2shotz has decided to take (Nokia) a worldwide phone company to a Lagos high court, demanding #5 billion naira compensation over the copyright infringement.

In his statement of claims, 2shortz said NOKIA used three of his songs as default ring tones for NOKIA X3 without getting approval and sealing a contract with him. He considered it as illegal.

He is therefore seeking damages in form of monetary compensation to the tune of N5 billion.

While Brendan Rilley, lawyer for NOKIA is saying that they actually got the deal through Orchard, a record label last year, 2shortz said nothing can be farther from the truth.2shortz reiterated that only Umunnamu his record label has the legal rights to enter into any contract with company or individual regarding his songs.

Well to be fair, it isn't about "taking Nigerians for a ride".   Intellectual property laws barely exist in Nigeria. Even if it exist, we have a culture of lack of respect for the IP of other people.

I have a feeling Nokia was duped into paying someone else for the rights of the songs.  Unfortunately, that person will most likely be a Nigerian who is yet to pay the artist a penny from it. You see, the accusing fingers will most probably come back to a Nigerian in my opinion.

And please don't try to justify the N5Billion claim for damages, even if Nokia made that much from the sales of the phones, it will be stupid to think that people bought those phones because of 2shot's ringtone.
The Nokia brand used to be the biggest name in mobile communications just 3-4 years ago.

How do you define bonafide then, if they don't have the right to sell the rights to his song as he has claimed here.

The main problem as far as I'm concerned is the hapzard way these guys contracts are structured. And the so many people that end up having some form of rights to a song. From marketer, to show promoter, to the artiste, his own personal label, the bigger distribution label he has a deal with etc etc.

He won't get that much it seems, but you don't ask for the precise amount you want from the onset do you. And he is not suing Nokia X3, he is suing Nokia, the corporation itself.

A bona fide purchaser is anyone that buys from the wrong person in good faith.
If Nokia proves that they attempted to buy the rights from the right people and actually paid, they'll be paying considerably less.

He's suing Nokia for the phones they sold with his ringtones in them, and that's the X3 . . .and the truth is Nokia sells anything better than three 2shot songs.

Didn't 2shotz sell his ENTIRE copyrighted albums through Alaba. He typically gave Alaba boys a copy while getting an advance lump sum in return. Alaba boys then would mass produce it and then make money for themselves.

All the best to him if he wins the case, but no Judge will award him anything close to the amount he is demanding. Hope he did not sell his record rights to the company that dealth with Nokia unknowingly and now expects to get a double whampy.
