Ladies and gentlemen, the educational aficionados, the cerebral analysts and pundits, respected Nairaland intelligentsia and commentariat, observers and watchers all well respected Nigerian students both in Nigeria and Abroad, it's our pleasure to welcome you to the Second phase and the Elimination round of the Third edition of the NAIRALAND INTERSCHOOL DEBATE between the gladiator of Lagos state University

You are welcome once again to the elimination rounds in the ongoing Nairaland Interschool Debate, the first four debate for this stage was a hit grin back to back from Yabatech Vs Unijos to Abu Zaria Vs Lautech, to Unilag Vs Unilorin to Futminna Vs Delsu, leaving out Yabatech, Lautech, Futminna and UNILAG from Nairaland Interschool debate third edition race, with UNIJOS and ABU ZARIA in for the next stage, which of these two schools will join UNIJOS, ABU ZARIA, UNILORIN and FUTMINNA? Well I am not to decide that, join us on Saturday at 7pm.. . As we all know this stage is survival of the fittest, you lose you are out.

DEBATE RULES

Kindly read.

1.) The recommended font size is the default size (size 8.) and the colour is the default colour (black).

2.) The essay should be in maximum of 1000 words.

3.) The use of SMS language and abbreviations are strictly forbidden.

4.) All materials used should be properly referenced at the end of the essay.

5.) All essays must be submitted on the stipulated date and time.

6.) Sole representatives are not allowed during the competition, both representatives must be present.

7.) All representatives are to engage in rebuttals and give answers to questions raised by the judges and the audience.

PROCEDURES

6:55 -- Debaters(Timidelaw horlapelumi dejman, Geestarry Dongraspo, blesseddivah) and judges(Jarus, LarrySun, Isacolukay) register presence

7:00 – The Chief coordinator , Luxanne declares the debate open

7:00 - 7:30 -- Debaters post their arguments within 30 minutes, maximum word limit is 1000

7:30 – 8:30pm – Rebuttals - A debater takes on his opponent’s view, puncturing his or her points - This the debater does by quoting the said comment and then countering it with his or her own views.

8:20 – 8:40pm – Judges post questions to debaters either on what the debater has posited or revolving around the debate topic, albeit, this is not compulsory, it is acceptable for a judge not to have questions for the debaters... Judges with questions should please be specific as to which debater they are posting their questions to. E.g “Mr X, could you expatiate what you meant by subsidy? or ...., kindly give examples to your claim that the removal of fuel subsidy is justified.

8:40 – 9:00pm – Debaters respond to questions raised by judges

9:00 – 9:20pm – Two questions will be entertained from the audience i.e. viewers and this will be based on ‘fastest fingers’. After the 2 questions, other questions will be attended to after the debate or perhaps, if the debater is free during the debate to respond to them, he or she can do so, however, points will not be awarded after the 2 questions.

9:20 – 9:30pm – Debaters respond to audience questions and concludes their arguments. Debaters who were not asked any questions can still conclude his/her arguments during this time.

9:30 – 9:40pm – Judges compile their scores and mail to coordinators with a copy to Nairalandinterschooldebate@gmail.com

9:40 – 10:00pm - Coordinators announce results, after which the thread will be thrown open for regular Nairaland discussions.

“I don’t think you should support the death penalty to seek revenge. I don’t think that’s right. I think the reason to support the death penalty is because it saves other people’s lives.” - George W. Bush, MBA, 43rd President of the United States, in an Oct. 17, 2000 debate with Al Gore at Washington University, said in response to the question "Do both of you believe that the death penalty actually deters crime?". A good day to the Coordinator, Judges, Fellow talk mates and readers. Yet again in the words of one time United States President George Walker Bush my position has been communicatively phrased, “I support the death penalty because I believe, if administered swiftly and justly, capital punishment is a deterrent against future violence and will save other innocent lives."

In establishing my stand in support for Death penalty, it is important to understand the weight of the words in the topic in question. Death Penalty has been defined as "a sentence of death imposed on a convicted criminal." The Black's Law Dictionary has rightly defined a Crime to be "an act committed or omitted, in violation of a public law, either forbidding or commanding it; a breach or violation of some public right or duty due to a whole community, considered as a community. In its social aggregate capacity, as distinguished from a civil injury." (Wilkins v. U. S.) Corruption, defined as "the act of an official or fiduciary person who unlawfully and wrongfully uses his station or character to procure some benefit for himself or for another person, contrary to duty and the rights of others." (U. S. v. Johnson). On the other hand, The United States Department of Defense defines terrorism as “the calculated use of unlawful violence or threat of unlawful violence to inculcate fear; intended to coerce or to intimidate governments or societies in the pursuit of goals that are generally political, religious, or ideological.” All terms defined above are such which if allowed to reign in our society would cause a decay to the system as a whole, and therefore must be addressed with full attention. Why not then other punishments?

Each punishment has the aim it intends to achieve; by virtue of this certain punishments must be levied on certain offences to achieve the desired result. The effect of terrorism in the world today has even made the concept a difficult one to define, groups and bodies have to begin to give it their own definition in other to get rid of the negative vice correctly in their jurisdiction. Crime rate on the other hand has been on an increase in the nation at large or is it corruption which has eaten so deep into the Nigerian state and is known to be the root of underdevelopment, backwardness or stagnancy in the Nigerian situation.

Several reasons accompany my position on death penalty for these offences stated above, one of which is Death Penalty would serve as deterrence to the members of the society at large when it comes to commission of such offences. It would act to checkmate as well as prevent people from committing such offences. With the knowledge of the punishment attached to such offences which gives no second chance, many who may think of attempting such offences would have more reasons to refrain from such acts. Death penalty cannot totally eradicate the commission of the offences in question but will surely bring the frequency to the barest minimum.

Death Penalty is a means of incapacitation or disablement for such offence to be committed again. As a matter of general knowledge, whatsoever punishment other than death penalty gives the offender another opportunity to do same act again. It's just like a terrorist who is given a jail term and is latter released, the terrorist have another opportunity to carry out same terror attack again as opposed to death penalty where the society is totally free from the commission of same offence by same offender. The existence of those who commit these offences in our society after serving back-patting punishments is both giving others the thought and backing to commit same or makes others so uncomfortable living with the knowledge of the fact that the person who has caused them grieve in a terrorist case is still living.

Death Penalty is a punishment of retribution for the offences of crime, corruption and terrorism. Retribution refers to the punishment deserved by an offender; it is the punishment levied by the society against an offender and is a panacea against terrorism, crime and corruption because offenders would be aware that their actions would be followed by an unforgiveable punishment. They would be more fearful of the effect which they will get in same measure of wrong done. Humans have the capacity and capability to do right when they are aware that wrongs would be punished, Ernest Van Den Haag, PhD, late Professor of Jurisprudence at Fordham University, in an Oct. 17, 1983 New York Times Op-Ed article titled "For the Death Penalty, said "…..nothing will deter a criminal more than the fear of death. Death is final. But where there is life there is hope...”. Moral indignation is an appropriate response to inherently wrongful conduct, such as that of crime, corruption and terrorism, while the goal to lower crime through deterrence is worthwhile; lawmakers need to place special emphasis on the moral gravity of offenses in determining the proportionality of punishment therefore death penalty for the offences in question.

In finalization, it is clear prima facie that death penalty for the offences stated save lives. Not in any way should this be exercised with wild abandon. All levels of government, from the Federal, State and local officials must see to it that the implementation rigorously upholds constitutional protections, such as due process and equal protection of the law. With this application am sure we all now have one position which is, death penalty is a panacea for crime, corruption and terrorism.

Colin Powell once said; “Great leaders are almost always great simplifiers, who can cut through argument, debate and doubt, to offer a solution everybody can understand”. Good day moderators, distinguish adjudicators, co debaters and amiable Nairalanders. I (horlapelumi) representing an epitome of excellence, the Lagos State University stand to support the motion, “Death Penalty a panacea for crime, corruption and terrorism in Nigeria”.

So as to justify my claims I would be addressing this prestigious gathering by giving the definition of Crime, Corruption and Terrorism after which I would be supporting my claim not with just facts and figures but with authorities and not just mere speculations that might want to appeal to emotion rather than profound solutions.

Crime is a legally prohibited action or an instance of negligence that is deemed injurious to the public welfare or morals or to the interests of the state. Thedictionary.reference.com refers to it as a foolish, senseless, or shameful act.

Corruption, generally speaking is “the abuse of entrusted power for private gain”. Corruption can be classified as grand, petty and political, depending on the amounts of money lost and the sector where it occurs. If anyone doesn’t know what corruption is I will refer them to the recent national headlines on both press and social media about billions of dollars flying high and above Nigerians head to the private pause of certain individuals in government? Maybe you need to hear about the Abacha loot or you need to know the reason for the latest slang ‘Dasukigate’.

Ranging from petty bribery to virtually ordering the Central Bank of Nigeria to siphon money into private bank accounts in overseas countries, corruption takes various forms that only a specialist in the subject will be keen to detail. The usual defence of the small offender is to blame corruption on the extended family system, which puts heavy demands on meagre earnings, but when it comes to the scale of graft by those at the top echelons of government it is nothing but greed.

Black’s Law Dictionary, 7th Edition defines the word terrorism as “the use of threat of violence to intimidate or cause panic especially as a means of affecting political conduct”. Think of the bokoharam insurgency hiding under religious justification in the Northern part of Nigeria which has not only taken many life but has displaced many.

For those that don’t know;

Nigeria is the 6th country in the world with the highest crime rate with 74.14 (crime rate) and 25.86(Safety).

18th most corrupt country in Africa.

Obviously one of the most terrorised in Africa currently .

All this makes me want to ask, should an individual who out of their own self destructive will commit any of this act be allowed to live as a free man all in the name of imprisonment or criminal in question should be given psychological treatment while he is kept imprisoned. What they fail to understand is that psychological treatment is only given to somebody who is clinically proven to be a lunatic.

The last time I checked, over 13000 people has been killed by the bokoharam insurgency in the north and the very effort of our gallant military to fight insurgency is been put to futility due to lack of sophisticated weapons for this course resulting in the death of a large number of them. Two factors are collectively responsible for this; diversion of arm fund by some of the people in government and the continuous attack by the insurgent group. This has not only deprived both Citizens and the military of their life but have also displaced many across the country, many lifes have been lost directly and indirectly as a result of this actions. The question is; should these categories of individuals who has singlehandedly and contributively contributed to the loss of life of such a huge number of persons be allowed to walk freely on the street or sentenced to prison for years not worth a single life? Who knows, they might just return from such incarnation to become our president.

Also, if such offences as armed robbery are punishable by death sentence, would it be fair for corruption and terrorism to be punished with mere imprisonment? The difference between corruption and armed robbery is that while the former is done without arm the latter is with arms, the result of both which is theft or conversion for personal gain. What is good for the goose is outrightly good for the gander.

Come to think of it, expert opinions show that an average criminal in a Nigeria prison feed above #180naira per day. They still have life after all, yes! At-least, two square meals a day and for the lucky and buoyant ones, preferential treatments are given and all their needs catered for in the prison through the prison officials. How then do we hope to put a stop to corruption, crime or terrorism in Nigeria with mere imprisonment or imposition of fines? I so much remember the case of a governor here in Nigeria who was convicted of corruption in 2008 and asked to pay a fine of 3.5million by an Enugu high court. If all I have to bear for stealing billion after conviction is just a little from such stolen fund, why won’t I want to steal? Death penalty remains the best panacea for corruption, crimes and terrorism in Nigeria.

In conclusion, what more qualifies life than a home, family, properties, societal benefits and well protected rights in the society? This individuals are being deprived of this through indulgence in crimes, corruption and terrorism. Therefore, death penalty is not only an instrument of disablement and deterrence but also of revenge as its avail to the society fairly the pain that has been inflicted on it from either crime, corruption or terrorism for even the bible has said “Whoever sheds man’s blood, his blood will be shed by man, for God made man in His image”._ Genesis 9:6.
