Only in Nigeria...Smh. In the US wearing a camouflage outfit whether cap, jackets or Tshirt signifies your love, respect and solidarity with the members of the Armed forces. In fact, this is the case in all civilized world, I guess Nigeria is just too backward to reason well as a country. Smh

What is the punishment for wearing a military uniform if you are not a member of the Nigerian armed forces?

Should you be disgraced and assaulted as is being done by some military men in Nigeria?

Many Nigerians have been asking that question following the inhumane punishment meted out on a physically challenged man by some power-drunk soldiers in Anambra state. No military officer is allowed by the constitution to manhandled, assault or harm a civilian for wearing a military uniform, but the law provides appropraite fine for people who commit such a crime.

Here is what Section 109 of the Criminal Code of Nigeria says:

109. Any person who, not being a person serving in the armed forces of Nigeria nor a member of the police forces, and with intent that he may be taken to be such a person or member as aforesaid-

(a) wears any part of the uniform of, or

.

I think the Law is pretty clear here.

Wears any part, even if you wear just the trousers with t-shirt and timbaland,
You are liable to face the consequences.

Shevon is just Quoting the part that suits his argument ignoring the very first line.

Who can equate one month in prison to Monetary value here?

If someone wears a camo, can you tell whether or not he has the intention to use it to intimidate his fellow civillians except he/she is caught in the act? The Law does not read minds neither do our soldiers.

Very true... But some unscrupulous entities will wear it with the intent to impersonate...
Thats 9ja for u.. A lot of ppl ave been caught flying d camo in pretence, all in d bid to oppress and to have a feel of the power that comes with the uniform ...

In d case of d handicapped guy.. He didnt wear it for negative reasons... Thats probably all he had to wear...

Anyway... All dis one nah grammar... 9ja is all about .."Monkey see Monkey do"... Nor be everything be baff up for 9ja...

This is hilariously true. I feel sorry for the cripple tho', I honestly do.

But agreed, that a lot of folks wear it to impersonate and do all sort of trash. However, look at it closely bro, it's all the question of a messed-up mentality. The khaki boys prefer to be feared than respected which is the case elsewhere, so like every human, people want to be feared. So they wear those uniforms and act the devil they wish to be. Sorry Nigeria

Provided that this section shall not apply to the wearing of any uniform or dress in the course of a stage play or in any bona fide public entertainment.

Celebs could say they where it for public entertainment

I think this means civilians can where uniform as long as the don't impersonate Uniform officers or make it appear to look like they are officers as long as they can maintain their civilian status they should br fine.

My broda, 9ja soldiers don't read o, some. barely understand the written language.

Even if u shout "oga officer shebi na 10naira fine?" , they'll still beat the living daylight out of you.

To avoid story that touch, avoid their attire.

The day I made that mistake, I was only grateful to my creator for giving me fast legs. If you see run wey I run and how they were chasing me, you'll be tempted to think I just murdered the president.

i think the onus is on whoever that is taking you to court....to prove that you actually have intent to impersonate.....

Nope. Where a officer has reasonable reason to suspect that you intend to commit an offence by virtue of your being found in possession of such items as might be used for such crime, the onus is entirely on you to prove your innocence

I have highlighted the relevant part of the law. It is not an offence to wear military or police uniform unless you wear it with the intent to impersonate a soldier or a policeman.

If you dare put on a military outfit following your understanding of the constitution you are on your own if you are caught by a crazy soldier
Re: What The Constitution Says About The Civilian Wearing The Military Uniform by Nobody: 7:02pm On Feb 19, 2017
The citizens are the problem, where in other develop worlds have you heard of a citizen that wears the camo claiming to be a soldier?

But in Nigeria, with their evil mindset they will do all kind of rubbish with it...

Nigeria has not gotten to that stage yet, when we get there I'll support civilians to wear it..

They are exempt because for you to be guilty you must have the INTENT to deceive the public that you're a military personnel. Davido and Co are, obviously, popular figures whom the public know are not military personnel.

some what will happen to the manufacturers of such wears, because its everywhere in the market. since, the military wears sold are without badges or ranks I don't see anything wrong wearing such. or does it look like Jesus' garment that healed a bleeding woman in the bible??

In a case where you are caught with items that suggest an intention to commit, yes. It works the same way everywhere; for example, if you are found with tens of thousands in cash in the UK, you can be detained until you provide a suitable explanation of why you have such an amount of cash in your possession.
