In my belief, powers beyond the shores of Nigeria saw to it that Ministry of Health and medical field as far as their tentacles could reach frustrated this man and his efforts/research.
People kept asking 'why not give him the benefit of doubt and test it first' but for very flimsy reasons, the powers that be won't have any of that.

16years later? Ridiculous!

Another Nigerian Lawyer ruling on technicalities and not content.

Yeah. Nafadac may not have the right tools to test the veracity of the drug but that does not also make his claims real. We just like throwing caution to the wind and not reading between the lines.

When did it become the job of a lawyer to tell whether a drug would work or not?

What independent clinical test has this drug undergone before he started administering it to humans?

If he is so sure of the efficacy, he should undergo the right processes for such. There are always rules and guidelines for drug tests before they are approved. Many variables like the efficacy, reaction, safety, clinical proof of how it works, active ingredients used and their chemical components need to be sorted out before a drug can be sold on the staples.

Not someone waking up and telling us he can cure HIV. Na black man own dey always dey different.

That court must be blinded by nationalism! There is no evidence to prove that vaccine can treat AIDS. It is a vaccine for goodness sake. The court doesn't even understand what that means in the first case. Smh...!

Abalaka is a surgeon and both him and the court should know that a judge has no place in deciding what is a scientific fact and what is not. The fight has just begun Abalaka is evading well known scientific methods of establishing new authentic knowledge.

What kind of a country is this.

Unless someone can correct me, the function of a court is to arbitrate in disputes between individuals in the state or between individuals with the government.

Dr Abalaka's matter is not a matter of dispute between him and the government.

The court lacks the competence to to make binding pronouncement on a matter of national health.
That is the function of the government or it's agency.

In case anyone has forgotten, Dr Abalaka was touting and marketing to the public, a medical product, a formulation that had not gone through the normal scientific standard of rigorous clinical testing and trials, as is the norm in a civilized world. sad

In fact, as I recall, the federal government offered to sponsor such clinical trials to (a) ascertain and certify both the short term and long term efficacy of the medical formulation in question, (B) to ascertain the safe dosages for administration to various age groups, (C) to ascertain the possible short and long term side effects , if any, of the formulation.

These are standard requirements for any and all medical formulations that are in use all over the world.
As a trained medical doctor, Dr Abalaka, was expected to know and understand this more than anyone else.

But, as is common with our African people, he opted for the African way of doing things by trying to boycot and jump over the standard scientific and ethical requirements of his profession.
He was more interested in selling his concoction( That is what it is for now, until proper scientific clinical trails are done) to desperate AIDS patients for N70k a dosage.

In any civilised nation, he would have been jailed for posing a public health hazard. He was quite lucky that the federal government did not prosecute him.

Now, for a court to declare his concoction valid without the benefit of a stage 1 and stage 2 rigorous clinic trail is ridiculous, ludicrous and hilariously saddening.

Are we, as Nigerians , unable to measure up to the standard thresholds of civilised conduct in practically all of our affairs?

This is not true.
Dr Abalaka was already selling his concoction to people already infected with HIV and people already suffering from full blown AIDS.

If it touted as a vaccine, then a minimum of 3 yrs of clinic testing is required before it can be certified for public use.
This is all that the government ever wanted and asked of Dr Abalaka.

In the typical Nigerian attitude, Dr Abalaka wanted an exemption from the standard scientific and ethical rules of his own profession.

Shame on him.

So get the f**K into your brain that HIV leads to AIDS in most cases and therefore it is of no use having a vaccine without complete effectiveness because the carrier is as deadly as ever. I didn't say CURE but TREAT AIDS! You are the dumb here! Legalizing 50% effective vaccine in Thailand is a false. It just proved you have no idea about what it is all about. It's only a trial. Jeez! Stop being petulant!

It is off no use legalizing what hasn't passed through ethical clinical trial other than saying he took people blood all rather serum and cleaned it up before re-injecting into people. That is laughable! Another silver-Ebola-like treatment claim. He might just poisoned more people in the long run without doing rigorous lab tests!

The federal government offered to fund the clinical trials.

The government did the right thing. Public health imperatives should always triumph over cheap irrational sentiments and blackmail.

This is the problem with Nigeria. We wax sentimental when we should be rational, and then we stand aloof when we rightly should be sentimental.

Nigerians manufacturing stupidity since 1000BC! How many clinical trials have been conducted with this "drug"? How many peer-reviewed researches have been carried out with this "drug"
Court is not the best place to get approval while there are other agencies like NAFDAC, NMA etc.

medicine in ABU, Liverpool, etc as well as occupied various management
positions in the health departments of several establishments.
At different times, Dr. Abalaka had been consultant surgeon in Makurdi,
Lokoja, and head of department of general hospitals in Makurdi, Lokoja and
Gwagwalada Specialist Hospital. He is currently the medical director of
Medicrest Hopital, Gwagwalada, his brainchild.

You don't seem to get.
The issue has nothing to do with his academic qualifications. In fact, if he was true to his qualifications and professional ethics, we would not be talking about this issue.

Every single medical drug you have ever taken, from panadol to iv injections, all went through rigorous clinical trials before being released for public administration.

The rules were enacted long before Dr Abalala was born. It wasn't obasanjo that made those rules.
Abalaka studied and swore to practice by those same rules.

But as a typical Nigerian, he wanted an exception from accountability.

That is the issue.
