Falana Calls For Buratai's Arrest by Nobody: 10:29am On Dec 25, 2015
Human rights lawyer, Femi Falana (SAN), has called on President Muhammadu Buhari to prosecute the Chief of Army Staff, Lt. Gen. Tukur Buratai, alongside other soldiers involved in the violent attack that led to the killing of scores of Shi’ite members in Zaria, Kaduna State.

Falana, in a statement titled, ‘Armed soldiers who attacked Sheik Ibrahim El-Zakzaki should be prosecuted,’on Wednesday also enjoined the Inspector-General of Police, Solomon Arase, to allow all detainees arrested in connection with the clash access to their families, doctors and lawyers.

The human rights activist reminded the Police and the Army authorities that in the 1996 case between the late Chief Gani Fawehinmi and the late Gen. Sani Abacha, the Court of Appeal had ordered the Attorney-General of the Federation, the Inspector-General of Police and the operatives of the Department of State Services to allow the late Fawehinmi’s wife and personal physicians to have access to him in prison “at all reasonable times.”


He said, “It is pertinent to remind the army and police authorities that even under a repressive military junta, the right of access to detainees was fought and won in Nigeria. Thus, in Chief Gani Fawehinmi vs General Sani Abacha (1996) 5 NWLR (PT 447) 198 at 202, the Court of Appeal ordered the Attorney-General of Federation, Inspector-General of Police and the operatives of the State Security Services to allow the wife and personal physicians of the appellant, a political detainee, to have access to him in prison custody ‘at all reasonable times.’

“In requesting the Inspector-General of Police to allow access to the detainees, his attention ought to be drawn to Section 14(2) of the Administration of Criminal Justice Act which provides as follows:

“A person who has the custody of an arrested suspect shall give the suspect reasonable facilities for obtaining legal advice, access to communication for taking steps to furnish bail, and otherwise making arrangements for his defence or release.

“In the light of the foregoing, we urge the police boss to allow the detainees access to their family members, personal physicians and legal practitioners at all reasonable times. Having undertaken to end impunity in the country, President Buhari should ensure that the Chief of Army Staff and all the soldiers who took part in the violent attack and arson in Zaria are brought to book without any further delay.”

Buratai and his ilk should be brought before the ICC, even Human Rights Watch and Amnesty International published their report this week calling for their prosecution

I think the presidency is in support of the army's violent style of reaction to citizens. As painful as it may sound, in a democratic regime, there are civil ways of quelling violent protest no matter who is caught in d crossfire. It seems this administration hasnt come to terms that in civilian regime, u dont use war firearms on civilian protesters even if they turn violent unless u must hav declared a curfew or state of emergency.

Every human being's life is sacred and the actions of the COAS and his bunch of thugs leaves a lot to be desired. Even if he was blocked on the road, does that justify going into the homes of those Shiites after the fact and killing them in cold blood? That is murder, simplicita!

Now that the dust has settled a little bit, wnt not allow the injured persons access to treatment or is it until they die in detention?

The silence of the president on this issue also doesn't bode well. It's as if he doesn't care about those who were killed one way or another. Its not just about setting up panels of inquiries whose reports will end up in the dustbin, we need to feel as if our president truly cares.

People just keep shouting about tapes and videos. His does that change the fact that injured people in detention are not being allowed access to treatment. Why not just massacre them like the others then undecided

Is this man senseless enough to know that the North is very sensitive on issues like this? Is he senseless enough to know that the person involved is top officer in the country? Is also senseless to know that those shi'ites were wielding weapons if not life ammos but, cutlasses, bows and even stones and they pelted his convoy? Which Indian hemp wey him smoke to forget say these shi'ites refused him passage on a road wey government build... He should shine his eyes oo!!!

I totally disagree with Femi Falana on this.
let the various investigation panels submit their report on findings first.
it is the same people that will condemn the government for not acting swiftly to contain the nefarious acts of the sect if action were not taken on time. That was how boko haram started from a small compound in a sleeping town of Maiduguri. Today we keep blaming Jonathan for,not acting swiftly until the sects spread all over the North East.

let us look beyond the incident. What exactly was the intent of the sects that blocked the way of the army who we understand has to resort to self defense. I just felt bad about the innocent souls that have been killed or properties destroyed.

once again lets wait for the outcome,if,the investigating panels set up
