ANOTHER BLOW FOR PDP-EDO STATE

A court have declared the 2007 election into house of Assembly that bring Umogbai Christian (Etsako Central) into the State legislative arm as Null and Void.A new election should be conducted within 45 days.
Before this verdict the house of Assembly are made up of 24 legislators,13 members are PDP and 11 AC.

Appeal Court declares Edo Assembly seat vacant
After two years and eight months legal tussle, the Court of Appeal in Benin on Monday called for a fresh election into Etsako Central Constituency in the state house of assembly on the ground that there was no election in the area on April 14, 2007. In a 45 minutes judgment delivered by Justice Saka Ibiyeye, the court upheld the decision of the lower tribunal which ruled on April 14, 2008 that there should be a fresh election in the area since the Independent National Electoral Commission (INEC) had cancelled the election and fixed April 28, 2007 for a bye election only for the election umpire to reverse itself on April 21 by declaring the Peoples Democratic Party (PDP) candidate in the election, Chris Umogbai as winner. This declaration led the Action Congress (AC) and its candidate, Johnson Oghuma to challenge INEC at the lower tribunal which ordered for fresh elections but the decision of the lower tribunal was challenged by the PDP and Umogbai in the appellate court. Ibiyeye ordered INEC to withdraw the certificate of return issued Umogbai and ordered that he "vacate his seat in the state house of assembly and INEC is hereby ordered to conduct fresh election within 45 days." With this decision, PDP now have 12 members while AC retains its 11 seats
