A legal luminary and social affairs commentator, Mr. Sabastine Hon (SAN), has said President Goodluck Jonathan is not constitutionally barred from contesting the 2015 presidential election if he chooses to contest.
The constitutional lawyer however flayed governors for appointing caretaker committees to run the affairs of local government councils, saying it was unlawful and unconstitutional.

Hon, who spoke to Sunday Sun in Abuja, submitted: “The Constitution did not bar him from contesting if he so wishes. This is because he took the first oath of office as a mid-term or as inter mid-term successor to his late boss, President Umaru Musa Yar’ Adua.”
He explained that Jonathan did not set out to become the president at the initial stage, stressing that he was only elected as the deputy to the late Yar’Adua, adding that as Vice President the Constitution required him to step into the position of President. It was still the same mandate.

“Can we say in all sincerity that the first two years that he occupied that seat he was the man in driving seat? He was not; he was only deputizing for the man in the driving seat. If the president does not assign a deputy responsibility to the vice president he will be there redundant,” Hon said.
On appointment of caretaker committees for local governments, Hon declared that it was unlawful and unconstitutional for governors to do so. He enjoined governors to ensure that constitutional provisions concerning local governments are held sacrosanct.

“In at least two decisions, the Court of Appeal has voided the appointment of caretaker committees. In the two decisions (Akon Vs Umoh and Akon Vs the Attorney General of Cross River State) delivered by the Court of Appeal, Calabar Division in 2002, the Court held that state governors have no power to constitute caretaker committees but the illegality is going on in the various states and nobody seems to be challenging them,” Hon lamented.

Please no one should mind all these so called clown called SAN i'm not really surprise when even everybody now is a SAN. SAN this SAN that why wont he or they be talking jargons

Is 2015 the issue to be talking baout now or how to make the one GEJ is still battling with to get headway? Shame on him for he want himself to be used as another tools for bone of contention to heat up the polity again.

When I read it on Sunewspaper this morning I was surprise because I least expect anyone saying Gej can still contest 2015 whereas the one he just strarted has gone anywhere yet and it was a SAN who said so. Its a big surprise.

The truth is he wont even try it. Though i'm one his follower because I voted for him but my vote contract with him expire 2015 anything beyond that is like looking for trouble.

The issue is why talking about contesting in 2015 now when he's less than 5 months into a running 4-yr mandate? What meaningful thing has he achieved with the present mandate other than insecurity all over the land?

With the way he is 'presiding' over us one will even doubt if by 2015 there will entity called Nigeria and the GEJ himself will be so organized to organize an election.

Constitutionally he can run.

But morally, he said he would not run. If he does decide to run in 2015, then he would be forever proclaimed a LIAR!

GEJ has been in "power" for around 18 months now and still nothing to show for it. All we hear are attempts to remain in power,  Yet the poverty levels deepen, unemployment remains prevalent and corruption bites harder.

Never has so much trust, expectation and goodwill been squandered so quickly.  

Well, after GEJ has finished his tenure and with Nigeria, perhaps then ALL NIGERIANS WILL ACCEPT THAT it is not North vs South vs West vs East but Rich pro-military elite vs everybody else.

Going by the responses here against Jonathan, it has shown that the sponors of boko haram are succeeding in their objective. They intend to rubbish Jonathan's first term and pave way for a northern president to ascend the throne easily. I think they are succeeding in making many people like the posters above lose faith in his administration. The northern politicans are really playing a nice game
