The spread of Islam to Yorubaland was accompanied by the institution of Shari’ah (the Islamic law), and Muslims in the area applied it, alongside the Customary and Common Laws during the pre-colonial period before its abolition by the colonial government. However, very little research has been done in this area. Therefore, this study examined the institution of Shari’ah in Oyo and Osun States of Nigeria with reference to Yoruba Customary Law which had been in existence and the Common Law[5].
The study revealed that the British colonialists, during the colonial era, used their authority to replace Shari’ah with Common Law through Indirect Rule. It identified that Shari’ah issue is contentious because of general misunderstanding and misconceptions of its origin, tenets and practices. It also discovered that the agitation of the Muslims in the selected states for Shari'ah was based on the premise that both Yoruba Customary and Common Laws did not cover certain provisions under Shari’ah, such as ‘iddah‘ waiting period for a widow’, al-hadanah ‘custody of children’ and mirath ‘inheritance’[6].

The study revealed that Muslims found psychological relief in the Shari’ah application in Yorubaland. Despite its official replacement, some Muslims had firm conviction in using Shari’ah; hence, it is applied at individual, private and non-governmental levels as evidenced in the activities of Faya Group in Ikirun, Bamidele Movement in Ibadan and Islahuddin Association in Iwo, as well as the Independent Shari’ah Arbitration Panels in Ibadan and Osogbo. It was discovered that while 93.0% of the Muslim respondents of both states were agitating for the establishment of Shari’ah Courts, 53.0% of the Christian respondents showed negative attitude to the resuscitation. 60.0% of the respondents of Oyo State House of Assembly supported the agitation, but 75.0% of those in Osun State did not[5].
A Shari`ah court was inaugurated in the southern state of Osun on Tuesday, April 25, to look into Muslim civil cases, the second such court in southern Nigeria.[7]. "The court groups senior Muslim scholars and jurists who will rule in Muslims' civil and personal cases according t Chairman of the Osun State Muslim Community, which championed the move.[8]

Sharia in Osun is akin to customary law. It only applies to muslims and not Christians unlike the Northern states.

Zamfara implemented the sharia clause and it is applicable to all and sundry as long as you are resident in the state irrespective of your religion or ethnic background but the sharia in Osun is selective and can only be applied to certain muslims in the state.

Sharia or no Sharia . . . .the tolerance of the South western Muslims would not create any problems . . . those courts have been in existence for quite some time and it hasn't raised eye brows even though the Muslims in Osun are clearly in the majority . . . .

There have been a fine balance between religion and culture . . .cos whether a Yoruba person is a Muslim or a Christian . . . . they all share the same cultural heritage .  . . which galvanizes the people more . . There was a particular case in Iragbiji where parents of a particular school ( Name withheld) were trying to persuade the school authorities to allow their female students dress to school as required by Islam tenets . . .The school authorities politely turned them down by explaining to them that such move might act as a precedence for more religious demands which might heat up the seemingly peaceful and tolerant level within the schools. . .  and the parents accepted the decision even though the religio-composition level of most schools around Iragbiji ( Including the said school) is about 90% in favour of the Muslims . . .That goes to show you how considerate and understanding the Yoruba Muslims are

The link that you posted was published back in 2000, further more, it said However, what may not be clear to many is that the Islamic code had a precedent in Yorubaland where it was practiced in the past before it finally died off.

So why re you contradicting yourself with your own disjointed stories?

If any state pases laws which are opposed to the Nigerian constitution, those laws will be overturned by the courts. How many court challenges have we had to these unconstitutional sharia implementaion you talk about.

Do you people even know, what the constitution provides for, as far as sharia is concerned? Continue to live in ignorance and you will not seek the remedies you deserve when your constitutional rights are trampled upon. olodos

I am afraid you are the one confused. You can always claim something is constitutional even though you realize it is not. Questions for you are:

1. Does your reading of the constitution mean that christians must endure sharia law if they live in states that practice it?
2. If not, as your demand for evidence that christians endure sharia law in the northern states reveals, then are those states not implementing unconstitutional sharia?

The fact is that sharia in the Nigerian constitution was supposed to be at the level of customary law as practiced in some SW states, but NO our brothers up north don't abide by the constitution - at least what-is-his-name from Zamfara said so - although at the time a senator of (suegbe) republic.

Thank God we do not have this kind of religious confusion in Igboland.

I just keep having this feeling that some Yoruba groups might clash due to the growing consciousness for Islamization going on in the country. If the Ife and Modakeke could kill each other over land dispute, the line of such a similar confrontation between any other groups over Shariah is thin.
