Dr Boonyamin Ayotunde Oyeneyin's reason for showing a lack of integrity in not honouring a binding legal agreement to leave on the 31st October 2016 per agreement reached on 5 April 2016 is quote his text to me on the 31st October 2016

"the very heavy rains in the last few months has made getting accommodation impossible as everywhere has been flooded. I implore u to give me till latest January ending to get a place because of this unforseen circumstance"

Coming from someone who lives in the same compound as me and was sent a text message a week prior to remind of leaving date but chose not to respond but in the meantime visited the local police station a couple of days before to fabricate a petition against his landlord it shows the character of the person. I call them a "Nasty piece of work"

In the meantime Dr Boonyamin Ayotunde Oyeneyin expects to

1) Continue to live rent free as he has not paid any rent for August to date
2) Not paid any service charge from January 2016 to date
3) Has a wife who is essentially in behaviour an uncouth, illiterate, no home training, ill mannered, destructive and aggressive intolerable nuisance.

These are the same people who specialise in taking advantage of people.

Washman will be given clothes for 2 full days and paid N1500 asked to iron for them and paid nothing.
Cleaner will be asked to clean up after their naming ceremony and paid nothing despite contributing nothing to the cleaners wages for 11 months.

PETITION RE: MR AND MRS BOONYAMIN AYOTUNDE OYENEYIN-THREAT TO LIFE
Despite our attendance at your premises on the 3rd November 2016, Mr and Mrs Oyeneyin have continued to threaten my life and continued their verbal and physical abuse of me this morning being the 4th November 2016. ( Audio evidence obtained but video was blocked by Mrs Oyeneyin hitting me with a bedsheet). I will send the audio file to you if you provide an email address or whatsapp number.
On 3rd November 2016, your officer insisted that I write a report statement and also sign an undertaking as a condition of allowing me to go home to my 8 year old who was at this time back from school and without adult supervision. I withdraw both on the basis that they were illegally obtained.
Instead of upholding the law and Contrary to the provisions of Law No 6 of 2007 your Police officers have been advising the tenant that the Memorandum of Understanding is not binding and neither is it enforceable and have been giving alternative instruction which they are not qualified to give to tenants.
I now require that legal action be pursued as Mr and Mrs Boonyamin Ayotunde Oyeneyin are incapable of peace and continue to threaten my life and that of my household. In the light of the persistent threat to life, I reserve my right to self defence.
Acts of violence and intolerable conduct/nuisance
• Dr Oyeneyin’s wife kept inviting back an uncouth ex-tenant and together have been leaving juju to harm me and my child and insulting me.
• Despite the plumber telling Dr Oyeneyin’s wife not to use the leaking waste pipe until it can be rectified, she continued despite knowing that her actions meant that this flooded my living room with waste water leaving a waste stench. This action contributed to an inability to rent out the lower flat for over 18 months.
• Dr Oyeneyin’s wife will dust her rug right in my face while lying in my bed.
• Dr Oyeneyin’s wife will put on the water pumping machine and leave the water flooding the compound for hours. Another tenant complained that this disturbs his sleep and he constantly has to wake up at night to put the pumping machine off
• Dr Oyeneyin and wife will put on Generator throughout the night making sleep impossible for others and despite request that all put off generator at midnight only Mr and Mrs Oyeneyin refused in a compound of 8 tenants. Most recently 8 October 2016(On until past 4am), 4 November 2016(On until past 3am).
• 24 October 2016 reminder text was sent to Dr Oyeneyin about handover of keys per memorandum of understanding. Dr Oyeneyin did not respond.
• 27 October 2016 – I later discovered on 3 November 2016 that Dr Oyeneyin sent a petition to the police on this day(dated 27 Oct 2016 copy was not provided to me).
• 31 October 2016 – Today is eviction date per CMC memorandum of understanding. Dr Oyeneyin sent me a text that he will not be leaving as per the CMC memorandum of understanding dated 5th April 2016 but will stay until end of January 2017.
• 3 November 2016 – Assault and violent conduct of Mrs Oyeneyin. Mrs Oyeneyin hit me and husband and wife then ran to Ajiwe police station to report that I poured water on her.
• 4 November 2016 – Husband and wife threatening violence and Mrs oyeneyin hit me with a bedsheet whilst I was in front of my flat to stop me video recording her violent and destructive conduct. In the audio Mrs Oyeneyin stated
 She is going to kill me
 She is going to destroy me with the Quran
 She is going to beat me
 She is going to lock me into my house or lock me up
 The house I built I will leave it for them
 Her husband will destroy any notice I put up and my property
 She will frustrate my life such that I leave my house for them
 She will put the generator on until 5am and wait for the bastard who will tell her not to do this
 I am a witch and talking to my househelp she should run away from me
I had to sleep in the living room because true to her word she kept the generator on all night.
• 7 November 2016 - I plan to attend Ajiwe Police Station to report continuation and need to advice that they pursue legal action as it appears that Mr and Mrs Oyeneyin are incapable of peaceful co-existence. (per Audiotape).

Sometimes being a landlord is fraught with problems especially if you live in the same compound with them. The ones wey dey fear to fight landlord will be nasty and looking for trouble of other tenants and they will come to you to settle quarrel. I think the best thing is for landlord to live alone. Let lawyers deal with every thing tenant. Its better if the tenants dont get to meet their landlord sef.

Hope you are doing good despite.

This is sad, but don't worry; things will pan out. They always do.

From your version of event, I think sincerely you are handling this wrongly. All I can make out from your post is that you've lost control and the recalcitrant tenant is dictating the pace. You need to be above your tenants in enforcing rental rules; no trading of words; as a Landlady you should not be seen or heard quarreling with your tenants. The rules which I know you know all too very well are very clear; any tenant who has constituted themselves into a nuisance to you and others and all hope of reasonableness to prevail can't be achieved should vacate the tenancy. The Police cannot determine grounds for the vacate of tenancy but the courts. The police should only be engaged for a specific or several breach of private or public peace and if that breach of peace involves grievous bodily harm (GBH), then effort should be channelled to charging the case to court or within the premise of the police adopt ADR (alternative dispute resolution) refraining all parties to act within the law. Please note too that a Landlord/lady can also constitute a nuisance in their property in the eyes of law. The police cannot detain a tenant indefinitely, the police will always release the tenant after the complaint has been made, the police cannot enforce the terms of your tenancy to your tenants, the courts can. So the police will find it hard to stop your tenant from running their generating set or the sewage if this was not contained in the ADR if there was one. So if you careless about ADR and no wish to engage the criminal court, don't waste your time and money with the Police. Please note that a threat to life in the first instance should fall under ADR.

So please gabbytabby, follow the lawful channel of eviction and be patient; SURULERE......again accept the inconvenience truth that for ALL evictions, Landlords/ladies will be out of pocket. Please no more threats, exchange of words, social media campaign. Just go down the eviction route and bid your time. At the end of the long and winding slow court process, you will have your property back. that has always been the case. As for any outstanding rent, bring that up during the legal process of eviction and the court bailiff will enforce payment through but not limited to seizure of personal property in the tenancy or elsewhere. There is NOTHING like free rent during eviction. It's a myth. And again, the tenant will foot the bill/cover the cost of eviction. It's well.

Pheww, being a landlord is not easy, while narrating the challenges facing us concerning of one of my mums tenant to someone yesterday he said he would rather use his money for business than build for rent.

All the Nigerian Police need is a mobilisation fee and when tenant starts to pay them to come and harrass person for him house some will even teach tenant what lie to say, how to get violent and what not. Join tenant to dey abuse you for police station, illegally obtain statement and undertaken I got them on tape but person need to choose him battles.

The mediation process sef. I requested their 7 day notice on the 1st November which I should get straightaway or within days and to date I get tossed from pillar to post . Admin says lawyer should take to head office for signature but have refused to take it from her. Lawyer insinuated that admin did not give her and admin can take to head office. It transpired that the relevant Director visited the unit Tuesday gone and nobody prepared the notice or gave it to her. People suggest it might be money matter me I say this week if I have to go head office go raise query so be it.

I find the system frustrating when it takes 30 days from request for enforcement to get issued a last 7 days notice before enforcement. This invariably gives additional 37 days.

This is not consistent either cos my first similar request took an acceptable 7 days of what is essentially a single A4 page template that requires you to add name, address and date. I definitely need clarification as to the expectations.

A sad day cos I left home to attend to a family emergency and in the time that i was away they smashed window, ripped net etc. It appears that another police visit is unavoidable even when I have lost faith in this avenue.

I have just listened to this Recording while searching for something else and l humbly DISAGREE with your position on the matter.

I dont know if you listened to the tape before your comments but a situation where a Tenant threatens that the she would frustrate the Landlord to leave her house, threatens diabolical charms on the Landlord and intentionally but unnecessarily decide to inconvenience other occupants, is not acceptable.

While l agree that the video does not paint a complete picture of what transpired in the past (and l always give benefit of doubt to the other party, when their own version of events is not available) but the little l heard on that tape is so annoying l feel like dragging that tenant out of that house, right now................ but that would be unlawful.

I think pasting their pictures on Social Media is a reflection of the level of frustration this landlord has gone and is going through, though privacy laws might not support this.
The Police do not generally play any vital role in a Landlord/tenant dispute and like @Diordaves has said, the Courts and legal process is her best option.
The "Nigerian" Police see themselves as exploiter and beneficiaries from Chaos!
Being that the House owner is a woman, (and probably a Single Mother), the tenants might be taking advantage of this.
I could hear the Tenant harping on "You dont have anybody to call"! And that tells me they feel she is isolated and thus can be taken advantage-of, which l think is very wrong.

Just like some Landlords are terrible, some tenants are just from Hell. They want to live Rent-free, dirty the compound, mess-up things, throw wild parties, inconvenience other tenants and act like they own the house!
I have met quite a few in the last 20-25yrs and have come to know that Landlords and Tenants are never designed to be Friends ... just "Hi-Hi" is how far it can go.
What you want is what they dont want to give; what they want to give is what you dont want!

Landlords need to generally, "prepare for this sort of days", before it happens.
Have clearly mapped-out strategy, usually consisting of various 'options' (depending on the severity of the case at hand) to deal with any recalcitrant tenant.
Dont allow it to get to the level where the Tenant feels he/she has an advantage or can threaten you in your own house.
I generally dont show any pity or civility when it gets to this level, l will use all necessary means (but ensure that l cant be faulted openly), legal, illegal, to deal with the situation.

If you dont have the leverage, you should be prepare to "buy it/pay for it" and as such, dont mind what it would cost you.
It could come in form of legal fees or payment for alternative means, as long as you "make a point" and let the other Tenants get the vibe that you cant be messed with.
They are watching and monitoring developments closely and forming their own opinion, for future use, as well.
When l was young, my Mum use to say she is always ready to spend #1,000, to remove the insulting stain of a #5.

I think @Diordaves have given the best advice on the matter.
Ignore them while pursuing them legally. Get a sound Lawyer and pursue them in court.
They will cry last the day Bailiffs come to "fonfey" their property because Tenants that talk the way that woman does, is the type that would disobey or not respond to a court summons.

Dont lose faith, it is just the "beginning of a process", a process which you and your Lawyer must hasten, to get it out of the hands pf the Police!
Once the matter is in a Law Court, the Police influence ends and they cant interfere.

Collect as much evidence (Pictures, Video, et.c.) and institute a legal case at the court, for damage to property.
You dont need to wait for the Police, to go to Court.
This has gotten out of hand! Next thing they would 'grow confidence' to do is attack your person.
take your personal security, seriously.
