Did he kill some one while collecting the phone ?

Was he armed when he went to rob the person ?

The constitution is clear on the 2 listed above.

The punishment is Death By Hanging.


What we should fight for is the same Death By Hanging on Politicians who steal our money too.

Was it a case of ARMED robbery ?

Did he threaten the victim with any harmful object? Even if it's a stone or table knife or fake gun?

If he did, then the judgement is in order.

According to Nigeria's law, ARMED robbery carries the death penalty irrespective of the value of the item involved.

Nigerians should learn to understand issues before jumping to conclusion. This guy in question did not just steal a phone, he killed his victim during the stealing act. We should check for facts first. The judgment was because of the killing not because of the phone. Infact he disguised and asked his victim to borrow him a phone to call someone that he was stranded and he ended up killing the victim

And they conveniently omitted the fact it was a case of armed robbery which is capital offence. The victim was stabbed in the head according to the previous report and left to die. Only Providence saved his life.

Are you sure the court sentence is death by hanging for stealing a phone? When did stealing become a capital offence that results in a death sentence? If for certainty the boy sentenced to death for stealing, except he killed someone in the process, then the sentenced is manipulated by someone. No high court judge with integrity and conscience can decide such a case, so the judge has a question to answer. The law is explicit on what crimes can necessitate a death sentence. This is an easy case to win, the boy should just appeal the case.

They told him they were victims of a robbery attack and would need his assistance to call their brother to bring some clothes for them to put on.

The unsuspecting Habila was touched by their story and in the process of dialling a number that was given to him, the 2nd convict (Godfrey Emmanuel), brought out a knife and stabbed him on the head, while Tope Abiodun escaped with the phone.

It means this country is a joke, if the judge truly sentence the young boy to death cos he stole phone of 87k? Yet a forner governor that stole billion was given a five years jail time, and even now he's on bail due to health reason.

Except perhaps something went wrong at the point of stealing, then he deserve such judgment.

He must have killed someone in the process or was armed when he carried out the robbery. He deserves to DIE and kudos to the judge. The OP must have omitted the other part to make us feel sorry for him.

Bastards like this cut someone's veins in the neck region the other day and he bled to death all because of common Samsung phone. The state governor should quickly sign the death warrant to serve as a deterrant to other armed phone thieves.

He was not sentenced to death for stealing. He was sentenced to death for armed robbery. The law states that the sentence for armed robbery is death.

We might not have the facts of the case. But I will tell you in confidence that he was not sentenced to death for the phone. He was sentenced to death for armed robbery which is punishable by death. It does not matter if you stole a cube of sugar in an armed robbery.

As per the politicians that steal money; their punishment is lesser cos it is termed 'embezzlement ' and 'misapproppriation '. The crime determines your sentence.

Stealing does not attract death punishment. It may be that he robbed the owner of the phone while he is armed. In such a case, the law would treat him as a armed robber with the attendant punishment for armed robbery which is death. I am not saying this is the case, but it is likely. In any case, the sentence is appealable.
