UNDERSTANDING YOUR RIGHTS AND OBLIGATIONS AS A TENANT

People move from place to place in search of greener pastures, they leave their original home and come to settle in completely strange abodes. This has brought with it the need to let accommodation either for residence or for business. The need to regulate the relationship between landlords and tenants so as to avoid arbitrary increment in rent and wrongful eviction became also imperative.

The relationship between a landlord and a tenant is that of owner and occupier. The landlord owns the land while the tenant is entitled to use and occupy the land subject to payment of rent and good behaviour. The relationship of landlord and tenant is contractual and thus, its terms cannot be altered by either party without the agreement of the other. The parties are bound by the terms of the agreement.

A tenant enjoys a number of rights:

1. A tenant has the right to question his landlord’s authority to increase rent unreasonably and arbitrarily.
2. A tenant can maintain an action in trespass against his landlord; a tenant can also obtain an injunction to restrain his landlord from ejecting him in an unlawful manner.
3. Tenants are entitled to statutorily stipulated periods of notice to quit.
4. A tenant has the right to quiet and peaceful enjoyment of the premises.
5. The tenant’s entitlement includes the right to privacy; freedom from unreasonable disturbance, exclusive possession of the premises subject to the landlord’s restricted right of inspection and the use of common areas for reasonable and lawful purposes.
6. Where a tenant with the previous consent in writing of the landlord, effects improvements on the premises, he/she shall be entitled to claim compensation for the effected improvements on quitting the premises.

A tenant has several obligations like:

1. Paying the rent at the times and in the manner agreed
2. Paying all existing and future rates and charges not payable by the landlord by law
3. Keeping the premises in good and tenantable condition, reasonable wear and tear excepted
4. Permitting the landlord and his agents to view the condition of the premises and effect repairs in necessary parts of the building during reasonable hours.
5. Not making any alterations or additions to the premises without the written consent of the landlord
6. Not assigning or sub-letting any part of the premises without the written consent of the landlord; and notifying the landl

A very good post I must say but do not try this with an Ikwerre landlord. If you dare an Ikwerre landlord, he will pack your load out of the property within 24 hours with the aid of those jobless Ikwerre youths.


Guys, make sure you have a cordially relationship with your landlord at all times.

An adage says "my landlord good my landlord good na him dey make people no build their own house".

If you have a troublesome landlord, just know you are on a fast lane to building your own house.

What of a landlord that refuses to fix his house and the tenant decided to leave but he refused to give a quit notice so as to deny the tenant his entitled 3 months duration to quit. The tenant stayed 2 months and some weeks before packing out.

Now they are in court and he is demanding 3 months rent.

Should he pay?

All i hear is tenant this tenant that, what about the rights of the landlord who has slaved and laboured to acquire a property.
The tenancy law is so skewed in favour of the tenant where a tenant does not pay rent, in most cases they will drag the matter in court and run a way with the arrears of rent.
Getting them out is another issue, you can be locked in court for years and you will not earn 1 kobo. The case of Odutola v Papersack ltd is a classic example.
The law needs to be adjusted to make provision for a tenant who wants to contest a quit notice to pay his rent in an escrow account to show he has the means of paying.

I have a question I want legally knowledgeable persons to shed light on. 1.The 3 month quit notice to the tenant,is it a myth or its real. 2. If the notice is served 3 months or more before the tenancy expires, is the landlord obliged to give a 3month after tenancy expires with no pay to fufil this condition??

Landlords are required to provide tenants with working connections to public utilities, such as water, electricity and gas, where these exist. If your home does not have a municipal water supply, you cannot require the landlord to connect you to the borehole, unfortunately. Utilities are the government's business, not the landlord's.

There is in Lagos State. I can't remember it exactly, but its something like any rent increase cannot exceed a specific percentage, I believe in the region of 25%, not so sure, within a period of some years, maybe 4 or 5, or so. Of course, most of these laws are dead letters, but they are on the books, and can be invoked, with what success, one cannot say.
