Ministerial Screening A Childs Play. by Nobody: 5:22pm On Oct 13, 2015
The much awaited ministerial screening was nothing but a childs play. its against what Nigerians were expecting. from what i have seen so far its the usuall "Take a bow & go" and its so disapointing that its the change agents that are shouting "take a bow & go" without some high level of questioning to make the process look a little bit different from what we use to see.

Lai Mohamend instead of addressing reasonable isues on ground, he was busy propaganding insults and shaming the PDP. even some of the PDP senators were optionlessly shouting "take a bow & go". The question is what is the way forward with this ministers to be, because it seems every nominee is a political saint.

The first thing you should question is the powers of the senate to screen anybody. The constitution said the senate should "confirm" appointments and not screen them.
Every screening has been done by the relevant security agents.

We saw it coming, the leadership (ELITES) at all level of governance in our country will not agree to, or allow a change, so am not disappointed. Mr Buhari is just a tree that will not be allowed to blossom, by the next 3months his leaves would have withered and Nigerians will ask is this the CHANGE?

Are you really angry? Please take a second look at the constitution. All the nominees are Ministers whether the senate approves on decline. Sorry my dear. PDP is gone and gone forever.

Wailers can't write anything about Lai without the word propaganda forming part of it.

How do you "confirm" a nominee without at getting to know if actually the nominee is actually fit for such a position?

Or do you confirm payment without verification?

I hope you realise that if a candidate is sent to the senate and they refuse to send a response to the president in 21 days he automatically becomes a minister....so what's the screening about?

I guess you got your 21 days something from this subsection:

An appointment to any of the offices aforesaid shall be deemed to have been made where no return has been received from the Senate within twenty-one working days of the receipt of nomination by the Senate.

Section 147(6).

Please notice the bold phrase.

By virtue of subsection 2 of the same section, the Senate has the power to confirm appointments. Where subsection 6 will take effect is when within 21 day, the Senate could not communicate with the President on the status of these appointments.

If the Senate refuses to confirm an appointment, then any action contrary to it is a nullity.

That is why the ruling party has to lobby hard to ensure that these confirmations scale through.

We talk about the Senate not having the powers to 'screen' nominees. That's actually true. But its also true that the President may miss some vital information about the nominee and the Senate could spot this irregularity and hence do not confirm such an appointment. That's the spirit behind check and balances and oversight functions. The framers of the constitution had that in mind and so do not explicitly put that the Senate shall 'screen' nominees.

Remember the case of Hajiya Jamila Salik who was not confirmed by the 7the Senate.
