Buying property in Nigeria
It is a big task, that involve chariness and patience.
In my research and personal experience in real-estate market over the past 6 years, till now.
I got to know that, there is no property that will not be sold everywhere in the world, if the present generation refuse to, the coming generation can not be predicted on what will be there own reasoning, concern and notion to dispose it. Let leave that as it is.
My major concern was why most realtors fails to do there due diligence while soliciting for there respective clients. There inability to conduct proper verification of property title/document, before transaction may lead to a great disaster,which can probably result to loosing huge sum of money to fraudster who are looking for potential property buyers to prey on.
A property owned by a deceased ought to have probate/letter of administration on it, this document will reveal the names of the people that administer the said property after the death of the owner. it is a proof that necessary and require legal procedure has been taken to perfect the document of the property, while a copy would be submitted to the court, and a copy will as well goes to ministry of lands and attach to the document.
If a title search was conducted at the ministry,and there is encumbrance on it. It means the deceased/ owner use the property as a collateral to borrow money from a financial institution. In this situation the seller might claim that the loan as been cleared, yes some desperate home owner or agent will say so, but what will proof them right; is to bring-out the "DEED OF RELEASED" issue to them by the bank, this will serve as evidence that the owner is not owning them anymore.And the deed of released must be registered with the land ministry before any attempt is being made in proceeding on the transaction.
Let also look into real estate foreclosure, where many people think they can secure a better deal. Whereas it also has it own detriment.
If a bank is selling a property, or offer a property for sale at a very ridiculous price than the worth of the property even though at a competent price along-side others at the price-point, the first information to sought for, is to authenticate if the property has been legally acquired by the bank and the bank name appear on the title of the property,this will put you on a safe side. And if the name of the individual is on the property, without consent letter from the owner which clearly stated by the vendor, that the bank has the right to dispose his property, please don't buy it. Is better to play it safe than to begin having headache after the transaction has been made. True and right information reduce and eliminate risk in buying real-estate market. Kindest regard.
