what inec,ministry of justice is doing presently according to yesterday news is illegal and cannot stand the test of time,the minister of justice said there is law for such incidents so therefore they won't go to supreme court,substituting candidate and crediting him previous votes is illegal, the only legal steps here is either James faleke is made the governor or cancell the election totally.

Since the death of Audu Abubakar, the Governorship candidate of APC and the leading candidate in the yet-to-be concluded Kogi state Governorship election, tongues have been wagging and opinions have been divided on what should be the next line with respect to the said election. To some, the election should be outrightly cancelled because the Governorship candidate of APC is gone. Secondly, APC followed the legal process in the nomination of Audu Abubakar and Hon James Faleke as the Governorship and Deputy Governorship candidates respectively. The Electoral Act never prescribe disqualification of political party on account of death of its Governorship or Deputy Governorship candidate. Considering that the Electoral Act and Supreme Court judgement maintained that political parties not candidates stand for election, it simply means APC remains in the race and in pole position to form new Kogi state government when Idris Wada's tenure elapse despite the demise of Audu.

Why Hon James Faleke Should Succeed Audu
That established, the next is who should succeed Audu Abubakar as APC candidate? Let us recall that the Electoral Act and Constitution was silent on what should happen in the event that a Governor-elect denounce his mandate before his inauguration as at 1998. When Atiku Abubakar rescinded his mandate for the VP candidate of Segun Obasanjo of PDP, INEC felt there was need for a fresh PDP candidate for a new election. PDP and the Adamawa state Deputy-Gov-elect Boni Haruna as then was went to court. The SC ruled that PDP won the election with Atiku/Haruna as candidates, and in the eyes of the law, Atiku was 'dead'. Hence, Haruna should replace Atiku as PDP Governorship candidate and be sworn-in as Adamawa state Governor. After the judgement, the Electoral Act and Constitution were amended to reflect the SC interpretation. In this situation, considering the fact that the law allows for the Deputy to succeed his/her boss in the event of death of the Governor-elect (after election has been concluded) and the Governor (after inauguration), it is only normal and in accordance with the positions of the SC judgements and the law tthat Hon James Faleke, the APC Kogi state Deputy Governorship candidate be upgraded to the substantive Governorship-candidate of APC, while the party nominates a new running mate.

The Position of Running Mate Is For Purpose Like This
We also have to realise that the purpose of running mate is not to 'fill space' but to step-in in case of any eventuality of the main candidate. This is why the VP assumes the role of President in event of death, and not the runner-up in the Presidential election. It is also the reason the VP-elect assume the position of President-elect in event of death of the President-elect and not the runner-up of the election. This is same reason the APC Deputy Governorship-candidate of Kogi state (James Faleke) will/should assume the position of Governorship-candidate and not the runner-up in the APC Primary election. Hence, the APC should 'do the needful and nominate a new Deputy-Gov candidate.

A Fresh Primary Is Illegal and Unconstitutional
However, should APC elect for a fresh primary, then that will amount to illegality as no section of the Electoral Act and the Constitution give room for primary when election is ongoing. I believe that the court will nullify it. It is my belief that the only legitimate thing is for Faleke to be made the candidate.

Why I'm Behind Hon James Faleke's Ascension:
My position on this subject is precipitated on the need for being on the side of justice irrespective of who the beneficiary may be. Justice is justice, there is no basis for opposing justice because it doesn't favor our ethnic or political scheme. For those against Faleke on basis of his non-Igala heritage, I urge you to accept the new development for in the interest of the state.

1, The elections were not concluded, hence the cases cited by Tonyebarcanista doesn't totally apply.

2, The deputy didn't run in the primary election. He was selected. Picking a deputy is a different game altogether. Inec don't have procedures for such selection. It's absolutely under the control of the party.

3, both late Audu and Faleke have not been elected at this point.

I taught APC did primary election which produced Audu as their candidate? Wouldn't it be better for the first runner up to now be their candidate rather than Faleke that was merely handpicked by the Late Audu. If Faleke should now be their candidate I think PDP will use the case of Taraba to defeat APC in law court because it literary means that there was no primary for APC.

How can the Igala claim that the sit of Governor belong to them alone? How can I be a second or third citizen in my own state? Why can they learn from the Urhobo in Delta State who gave same opportunity to other ethics groups around them? The Urhobos are d majority in Delta state but they give opportunity to other ethics group to be Governor, though they are said to be 5th largest ethic group in Nigeria but they did not hold any position in Nigeria Government but they never kill themselves nor burnt tire to show their marginalization nor do they become hostile to the Neighbouring community.
We all must learn to accept others. Let stop the me first ideology. By the constitution, as a citizen of This great Nation we are all eligible to be voted in & be voted for. Eligible to Govern & to be Governed.

You are not exactly correct, yes the TOTAL election results has not been concluded, BUT, the elections in most units, wards, local government has been concluded. It is only in a few polling units in some ward that elections had not been concluded. Remember, results are announced at each polling unit. INEC cannot cancel results of a polling unit once it had been announced and accepted by INEC .

The only controversy is in polling units where elections were cancelled.

With all due respect to the op.. I think the op. Knw little or noting about law. The law neva said in dis case to mk the deputy the flag bearer rather it said replace the candidate. Also the law stipulated dat the person who shal be return as the governor elect must av pass through all electoral process which include the party primary. So if Mr faleke wants to bcome the governor he shud contest the party primary he might just be lucky. OP hope u remember the election is inconclusive.

The necessity for the intended primary is a result of unforseen circumstance which was not provided for in the law. So, I don't think it will be illegal to do one. However, I support that Faleke should be allowed to fly the party's flag with the election almost won by a joint ticket with Audu.

Primaries can only be held to select a candidate to contest in areas where results had been cancelled, you cannot select another candidate to contest in areas where results had been declared, unless those results are also cancelled.

Point of correction sir, mind you the election was declare inconclusive, with this statement is only the party that has power to decide who to replace Prince Audu. to me the runner up in APC primaries to replace Prince Audu. Because if for any reason if prince Audu has some problems is his Runner up that will take over. For the case of Atiku the election was concluded.

So to cut the story short who ever is Prince Audu's Runner up during the APC primaries should Automatically take over the APC candidacy and continue. period.

Since there's no exact provision in the law for this we need to be careful because judicial precedence is more harmful.

Falake is out of the scheme cos a law says you must go through primaries to b a flagbearer which he ddnt. He would v bn the governor if they were already sworn in.

Why Hon James Faleke Should Succeed Audu
That established, the next is who should succeed Audu Abubakar as APC candidate? Let us recall that the Electoral Act and Constitution was silent on what should happen in the event that a Governor-elect denounce his mandate before his inauguration as at 1998. When Atiku Abubakar rescinded his mandate for the VP candidate of Segun Obasanjo of PDP, INEC felt there was need for a fresh PDP candidate for a new election. PDP and the Adamawa state Deputy-Gov-elect Boni Haruna as then was went to court. The SC ruled that PDP won the election with Atiku/Haruna as candidates, and in the eyes of the law, Atiku was 'dead'. Hence, Haruna should replace Atiku as PDP Governorship candidate and be sworn-in as Adamawa state Governor. After the judgement, the Electoral Act and Constitution were amended to reflect the SC interpretation. In this situation, considering the fact that the law allows for the Deputy to succeed his/her boss in the event of death of the Governor-elect (after election has been concluded) and the Governor (after inauguration), it is only normal and in accordance with the positions of the SC judgements and the law tthat Hon James Faleke, the APC Kogi state Deputy Governorship candidate be upgraded to the substantive Governorship-candidate of APC, while the party nominates a new running mate.

The Position of Running Mate Is For Purpose Like This
We also have to realise that the purpose of running mate is not to 'fill space' but to step-in in case of any eventuality of the main candidate. This is why the VP assumes the role of President in event of death, and not the runner-up in the Presidential election. It is also the reason the VP-elect assume the position of President-elect in event of death of the President-elect and not the runner-up of the election. This is same reason the APC Deputy Governorship-candidate of Kogi state (James Faleke) will/should assume the position of Governorship-candidate and not the runner-up in the APC Primary election. Hence, the APC should 'do the needful and nominate a new Deputy-Gov candidate.

A Fresh Primary Is Illegal and Unconstitutional
However, should APC elect for a fresh primary, then that will amount to illegality as no section of the Electoral Act and the Constitution give room for primary when election is ongoing. I believe that the court will nullify it. It is my belief that the only legitimate thing is for Faleke to be made the candidate.

Why I'm Behind Hon James Faleke's Ascension:
My position on this subject is precipitated on the need for being on the side of justice irrespective of who the beneficiary may be. Justice is justice, there is no basis for opposing justice because it doesn't favor our ethnic or political scheme. For those against Faleke on basis of his non-Igala heritage, I urge you to accept the new development for in the interest of the state.

you are right, which ever Way you look at it the APC has won the election. With APC leading with 41000 votes and 49000 votes being contested for. Its certain that all the 49000 voters will note be accredited and all the accredited voters will not vote. Secondly, there is no how all the voters will vote for the PDP even if all the supplementary election will hold in igala polling units. So add and subtract, the APC has won this election. In my own view, FALEKE should be allowed to continue the process and a running mate nominated for him.
My fear is that this might not happen considering the ethnic and religious prejudice in the state. The igala and Muslims are the majority in kogi state. So they believe that they must always be at the helm of affairs in the state, this makes it difficult for an okun speaking Yoruba to ascend to the government house. For we as a nation to move forward, religious and ethnic prejudice must be checkmated. FALEKE is a good candidate and I know he will perform.
