First of all i wish there were sections for law here on naira land where we can be enlightened about our rights. All d same after sitting for jamb for like 4times and passing the post jamb convincingly yet you are not admitted isnt it possible to sue d university for collecting ur money and not admitting you?plz lawyers in d house wot do you think?
Re: Can A University Be Sued? by Odunnu: 8:16pm On Sep 04, 2011
Now, this is touching. How do you know you passed convincingly? thought being above the cut off automatically qualifies you to be admitted, please enlighten me.
Re: Can A University Be Sued? by 4reigningqueen: 10:05pm On Sep 04, 2011
getting d cut off mark or above does not guarantee ones admission.there is a slot 4 staff children, governor,vc,deputy vc,catchment area, indigenes and anoyingly who you know before thinking of those who shud be admitted on merit.dis is crazy.

This is like applying to a college, paying their application fees and not getting admitted.
Or sitting for an exam and failing.

No, they cannot get sued UNLESS you have tangible evidence of discrepancies against them. Did you read the exam policy? Did it say you'll be refunded your money?

The only way you can sue them is if you can prove that the exam score was altered.

I have heard of one news sometimes that a student of lead city university in Ibadan sued Nigerian board that is in charge of University formation and the guy won that case. I think it is possible if you are at the right side of the case but what give you the impression that you're good to be admitted into the school in the first instance? Think of this before you hire your Mr. Talkative because if you are wrong, your money don lost be that ooooooo grin cool

In the law of contract this is called invitation to treat, not an offer, they are not liable if they dnt choose u. Advice: an action cannot be brought against them cos u would lose, and u cant match their lawyer
Re: Can A University Be Sued? by Abayomin70(m): 7:02am On Sep 05, 2011
u can neva sue dem for example
Re: Can A University Be Sued? by tolurode(m): 8:18am On Sep 05, 2011
As earlier stated,it is an invitation to treat and is yet to constitute an offer. A right of action is yet to accrue and writing or passing the post-jamb test does not automatically qualify a candidate for admission, other yardsticks may be considered. To the other arm of the question, universities can sue and be sued, they are regarded as artificial persons in law embedded with the capacity to act as a natural person if they enter into contractual relations.

Now this is where nigerian Uni.s are fuc.ked, who the hell reserves slots for others in other countries? backward is what nigeria will be going if that is not stopped, admission should base on merits, and not slotting for staffs or politicians kids

Situations like this can be frustrating and discomfiting.
The flagrant abuse of propriety by varsities should be frowned upon.
Your case anyway isn't peculiar.
Inasmuch as their is IM in our schools, I wager that 70% of admissions offered are on merit.
Your case might be one of the exceptions.
And who says they can't be sued?
Of course they can; once you are sure that you have incontrovertible evidence.
But one of the problems should be the undue lingering nature of litigation in this country, which means that you have to get yourself admission elsewhere while the case lasts. (It might last up to 5 - 16 years)
So I think if you have the wherewithal, you can go ahead.
You might try and see if there is any NGO that will help plead your case.
You can also try taking an influential person with you to the school, if you are cocksure that you passed convincingly.
In seeking admission, the God Factor shouldn't be left at all, as He is the one who crowns our efforts with success.

Try private universities if you have the money or better still go abroad.

Any organisation that or body that possesses legal personality can sue and be sued.legal personality here means persons, bodies, organisation that are recognised by the law.A nigerian university must be recognised by law if it is registered and approbated by NUC and must be approved by the national assembly in the case of federal university.Uni-ibadan has once been sued by an employee working for the school respecting his contract with the school when he was wrongfully dismissed. The employee succeded in court.A nigerian university can sue and can be sued.thanks

Ahah I thought there were no coma coma in this post UME exam thing? I thought the school sets cut off point for students writing the exam and if you reach the cut off point for your course you are admitted?

If they knew they had 50 slots for students why did they sell one million forms? were they expecting that out of one million only 50 would pass? If you have so few a space then sell few forms.

I believe you can sue them so long as you are sure you score up to the cut off point and you can prove it. Get your exam result slip so they don't quickly alter your score and if possible get to know the scores of admitted students in your chosen department too. like if they admit a candidate with 150 score while they tell you with a score of 250 that there is no space.

God education in Nigeria has gone to the gutters jamb alone is enough to filter candidates for universities but the money involved would not let them go back to the old tested and proven method.

All the above is considered before a cut off mark is set.
So if you pass convincingly then you would certainly be given admission.

@OP. Listen good.
The university can be suele have done that and won cases.

NOW WHY ARE U SUEING? U THINK U PASSED CONVINCINGLY? LOL. See!! even if u score 299/300 the University has the sole right to admit you or dispense you off. SO U HAVE NO CASE. Though in all fairness u may have scored high, but the cut off is dependent on the number of candidates that make the bucket for the Said dept.

Moreover, if your name ,you feel was substituted. DO U HAVE A VALID CLUE AND EVIDENCE. From experience i wud say it is a 'NO'. GUD LUCK SHA

The University has which right?
Please spare me that.
Go and read what Prof. Dakas of Unijos did when he was denied first class.

Universities, just like any other juristic person can sue and be sued. However, what are the merits of your case, the plank you want to rest your case on? That you made the cut off but was not admitted does not appear to be a very strong reason to want to sue. Admission into universities are subject to several other vagaries which may not have been favourable to you at the time of selection. Except you can provide evidence that weighs strongly in your favour that scores were altered or that you were unjustly disqualified, you may not get judgment. Assume for purposes of argument that the court favours your position and you are admitted, do you strongly believe that you will graduate from that same institution, chances are that if you are very brilliant, they will award you a PASS grade or third class at the very best. You may wish to know that such a grade would not take you very far or at the best you will work doubly hard to start well in life especially if you plan to be reliant on employment in the job market. If you insist, you may test the case but ensure to aspire to be admitted elsewhere. Good luck.
