The National Chairman of the Peoples Democratic Party, Ali Modu-Sheriff, has been dragged to the Federal High Court, Lokoja for allegedly breaching the judgment of the Port-Harcourt Court of Appeal.

The suit marked, FHC/LKJ/CS/13/17 filed by Suberu Yakubu, a member of the PDP from Okene, has Prof. Adewale Oladipo; the PDP; and the Independent National Electoral Commission as defendants.

In the originating summons filed by the counsel for the plaintiff, Usman Sule on Monday in Lokoja, he raised seven questions for determination and sought seven reliefs.

In the originating summons supported by a 32-paragraph affidavit, the plaintiff said the Court of Appeal, Port-Harcourt Division in an appeal numbered CA/PH/349/2016 delivered on February 17, 2017 ordered parties to maintain the status quo as of May 18, 2016.

But Yakubu alleged that in defiance of the order, the PDP National Chairman went ahead to hand pick Dr. Cairo Ojugboh as the deputy national chairman and Bernard Mikko as the national publicity secretary of the party, among others.

Among the questions raised for determination were whether the action of the national chairman conferred authority on the 1st, 2nd and 3rd defendants to hand pick other persons to serve as members of the national committee of the party; whether the action was not a breach of the PDP’s constitution and “outside the context and plain interpretation of the Appeal Court judgment.’’
