Aggrieved House of Representatives candidates of a faction of the Peoples Democratic Party have stormed the headquarters of the Independent National Electoral Commission in Abuja to protest the continued delay to act on the Supreme Court judgment in respect of the rightful winners of the National Assembly seats in Anambra state in the 2015 general elections.

The protesters arrived INEC as early as 8am and took up positions at the entrance to the commission, chanting solidarity songs. Most of them displayed placards demanding that INEC issues their representatives certificates of return to resume at the National Assembly.

Speaking on behalf of other aggrieved candidates, Hon. Tony Office expressed dismay at the action of INEC Chairman, Prof. Mahmood Yakubu, in declining to grant them audience despite several letters seeking to meet with him. While alleging INEC bias, Office accused the former Acting Chairman of INEC, Amina Zakari, of being responsible for their plight.

He said the woman who is now a national commissioner led the affairs of INEC during the time when their names were struck out from the election list.

The protesters were prevented from gaining access to INEC premises and after about an hour, the leader of INEC security team asked their representative to come in and deliver their letter.

No the Fact is that the Supreme Court Affirmed the judgement of Justice Chukwu of Abuja FHC, which held that ONLY Oguebego group elected primary candidates, of Chris Uba, Okonkwo, Emeka and HOR members, are to be recognized by INEC. But after Sup. CT rulling, Andy Uba group reportedly bribed the INEC consortium lawyers with 5 Million dollars, and some of that money may havve found its way to INEC chairman's pocket. That is why he is dragging his feet in obeying a Clear Sup. Order affirming Justice Chukwu's order.

There shouldn't be any controversy in the Anambra State matter to cause any nuisance as presently being experienced. The Ejike Oguebego led PDP caucus is only empowered to conduct primaries for the state ellection and anything concerning PDP in the state. If you study the decision of the Supreme Court in SC/37 you will see that a recent case wase cited and where the court held that State Executive of a Political Party has no power to conduct Primaries for the National Assembly seats.
The controversy was also attended to when INEC sought a clearification on same matter, although the Supreme Court declined jurisdiction to review or re-give it decision in the SC/37 case, Okoro JSC laid it to rest in His rulling of the lead judgement.

I think the protesters are only ired to force the INEC to do the biddings of their sponsors.

INEC Approached the Supreme court for clarification of their earlier judgment, the Supreme court told them that what was before it was the issue of the subsisting order emanated from the federal high court in respect of the State excos and NOT who rightfully deserve to be in the National Assembly.
Therefore the issue of the candidates were never part of the suit. You cannot bring any action against any party that was never a party in your suit. They should go back to the federal high court to claim their seats.

The Supreme Court or any Court for that matter, ONLY rules on the question before it. The question before Abuja FHC which was wholeheartedly affirmed by the Supreme Court is Whose list of candidates should the INEC accept for 2015 Anambra National Assembly Elections? The Oguebego Faction list or the PDP caretaker comittee list?

The question of who has the RIGHT to conduct National Assembly primaries was neither before Justice Chukwu of FHC Abuja nor before the Supreme Court.

Therefoe Supreme Court's decision affirming Justice Chukwu's Judgement, does not in any way upturn its precedent that ordinarily, under normal circumstances, the National Working Comittee shall elect its national Assembly candidates. However, the instant case is distinguished, due to the fact that PDP, despite a susbisting FHC order, flaunted Justice Chikwu's judgement ordering the PDP to worlk with the legitimate Anambra PDP, Oguebego led Exco.

So rather than obey Justice Chukwu's order PDP set up an illegal caretaker comittee to select Andy Uba, Odua and co.

Now here are the two Supreme Courts judgements. The real facts NOT inuendos:
I welcome all Nigerians worldwide to review the two judgements of Sup. CT on this matter, and be the judge for themselves:

On January 29, 2016 "Supreme CT" decsion affirmed Justice Chukwus judgement and held that:

1. — That it is hereby ordered that the purported caretaker committee/ ad hoc committee is illegal, null and void.
2. — That any delegate list or nominated candidate that emanated from the congress/ primaries conducted by the caretaker committee or ad hoc committee is illegal, invalid, unconstitutional, abuse of court process, null and void and cannot be used for any purpose.
3. — That 1st defendant (PDP) are hereby restrained from forwarding, sending or submitting to 2nd defendant (INEC) any delegates list or nominated candidates that emerge from congress or primaries conducted by the caretaker or ad hoc committee.
4. — That 2nd defendant (INEC) is restrained from accepting or receiving any delegate list or nominated candidate that may emerge from congress/primaries conducted by the caretaker committee except those that emanate from the plaintiffs. [Oguebego group of Chris Uba, Okonkwo, Emeka, and HOR members]
5. — That PDP was in flagrant disobedience and contempt of the order of this court made on 10th day of October 2014 and reaffirmed on the 24th of October 2014.

On February 24, 2016, "Supreme CT" decision Re-affirmed its Jan. 29, 2016 judgement, refused to review its judgement, dismissed the compromised INEC consortium lawyers 'Motion for Clarification and held that:

1. — That it is hereby ordered that the purported caretaker committee/ ad hoc committee is illegal, null and void.
2. — That any delegate list or nominated candidate that emanated from the congress/ primaries conducted by the caretaker committee or ad hoc committee is illegal, invalid, unconstitutional, abuse of court process, null and void and cannot be used for any purpose.
3. — That 1st defendant (PDP) are hereby restrained from forwarding, sending or submitting to 2nd defendant (INEC) any delegates list or nominated candidates that emerge from congress or primaries conducted by the caretaker or ad hoc committee.
4. — That 2nd defendant (INEC) is restrained from accepting or receiving any delegate list or nominated candidate that may emerge from congress/primaries conducted by the caretaker committee except those that emanate from the plaintiffs[Oguebego group of Chris Uba, Okonkwo, Emeka, and HOR members .
5. — That PDP was in flagrant disobedience and contempt of the order of this court made on 10th day of October 2014 and reaffirmed on the 24th of October 2014.

In light of the foregoing, a Non-compromised INEC Consortium Lawyers would have advised INEC to immediately withdraw the Certificate of Andy Uba, Odua & Co and issue the already prepared Certificate of returns to Oguebego group of Chris Uba, Okonkwo and Co.

Bottomline, but for the compromised INEC consortium lawyers, the Supreme CT's decision no 4 prayer, 4. — That 2nd defendant (INEC) is restrained from accepting or receiving any delegate list or nominated candidate that may emerge from congress/primaries conducted by the caretaker committee except those that emanate from the plaintiffs.[Oguebego group of Chris Uba, Okonkwo, Emeka and HOR members] its plain to all English reading peoples worldwide, that pursuant to this No. 4 Sup. CT rulling alone, INEC shall withdraw the Cert. of Returns of Andy Uba, Odua & Co and issue Cert. of Returns to Chris Uba, Okonkwo and co. Period.

In conclusion, as I noted in my earlier post on this matter, Inec should be purged. It is evident that Yakubu, may have been compromised and that is why he is dragging his feet in obeying a clear and unanbigous Supreme Court Order.
