ANAMBRA CENTRAL: Victor Umeh Wins At Appeal Court
Breaking News:
Live from Appeal Court Abuja
Chief Victor Umeh wins.
…election to be conducted in the next 90 days.

Appeal Court orders INEC to conduct Anambra Central Senatorial election without PDP.

The Appeal Court which sat by 2pm, this afternoon delivered the judgement in an appeal filed by the INEC and joined by Chief Victor Umeh against the judgement of Justice Chikere of the Federal High Court, Abuja which ordered INEC to include PDP in the postponed March 5, 2016 scheduled rerun election.

Delivering judgement, Appeal Court said that the trial court erred by ordering INEC to include PDP.

According to AIF Media reporter at the court, the appellate court ruled that since the PDP primaries that brought Iyom Ekwunife for the March 28, 2015 Anambra Central Senatorial was nullified by the Appeal Tribunal, Enugu on December 5, 2015 that PDP has lost the right to either conduct a fresh primaries or substitute their candidate.

The Appeal Court went further to bar INEC from including PDP in the ballot and ordered for the rerun election into the Anambra Central Senatorial election to be conducted in the next 90 days.

No be only paid all entitlements. The judgement would be passed for election to be conducted and not for Victor Umeh to be declared a winner.

Ngige can contest again under APC.

This is pre election matter, it is not electoral petition. The last jurisdiction is at the Supreme court.

However, delivering judgment on the matter on Tuesday in Abuja, Justice Chikere held that the time for political parties to nominate candidates for elective position in respect of the 2015 elections had elapsed.
The judge held: “The time for the nomination, withdrawal or substitution of candidates for the court-ordered election in Anambra Central senatorial district has elapsed.
“As decided by the Court of Appeal in the case of Labour Party against INEC, there is no room for fresh candidates in a court-ordered election.”
