A legal practicional with Femi Okafor and Associate has accused Union and Keystone Banks PLC of being complicit in the alleged defrauding of his account with bank A/C name Nwaogwugwu Ezeamaka Charles, ITF Trinity .C. Nduka and A/C No. 0040961076.

The barrister who narrated how his home was burgled on the 24th day of January 2017 by unknown hoodlums, said his personal valuables including but not limited to his Union Bank ATM card, expired drivers license, ASUS screen touch laptop, shuttle/laptop bag was made away with.

However, having reported and complied with the laid down procedures of Union bank in helping to apprehend the suspect who made withdrawal with his ATM card at Keystone bank branch in Obosi Anambra state, the bank has refused to provide the camera footage suggesting complicity and negligence to service provided to himself and other customers.

Speaking exclusively with Universal Reporter, the lawyer pointed out that the amount of money stolen is not the bone of contention rather, the obvious neglect of CBN standards and guideline on ATM operations in Nigeria which leaves the poor citizens with the brunt and loss.

In his words, "I have complied with the laid down procedures from Union Bank in helping to apprehend the suspects but till date the bank have failed to provide photos of the suspects which is in clear violation of part 3(4)(a) of the CBN standards and giudeline on ATM. It states in part 'Every ATM shall have a camera which shall view and record all persons using the machine and every activity at the ATM..."

"With that provision, it is wrong that the bank would willfully withhold the camera footage of the transactions carried out in the bank especially when such act strictly contradict provisions of PROFESSIONAL CODE OF ETHICS AND BUSINESS CONDUCT IN THE NIGERIA BANKING SECTOR". He further pointed out that part 3(4)(a)of the ATM GUIDELINES also states; "where the user of an ATM blocks his image for camera capture, the ATM shall be capable of aborting the transaction, meaning that the machine should not have been in operation since the cameras were faulty, else, how does it exonerate the bank from aiding/abetting the unauthorized transaction."

Conclusively, the lawyer insisted that his right to have the footage of the unauthorized transaction in his account be respected or he will be forced to seek redress in a court of competent jurisdiction.

According to the lawyer, Union bank plc, while addressing his complaint through a letter dated 30th of June 2017 signed by Mrs B.A Odejimi of their legal department, the bank said the issue raised are being investigated but till date nothing have being done.
