So now we think the UK tourist visa will not be given. Because we gave document that say she did still work there. What to do now please. I am so worried, she is very worried. Will she be stopped from apply for any UK visa for 10 years? we plan to marry in UK in this summer, August. Can we marry here in Nairobi, then apply for spouse visa? or will that also be turned down, because of before fake work document. Please help or advise what she should do.'vette

So that's all u gonna say? Why didn't u mention anything about the fake stuff other than advising him of a way out? Why didn't u remind him of the 10 years ban if deception is used that u always tell fellow Nigerian.
Oh is it because he his from Kenya u don't think he used deception on his application? No string attached i think your advice was biased on this subject matter

The gf has made the mistake already, he is aware of the 10yrs ban(read his post) he also have idea of the marriage root, he did not come here to ask if its ok to use fake document, he acknowledged his gf's mistake and asked for a way out of it.

My view would have been different if he was asking for a way of cheating the system or trying to justify his gf's action.
If the gf got banned for 10yrs, they can still sort it out legitimately through marriage hence my initial reply to his post.

But when she came back from England, she did not have any job no more.
So when she filled in the tourist application, she still said she worked ther, when infact she did no longer work there.

Thank you for your constructive confirmation.
I read on the UK border web site that they can not withold a UK visa in the event we are married.
We want to live and have the oportunity of life together in UK.

Hi all.
@ Poster, there's only one outcome from this application and that is; visa refusal together with a 10 years ban, and the ban might not be revoked even if she married a UK citizen. It would take a great deal of legal struggles to get the ban overtuned

You certainly don't write or communicate (form your sentences) like you have been in the UK all your life so that is a big fat lie right there!!! Perhaps if you tried telling the truth about your dilemma i.e Where are you living now? How long you have actually held a UK passport etc? you might get a response that has been correctly applied to your situation.

The visa will most likely be refused and she will be placed on a 10 year ban .That said,if you guys get married,and all other requirements for spousal visa are right,she can not be refused a visa based on Paragraph 320(7B) of the UK immigration law.According to the UK immigration law:

(7C) Paragraph 320(7B) shall not apply in the following circumstances:

(a) where the applicant is applying as:
(i) a spouse, civil partner or unmarried or same-sex partner under
paragraphs 281 or 295A,
(ii) a fiancé(e) or proposed civil partner under paragraph 290,
(iii) a parent, grandparent or other dependent relative under paragraph 317,
(iv) a person exercising rights of access to a child under paragraph 246, or
(v) a spouse, civil partner, unmarried or same-sex partner of a refugee or person with Humanitarian Protection under paragraphs 352A, 352AA, 352FA or 352FD;

Doesn't shock me at all but this isn't a black or white race issue so why bring it up?

Most people normally write in the same way they speak and I can tell from reading Ukvette's words that he is not a native UK born citizen that he claims to be. Again, this has nothing to do with race. For all we know he could be Polish!

There seems to be a debate to as who I actually am, and to where I actually am.
Taking into account that my grammar is not to your standard.

Well, to clear things up, since some person, mention no names, may be a little 'old school'
I am white, I am not Kenyean, I have never been to Kenya.

I was born in Liverpool, last time I checked, Liverpool was still in the UK.

Now to seriousness,
I travel to many parts of the world, and have lived on all the continents of this great world.
To this, I find that it is some times more easy, to the reader, to write in fragmented grammar.
This gives the reader, who may or may not be English native speaker, a chance to understand in more detail.
Short words, and short sentences.

I am currently living in China, and, Chinese is also one of my languages, along with Dutch.
Having spent serious time in China, one does tend to adapt to the 'Chinglish'

The problem arises with my Chinese girlfriend, not any African girl.
I came to this forum, for advice.
It is a well known fact, that there are more Africans attempting to enter UK with false documents, than from any other county.
So I guess, this is where all the expertise lies, hense my visit here.

The critical comments have also been taken onboard, and will form the basis of a forthcomming 'spouse' visa, later in the year.

It has been sugested that when we apply for spouse visa, this this will by virtue of the probable 10 year ban, will also be refused.
I have been informed that this situation now requires the intervention of a specialised lawyer.
My uderstanding is that when the lawyer submits to the UKBP the court hearing date, this is usually sufficient to grant the spouse visa.

I think u are holding the wrong-end of my argument here. I was only trying to point out that not every British born, even the natives can read and write properly. i wasn't trying to bring up White vs Black war of words here.

^^I understand your point however I just didn't see what it had to do with my initial question and why you brought up 'White British' citizens 

In any case if a person born and bred in Britain couldn't write properly they still wouldn't form sentences and use certain terms like "She make a big error of judgment' like Ukvette does. A UK native  like Rab C Nesbitt would simply say "She made a helluva mistake"/ "She blew it" or "She fcvked up!" even if you they could not write properly.  Another example is when a person writes in Nigerian pidgin English and one can tell immediately that they are not regular speakers of or familiar with the dialect.

That quote there from you was what lead to my comment about 'white British' Basically saying that . . . .been in the UK doesn't mean one can read or write properly. . . that even some natives(White British) can't read or write properly.

All I said was that the OP did not come across as someone who has been in the UK all their life and as it turns out I was right because he has now admitted that he lives in China and claims he is basically communicating in 'Chinglish'. This was after basically outing himself in his first post about being in Kenya. As to why a native English speaker would communicate in this so called 'Chinglish' on an English language board is beyond me but it just tells me he is lying. Furthermore it appears that the girl he is after is also in China and I think the method of applying for a UK visa for a Chinese national varies slightly (disclaimer - correct me if I am wrong)

Just admit you jumped on the defensive wagon a tad bit early.

Absolutely not!!! my advice to him was based on his immigration issue, not abt his writing. You brought the writing or speaking angle to it. We are addressing 2 different issues here. I can understand your points about his inconsistency in his posts, i can't argue about that, but you are wrong to suggest that i jumped to defend him.

First of all, I never mentioned anything about the OP writing 'properly' just that his style of communicating was not compliant with his stated background i.e. "I am UK, born and lived here all my life." You responding to me in the way you did about some White Brits and their inability to write properly clearly shows you were being defensive as that fact had nothing at all to do with my initial post.
