Judiciary workers continue strike, meet govs today 12.01.2015.



As the nation-wide strike embarked on by Judiciary Staff Union of Nigeria, JUSUN, enters the second week, the union has vowed not to back down until its demands were met. JUSUN had on January 2 directed its members to shut down court activities in all states over non-compliance with orders of the Federal High Court, Abuja, on the financial autonomy and independence of the Judiciary.


In a telephone conversation, National Secretary of JUSUN, Isaiah Adetola, told National Mirror that both the federal and state governments have not shown readiness to comply with the court’s judgment. According to him, despite several letters and warning strikes urging the federal and state governments to comply with the judgment, they flouted the order.


He advised the state governments to adhere strictly to the order of the court in order not to prolong the strike.


Adetola, who disclosed that the union will be meeting Federal Government officials today (Monday) to discuss the issue, added that the union was ready to call off the strike if its demands were met. National Mirror gathered that none of the 36 governors has invited leadership of the union for dialogue on the issue.


Meanwhile, the Rule of Law Development Foundation has called on JUSUN to call off its strike and return to the drawing board in view of the inherent and manifest constitutional weakness of its cause. A statement signed by its coordinator, Mr. Bodunrin Daudu, SAN, states:

“It is in the overall interest of Nigeria that JUSUN is not unwittingly used to arrest the nascent democratic growth of this great country.


Nigerian political history is replete with persons, groups, etc. who have played the same kind of role JUSUN now plays, and have in the process set the nation’s political timetable backward.”


The foundation said it was willing to lend JUSUN its expertise to
secure the financial autonomy of states’ judiciaries in a
constitutional manner which will not plunge this great nation into crises, rancour or darkness.


The statement added that the judgment being sought to be enforced by JUSUN is clearly on very weak constitutional grounds as it was obvious that based on existing Supreme Court decisions, the funds for the judiciary cannot be taken from the Federation Account but from either the Consolidated Revenue Funds of the federation or that of the states.

ABUJA — The Attorney General of the Federation and Minister of
Justice, Mohammed Bello Adoke, SAN, yesterday, said the Federal Government should not be held responsible for the eight days industrial action that has crippled judicial activities across the country.


This came as former President of the Nigeria Bar Association,
NBA, and member of the National Judicial Council, NJC, Mr O. C.
J. Okocha, SAN, yesterday asked the Judiciary Staff Union of
Nigeria, JUSUN, to call off its strike to enable the NBA to proceed
from where they stopped the fight for judicial autonomy.


In a statement in Abuja yesterday, Adoke maintained that
Nigerians should hold the various state governments accountable for the indefinite strike declared by JUSUN.


The strike which commenced on January 5, a date scheduled for the judiciary to resume work after its yuletide, has stalled hearing on several political matters bothering on nomination of candidates for the impending general elections.


It has also weighed down on political parties, especially in states where parallel primary elections held.


This is even as the Independent National Electoral Commission,
INEC, has fixed today as the final day for submission of names of candidates for the election.


Meantime, in a statement signed by the Director of Information at the Federal Ministry of Justice, Mr. Charles Nwodo, the AGF also insisted that the closure of courts in the country was as a result of the refusal by some state governors to obey a Federal High Court judgment that had on January 13, 2014, declared financial autonomy for the judiciary.


“The Office of the Attorney General of the Federation and Minister of Justice notes with concern the on-going strike embarked upon by JUSUN to press for the implementation of the judgment of the Federal High Court, Abuja delivered on January 13, 2014 (Coram, A.F.A. Ademola ) in suit No. FHC/ABJ/CS/667/13.


“The Federal High Court, among other things, ordered that the
amount standing to the credit of the states’ judiciary in the
Federation/Consolidated Revenue Fund be paid directly to the
heads of courts in the various states’ judiciary in compliance with the provisions of sections 81(3), 121 (3) and 162 (9) of the
Constitution of the Federal Republic of Nigeria, 1999.



Strike directed at state govts

“This strike is unfortunate and has paralyzed the activities of the judiciary throughout the federation. The Honourable Attorney General of the Federation is, however, constrained to issue this statement in view of the misconceptions and insinuations in the print and electronic media concerning the strike and the efforts being made to address the implementation challenges posed by the judgement.


“It is important to observe as follows: That the Federal
Government is not in breach or violation of the aforementioned
judgment of the Federal High Court. This much has been publicly acknowledged by JUSUN in all their statements and deliberations;


“That the strike is actually directed at state governments that are yet to comply with the judgment;


“That federal courts are thus only on sympathy strike with their
state counterparts.

“The foregoing notwithstanding, the Supervising Minister of Labour and Productively has been working assiduously with relevant stakeholders to resolve all the challenges that may have militated against the implementation of the judgment of the court.


“The Federal Government acknowledges the imperative of an
efficient and effective judiciary to our democratic consolidation and is doing all that is within its constitutional powers to ensure full implementation of the judgement.


“We, therefore, call on all well-meaning Nigerians to appreciate
the dynamics of the federal structure that Nigeria operates and the constitutional limits of the Federal Government when dealing with the states especially with respect to matters within their constitutional mandates.”



Call off strike, Okocha tells JUSUN

Okocha said in as much as there was justification for the strike,
the union had made its point and should call off the strike, adding that NBA would stand as guarantor to stakeholders to ensure that the issue was addressed accordingly.


Meanwhile, the courts may not resume until next week as a
meeting between the workers and the government representatives has already been tentatively fixed for the weekend to resolve the issues.


He said:“In as much as there is justification for the strike
embarked upon by the JUSUN, I think they have made their point
and should call off the strike so that we can then proceed from
there.


“It is not appropriate to shut down the courts for an indefinite
period of time. The court symbolises the liberty of the citizens of Nigeria, and indeed of any constitutional democracy. And when you shut down the courts, you are now leaving the citizens with no option; no avenue to ventilate their grievances.


“It is even worse for criminal suspects who are either in police
custody or awaiting arraignment before the court or in prison
custody awaiting trial for their offences.

“So I believe that having maintained the strike for one week,
JUSUN has made its point and they should call off the strike.


This is a very critical stage of our nation’s development. This is a time when we are preparing for elections, and pre-election and post- election controversies will arise, including criminal offences related to election.”


“Just like the NBA, which I belong to, has already appealed, I
appeal to JUSUN to kindly call off the strike. A point has been
made; the issues to be tabled for discussion will now be tabled fordiscussion. And the NBA, I believe, will stand as guarantor to
ensure that all concerned will take the problem serious and
address the issue accordingly.”


Another Seniour Advocate, Tayo Oyetibo, who spoke with Vanguard on telephone asked the government to call the executive of the JUSUN and discuss with them, with a view to resolving the issues at stake.


Oyetibo stressed that when workers go on strike, government
ought to show interest in addressing their complaints so as to
restore normalcy.


He said: “The whole strike is about autonomy for the judiciary,
which I think the government should just look into because the
public is the one bearing the brunt of the strike.”


On what should be done to suspects in police custody as the strike entered its second week, Oyetibo said: “Those in police custody can be granted bail, if the offence is a bailable one. You grant them police bail pending when the courts will re-open, and then you charge them to court.


“You cannot say that because of strike, you will continue to keep them in detention for reasons that are unlawful. Most offences are bailable, so the police should grant them bail and allow them to go on production of sureties.”


JUSUN shut down courts across the country on January 5 to
compel the authorities to comply with the court judgement and the Memoranda of Understanding, MoU, of January 13, 2014 and
August 1, 2014 respectively on the autonomy.


Justice Adeniyi Ademola had on January 14, 2014, following a suit by JUSUN, restrained the Federal Government and the 36 state governors from holding on to funds meant for the judiciary.

Nigerian courts not resuming until next week

LAGOS—There was indication that the court rooms across the
country will remain shut until next week.


Vanguard gathered that the officials of the striking workers under the umbrella of Judiciary Staff Union of Nigeria, JUSUN, have vowed to put the gates of the courts in the country under locks and key until their demands are met.


The workers’ strike action entered the 10th day yesterday. The
workers had embarked on the strike to protest the refusal of the
executive arm of government at the federal and state levels to
implement a judgment of Justice Adeniyi Ademola of a federal highcourt, Abuja which granted financial autonomy to the judiciary on January 13, 2014.


Already, a meeting between the workers and the government
representatives has been fixed tentatively for the weekend, where it is expected that both party will resolve all disagreements between them.


A visit to the headquaters of the High Court of Lagos State, Ikeja
and the Lagos division, Igbosere and the Appeal Court and the
Federal High Court revealed that all gates to the premises are
under locks and key.


Several litigants who were in court with the hope that there will be positive development left dejected.


There were posters pasted on the gates with the inscription, “the courts are on strike.”


In line with the court judgment, the Accountant-General of the
Federation is expected to make deductions from the consolidated fund and transfer the amount standing to the credit of states’ judiciary to the National Judicial Council which will then disburse same to the various heads of court.


JUSUN said various stakeholders, including the accountant
general of the federation, AGF, states’ accountants general, and
commissioners of finance among others, had flouted the
Memorandum of Understanding, MoU, signed by all the parties on November 27, 2014.


The MoU, directed the AGF to deduct directly from the allocation to states’ judiciary at the last Federation Account Allocation
Committee, FAAC, meeting in December.


JUSUN president, Mawan Adamu said in Abuja on Monday that
they would not go back on the strike and that the industrial action would continue until the judgment of the court is respected.


Meanwhile, some lawyers have condemned the closure of the
gates to the court premises.


According to them, it is unheard of, since there are several people who used the court apart from the striking officials.


A former president of the Nigerian Bar Association, Mr J.B.
Dawodu said the step taken by the workers is criminal in nature
since their action will affect so many people whose fundamental rights are being infringed.

(1) It is not a rumour that JUSUN (Judiciary Staff Union of Nigeria) has embarked on an indefinite and a nationwide strike as far back as on 2nd of January, 2015 over the non-implementation of Court Order with respect to the Autonomy of the Nigerian Judiciary.


(2) The aftermath of JUSUN strike has led to the total collapse of all courts` activities in the Nigerian Courts without excluding the Supreme Court of Nigeria.


(3) The Stakeholders including the Accountant General of The Federation and JUSUN members have held several reconciliatory meetings to call off the strike but all proved abortive as at 8th of January, 2015.


(4) Pieces of information at our disposal show clearly that the Stakeholders including the Accountant General of The Federation and JUSUN members have fixed another crucial and reconciliatory meeting to Saturday, 17th of January, 2015.


(5) The outcomes and resolutions of the reconciliatory meeting fixed for 17th of January, 2015 between the Stakeholders including the Accountant General of The Federation and JUSUN members will determine whether the strike will be called off or not.


(6) As a result of the above, and among other unforeseen circumstances, it is absolutely premature to conclude that the ongoing strike of JUSUN will adversely affect the hearing of all the outstanding motions in the Patent Right Infringement appeal involving CCNL and Mobil Producing Nigeria Unlimited before the Honourable Justices of the Supreme Court of Nigeria fixed for Monday, 19th of January, 2015.


(7) It is incumbent upon the Management of CCNL to monitor the outcomes/resolutions of the reconciliatory meeting fixed for 17th of January, 2015 between the Stakeholders including the Accountant General of The Federation and JUSUN members to determine whether or not the strike will be called off or not.

Judiciary workers plan contempt suit against 36 Govs



The leadership of the Judiciary Staff Union of Nigeria, JUSUN, has resolved to file a contempt case before the Federal High Court, Abuja against the 36 state governors for refusing to obey court order granting the judiciary autonomy.


A top judicial officer told Nigerian Pilot yesterday that the union
had briefed a Senior Advocate of Nigeria, SAN, who is waiting for
the outcome of the meeting between the Supervising Minister of Labour, Kabiru Tanimu and the union leaders before taking the appropriate action.


It was also learnt that once the coast is clear on the ongoing strike called by the union, the contempt suit would be filed by JUSUN.


According to the source, the union wants to use the court to
compel the governors directly to comply with the judgement of
Justice Ademola Adeniyi which endorsed financial autonomy for the country’s judiciary.


He said that the union would approach the court to commit the
governors to prison for refusing to obey its orders.
National President of JUSUN, Comrade Marwan Mustapha Adamu, said that all courts in the country would continue to remain shut until governments at all levels saw the need to ensure a free, vibrant and independent judiciary in the country.


The union embarked on the indefinite strike on Friday, January 2, 2015 due to what it described as “insensitive” and the failure of stakeholders to respect the last Memorandum of Understanding, MoU, on financial autonomy for the judiciary.

Turaki, along with other stakeholders had met with the JUSUN
officers on January 7, two days after the lingering strike started.


But the representatives of the workers had left the meeting with a resolve to continue the strike until its demand was met.


The workers are demanding the implementation of a January 13, 2014 judgment of a Federal High Court, Abuja, which ordered a prompt compliance with constitutional provisions on the financial autonomy status of the judiciary.


The SGF, in a letter dated January 14, 2015 which he personally
signed, said a fresh meeting with the striking workers was
necessary “in view of the likely consequences of continuous
closure of courts on our nascent democracy.”


” it is resolved that crucial meetings of all critical stakeholders be convened to find a lasting solution to all the issues in contention,” Anyim stated.

Adoke lied over our strike – Judiciary workers

Members of the Judiciary Staff Union of Nigeria have faulted a
recent comment by the Attorney-General of the Federation and
Minister of Justice, Mohammed Adoke, on their ongoing strike.


National Public Relations Officer of the union, Kayode Igbarago,
said in a statement on Thursday that the minister was being
“economical with the truth.”


The comment of the minister was contained in a statement issued on January 9, 2015, by the Director, Information, of the Federal Ministry of Justice, Mr. Charles Nwodo.


The minister claimed in the statement that the Federal Government was not in breach of the January 13, 2014 judgment of a Federal High Court in Abuja which JUSUN is agitating for its implementation.


JUSUN members had been on strike since January 5, demanding the enforcement of the judgment which affirmed the financial autonomy status of the judiciary.


The judgment delivered by Justice Adeniyi Ademola of a Federal High Court in Abuja, abolished the piecemeal funding of the judiciary by state governments.


But Adoke had said in the statement by Nwodo that the Federal
Government was not in breach of the judgment, adding that the
federal court workers were only on strike in solidarity with their
state court counterparts.


The ministry’s statement had read, “It is important to observe as
follows:

“(a) that the Federal Government is not in breach or violation of the aforementioned judgment of the Federal High Court. This much has been publicly acknowledged by JUSUN in all their statements and deliberations;

“(b) that the strike is actually directed at State Governments that
are yet to comply with the Judgment;

“(c) that federal courts are thus only on sympathy strike with their state counterparts.”


But JUSUN said on Thursday that contrary to the minister’s
position, both the federal and state governments continued to be in breach of the judgment.


The union argued that the Accountant-General of the Federation, Mr. Jonah Otunla, who was specifically ordered by the court to enforce the judgment, was a part of the executive arm of government.


Otunla is said to have failed to carry out the court order which
directed him to be deducting the funds standing credit to the
judiciary in the Federation Account and be disbursing same to the various heads of court through the National Judicial Council.


The union’s statement read in part, “JUSUN is of the position that the Hon. Attorney General and Minister of Justice is being
economical with the truth.


“The Hon. Minister is in position to explain why federal court
works including those of the Ministry of Justice are not paid their salaries as and when due.


“Judges at state levels who are constitutionally expected to be
paid through the National Judicial Council face the same
challenges.”


The union added that Adoke, as the chief law officer of the country, and a party to the suit, failed to direct the Accountant General of the Federation to start implementing the judgment.


The union stated, “The Honourable Attorney General of the
Federation and Minister of Justice should know that his office was a party as a defendant in the judgment of the Federal High Court and has refused to appeal against it, but could not as the legal officer of the federation refused or failed to direct the Minister of State for Finance and the Accountant General of the Federation, who are part of the executive arm to obey the judgment of a competent court.”

The judgment which JUSUN is agitating for its implementation had ordered the Accountant-General of the Federation to be deducting funds standing to the credit of the judiciary and disburse directly to the various heads of court.


The judgment was delivered by Justice Adeniyi Ademola on
January 13, 2014.

Judicial Staff Strike: Bar Leaders Seek Early Resolution

BAR LEADERS in Lagos have urged parties in the ongoing
strike action by Judicial Staff Union of Nigeria (JUSUN), to
immediately resolve the crisis and allow courts to re-
open.


The leaders in a communiqué issued on Friday after a
meeting of the Executive Members of the four branches of
Nigerian Bar Association (NBA) in Lagos, and read by the
Lagos State Attorney General, Ade Ipaye, noted that the
strike has caused untold hardship to ordinary Nigerians
who are deprived of their freedom, being without trial and
opportunity to apply for bail.


According to them, the strike has not only deprived legal
practitioners their means of livelihood but has in a very
disturbing way, also signalled the impotence of the
Nigerian Justice system, as well as constituted a clear
inducement to impunity.


The leaders noted that the action has made fundamental
rights enforcement, settlement of disputes, taxation and
company management impossible, thereby shutting down
all justice infrastructure provided by law in Nigeria.


While supporting autonomy of the judiciary and direct
deduction or remittance of money budgeted for the
judiciary in the consolidated Revenue Fund Account of the
federal and state government, the leaders said it is ironical
that the courts, which are empowered by law to enforce
judgments, are being sidelined and shut down by
this method of enforcement.


Also, in the communiqué signed by Ipaye and chairmen of
the four Bar associations, namely, Alex Muoka, Lagos;
Yinka Farounbi, Ikeja; Adedotun Adetunji, Ikorodu; and
Chris Okoye, Badagry, the leaders said if the strike is not
nipped in the bud, it would create a disturbing precedence
whereby a strike action is called to secure the enforcement
of a court judgment.


They expressed fear that the consequence of the strike
will not only outlive the strike period but that the
breakdown of law and order is the logical result, especially
when the 2015 general elections is days away.

(1.2) On 2nd of January, 2015, JUSUN (Judiciary Staff Union of Nigeria) embarked on an indefinite and a nationwide strike over the non-implementation of Court Order with respect to the Autonomy of the Nigerian Judiciary.


(1.3) The Reconciliatory Meeting between the Stakeholders including the Accountant General of The Federation and JUSUN members fixed for Saturday, 17th of January, 2015 has been postponed to Monday, 19th of January, 2015.

Strike: FG meets judiciary workers’ union today

The Federal Government will today meet striking judiciary workers and other stakeholders with a view to ending the strike embarked upon by the Judiciary Staff Union of Nigeria (JUSUN) close to two weeks now.


Today’s meeting is part of on-going discussions initiated by the
Supervising Minister of Labour and Productivity, Kabiru Tanimu
Turaki.


President of JUSUN Comrade Marwan Mustapha Adamu told
reporters that the union is open to meaningful talks that will lead to the suspension of the strike, but insisted that the strike won’t be suspended until a Federal High Court judgment which granted financial autonomy to the judicial sector is implemented.


The union also disagreed with comments allegedly made by the
Attorney General of the Federation and Minister of Justice,
Mohammed Bello Adoke, saying that the federal courts are only on sympathy strike as the Federal Government is complying with the provision of Nigeria’s constitution.


A statement signed by JUSUN’s Publicity Secretary, Comrade
Kayode Igbarago said the statement was untrue, stressing that
federal courts’ workers and state court workers are in harmony
with regards to their demands.


Igbarago said, “federal workers in the judiciary are protesting the anomalies… JUSUN also states unequivocally that the judgment/ order of the Federal High Court under reference was for the Accountant General of the Federation to deduct and pay directly to the National Judicial Council (NJC) for remittance to state judiciaries.”

The Illegality of JUNSUN Strike



After the Christmas and New Year break, Nigerian lawyers returned to work only to be confronted with locked up court premises.


The crippling effect of the nationwide strike embarked upon by
members of the Judiciary Staff Union of Nigeria (JUSUN) was
witnessed by lawyers and judges at all hierarchies of courts on
January 2, 2015.


The entire justice delivery system is now at a
standstill, the agony of litigants is palpable and the consequences can only be imagined.

Anyim, Adoke, others fail to resolve JUSUN strike

Top government functionaries at both state and federal levels met with the striking Judiciary Staff Union of Nigeria on Monday, but failed to find solution to the lingering industrial action.


The nationwide strike, which has grounded the entire judiciary
arms of government at all levels, started on January 5, 2015.


The stakeholders’ meeting which held at the instance of the
Secretary to the Government of the Federation, Pius Anyim, lasted between 6pm and 10pm on Monday.


Another meeting of the stakeholders with JUSUN officials and
various Chief Registrars of various state high courts was
scheduled to hold at about 6pm on Tuesday.


As of the time of filing this report, our correspondent learnt that
JUSUN officials were on their way to the meeting scheduled to
take place at the Conference Hall of the Office of the Secretary to
the Federation.


The Monday’s meeting was unable to meet JUSUN’s demand for the compliance with the judgment of a Federal High Court, Abuja which affirmed the financial autonomy status of the judiciary.


It was learnt that another meeting with Chief Registrars of state
high courts was scheduled following claims by some state
Attorneys-General that their states were already complying with
the judgment.


The head of the body of state Attorneys-General, Mr. Eyitayo
Jegede (Ondo State), was present at the meeting.


Minister of Finance, Dr. Ngozi Okonjo-Iweala, was invited but was absent at the meeting.


Some of those who attended the meeting were the Attorney-
General of the Federation and Minister of Justice, Mr. Mohammed Adoke; Supervising Minister for Labour and Productivity, Kabir Turaki, the leadership and the President of the Nigerian Bar Association, Mr. Augustine Alegeh (SAN).


Those who were also at the meeting were the Accountant-General of the Federation, Mr. Jonah Otunla and some state Attorneys-General along with the leadership and President of the Nigeria Labour Congress, Abdulwaheed Omar.


The Monday’s meeting was the second in the series of futile
government’s talk with the workers since the strike started on
January 5.


The Supervising Minister of Labour and Productivity, along with
other stakeholders had met with the JUSUN officers on January 7, two days after the lingering strike started.


But the representatives of the workers had left the meeting with a resolve to continue the strike until its demand was met.


The judgment which JUSUN is agitating for its implementation
was delivered by Justice Adeniyi Ademola on January 13, 2014.


The court described as unconstitutional the piecemeal funding of the judiciary by state governments.


It ordered that the Accountant-General of the Federation to be
deducting the amount standing to the credit of various state
judiciary and disburse to the various heads of court in line with
constitutional provisions.

Abuja- The joint meeting for negotiations between the Federal
Government, Chief Registrars of states’ judiciary and the
Judiciary Staff Union of Nigeria (JUSUN) on Tuesday ended
unresolved.


The meeting was held at the office of the Secretary to the
Government of the Federation (SGF) in Abuja, with all
stakeholders present to deliberate and find the way forward.


The SGF, Anyim Pius Anyim, in his opening remarks had said the
meeting was called to have a better understanding of the issue at hand.


He said the meeting was also to take necessary steps in finding
solutions.


“FG is ready to comply with the judgment of the court, in line withthe Constitution,’’ Anyim said, adding that the Federal
Government was committed to the autonomy of the judiciary for
the system to work.


He said however that the Federal Government could only help to
ensure that state governments complied with the payment based on the availability of resources.


“The Federal Government, as a government, is committed to the
autonomy of the judiciary.


“But we need to work together to bring a perfect working
solution for everybody, because we do not want this strike to
continue for too long.


“It will not be good if all the 36 states’ Chief Registrars come
here and they won’t be to have a workable solution.


“I want to appeal to you not to go back without finding a
solution.


“This matter has dragged and we want everybody to come to an
agreement for the interest of the system and I want your
presence here (in Abuja) to make a difference,” Anyim said.


The News Agency of Nigeria (NAN) reports however that the
meeting had on Monday ended with all eyes on the Chief
Registrars.


This was on the basis of the Chief Registrars confirming if any
state had complied with the court order, which will be the basis
for the strike to be called off.


During the meeting with the Registrars, the Chief Registrar of the Supreme Court, Ahmed Saleh, who spoke on behalf of others
from the states, confirmed non-implementation by the states.


“I want to say on behalf of my colleagues, that both the state and federal government have not complied with the court judgment.”


The Attorney-General of Ondo State, Eyitayo Jegede, who spoke
on behalf of the Attorney-Generals of the states, said they agreed that a mistake had been made in this regard.


He however pleaded that the next move should about finding a
way forward.


“As a body of Attorney-Generals, we met several times, and at
each of these meetings we have discussed and took a position.


“This position is that we are all committed in our own way to
ensure that every gap in areas of full implementation will be
corrected.


“We want to assure that we are all working on the same goal,
but we want to plead with you (JUSUN) to give us an
opportunity to close all the gaps.


“Let us find a lasting solution to this problem. If we can be given
about two months to get everything done and the strike is called off, it will be good,” Jegede said.


The National President of JUSUN, Mr. Marwan Adamu, said the
agreement for the meeting was to ascertain if some states had
complied or not.


He however pointed out that if no state had complied with the
court judgment there was nothing to be done.


Adamu said the only way forward was for the states and Federal
Government to obey the court judgment.


He however said another meeting could be held on Tuesday to
see how this compliance could be speedily achieved.


On his part, the President of Nigeria Bar Association (NBA), Mr.
Augusustine Alegeh, pleaded for the matter to be resolved
earnestly.


He said the NBA could not take a decision for the Federal
Government or the state governments, but could only advise.


“I plead that the issue of compliance should be resolved
tomorrow (Wednesday) at all cost so that the strike can be called off,’’ Alegeh said.


NAN reports that the meeting was later rescheduled for
Wednesday at the Supreme Court.(NAN)

Judiciary workers decide on strike Sunday

After three days of marathon meetings of stakeholders with
officers of the striking Judiciary Staff Union of Nigeria, the National Executive Council of the union will meet on Sunday to decide on whether or not to continue its industrial action.


The union’s NEC meeting is to take place at the Supreme Court by 2pm on Sunday.


JUSUN’s nationwide strike, which has grounded the entire
judiciary arms of government at all levels, started on January 5,
2015.


The executive council of JUSUN took the decision to convene a
NEC meeting on Wednesday after meeting with the leadership of
the Nigerian Bar Association, the forum of Chief Registrars of
various courts in the country, the body of the state Attorneys-
General among others.


President of the NBA, Mr. Augustine Alegeh (SAN), was said to
have presided over the meeting.


The NBA president, the state Attorneys-General and other
stakeholders are expected to reconvene for another meeting on
January 26 by 12pm to receive briefing on the decision of the
JUSUN’s NEC.


JUSUN’s National Public Relation Officer, Kayode Igbarago, told
our correspondent on Wednesday that if the NEC was disposed to suspending or calling off the strike it would be announced formally on Monday after the meeting with the stakeholders.


It was learnt that the union’s decision to convene a NEC meeting came in the light of explanations by government that the Accountant-General of the Federation lacked the power to deduct money from the Federation Account as ordered in the judgment which JUSUN is agitating for its implementation.


The said judgment delivered by Justice Adeniyi Ademola of a
Federal High Court in Abuja on January 13, 2014, affirmed the
financial autonomy status of the judiciary and abolished its
piecemeal funding by the executive.


The court ordered the Accountant-General of the Federation to be deducting funds standing to the credit of the judiciary in the
Federation Account and be remitting it directly to the various
heads of court.


Some of the state Attorneys-General led by Eyitayo Jegede (Ondo) who were in attendance at the Wednesday’s meeting were said to have pleaded with JUSUN officers to suspend their strike, promising to fashion out the modalities of meeting the union’s demands within the shortest possible time.


A stakeholder who attended the meeting said, “It was said that
portion of the judgment cannot be implemented in that form.


References were made to previous judgments of superior courts which held that the Accountant-General of the Federation cannot unilaterally draw funds from the Federation Account without the consent of the governors.


“There is another account called the consolidated account which is under the control of the state governments. So the Attorneys- General said they had the mandate of their various governors to be able to fashion out how they can begin the implementation of the judgment from the consolidated account.”


The meeting convened by the Secretary to the Government of the Federation, Pius Anyim, started on Monday and was adjourned till Tuesday to ascertain the claims by the Attorneys-General of Ondo, Lagos and Delta states that their state governments were already complying with the judgment.


On Tuesday, the body of the Chief Registrars, who are the
accounting officers of their various levels of judiciary, attended the meeting, stating clearly that both the state and federal
governments had yet to start complying with the court judgment.


It was learnt that the state Attorneys-General who had maintained a hard stance at the two previous meetings started pleading with the union to suspend the strike to give them time to fashion out the modalities of implementing the judgment.

-Thank you very much for this question.
-My personal opinions on the current industrial strike embarked upon by JUSUN have identified grievous fundamental faults, both on the part of the Government, and JUSUN Executives.
-First and foremost, why the Executive Arm of Government in Nigeria has failed totally to comply with orders of a court of competent jurisdiction in Nigeria?
-The three (3) Arms of Government, The Executive, The Legislature and the Judiciary, must be independent. But The Executive Arm of Government in Nigeria has taken The Judiciary for a ride. The Judiciary is not an appendage to the Executive, but an Independent Arm of Government.
-Conversely, the fundamental fault traceable to JUSUN Executives is that, Is a nationwide and indefinite strike a legal procedure to enforce a valid judgment of a court of competent jurisdiction in Nigeria? The answer is a re-sounding no.
-You cannot use what is wrong to correct what is wrong. You cannot enforce or implement a court order through a nationwide and indefinite strike.
-To implement or enforce a valid judgment of a court of competent jurisdiction in Nigeria, you sue for contempt of court, as simple as that.

-When two elephants fight, the grasses suffer the consequences of the battle, is a very popular African proverb.

-The indefinite and a nationwide strike embarked upon by the Judiciary Staff Union of Nigeria (JUSUN) is absolutely unfortunate in view of the fact that the strike has crippled every judicial activities in all the Nigerian Courts.
-The current industrial strike embarked upon by JUSUN has brought hardship, suffering and pains to innocent litigating Nigerian Citizens.
-As at 3rd of November, 2014, there were two-hundred and two (202) appeals pending before the Honourable Justices of the Supreme Court of Nigeria.
-Owing to JUSUN industrial strike started three (3) weeks ago, none of those appeals could be entertained by the Honourable Justices of the Supreme Court of Nigeria including the Appeals filed by Comandclem Nigeria Limited and the Cross Appeal filed by Mobil Producing Nigeria Unlimited.
-In totality, JUSUN strike is unfortunate in the sense that it has amounted to a contradiction in that the same court, which ruled in favour of JUSUN, have been shut down in respect of the judgment. Thank you.

“-The determination of all the outstanding motions in the case between Comandclem Nigeria Limited and Mobil Producing Nigeria Unlimited could not hold on the 19th day of January, 2015, in the Supreme Court of Nigeria because of the unexpected JUSUN strike.
-The appeal of Comandclem Nigeria Limited is not the only appeal affected by JUSUN strike in Nigeria. Over two-hundred and two (202) appeals pending before the Supreme Court of Nigeria could not be entertained as a result of JUSUN strike. Those appeals must suffer adjournments.
-The rule of the court is that when the court could not adjudicate upon an appeal fixed for hearing on a particular date because of one reason or the other, the appeal must suffer an adjournment; and as the court pleases and on the discretion of the court, the court has a duty to notify all parties the subsequent adjourned date.
-This position of law was demonstrated by Honourable Justice Tsammani, (J.C.A) in the case between Conleth Anyamele Onyenobi V. Louis Amadi & Ors, when the court said and I quote.
-‘‘It is the law that, where a court adjourns a case beyond a date which the litigants have notice of the hearing, the court has a duty to notify the parties of the subsequent adjourned date.”

JUSUN Suspends Strike in Federal Courts

The Judiciary Staff Union of Nigeria has suspended its three weeks old strike in federal courts.


The suspension was the result of a meeting held at the Supreme Court on Sunday at the instance of the Chief Registrar of the Supreme Court, Ahmed Gambo.


Details of the decision to suspend the strike remain sketchy.


However, a source who was not authorised to talk told our correspondent that the strike had been suspended only for federal courts.


The implication is that states' courts will remain shut.


The affected courts are the Federal High Court, the Court of Appeal, the Supreme Court ‎and the National Industrial Court.


These courts are expected to reopen for business on Monday, 26th January, 2015.


For three weeks, the workers effectively ‎closed down all courts nationwide following the refusal of the executive to comply with a judgment of a Federal High Court, Abuja which ordered the executive to hands off funds meant for the judiciary.


JUSUN's President, Marwa Adamu said the workers decided to go on an indefinite strike because the executive did not comply with the agreement reached with the union to comply with the judgment of the court on judiciary funding.


While sympathizing with litigants, he said the workers had no choice but to go on strike to compel implementation of a subsisting court order and the agreement reached with them.


The strike denied politicians ‎dissatisfied with their parties primaries to have their grievances heard in court.

(1.0) Introduction

(1.1) It is now an history that the 19th of January, 2015, a date fixed for the hearing of outstanding motions in the case of Patent Right Infringement between Comandclem Nigeria Limited and Mobil Producing Nigeria Unlimited pending in the Supreme Court of Nigeria clashed unfortunately with the nationwide Judiciary Strike in Nigeria.

(1.2) The possible outstanding motions the Honourable Justices of the Supreme Court of Nigeria fixed for adjudication on 19th of January, 2015 are stated as follows

(1.2.1) Restoration Application: Filed by Comandclem Nigeria Limited

(1.2.2) Application Of A Party Sought To Be Joined. Filed by Muideen Oyewo Adekunle (A fake Patentee from Kwara State)

(1.2.3) Application To Substitute The Name Of The 1st Appellant & The 1st Cross Appellant: Filed by Comandclem Nigeria Limited.

(1.2.4) Application For Time Extension To File The Cross Appellant Reply Brief: Filed by Mobil Producing Nigeria Unlimited.


(2.0) Duties & Responsibilities Of Litigants (CCNL And Mobil Oil)

(2.1) Before I make any categorical statement on the next hearing date in the case of Patent Right Infringement suit between CCNL and Mobil Producing Nigeria Unlimited, I consider it pertinent to identify and explain the duties and responsibilities of The Board Of Directors in CCNL before the Honourable Justices Of The Supreme Court Of Nigeria.

(2.2) The duties and responsibilities of The Board Of Directors In Comandclem Nigeria Limited is to file A Brief Of Argument as provided for in Order 6, Rule 5 (1a) Of The Supreme Court Rule Of 1985 As Amended. With your due permission, I quote.
5.(1)(a) The appellant shall within ten weeks of the receipt of the Record of Appeal referred to in Order 7 file in the Court and serve on the respondent a written brief being a succinct statement of his argument in the appeal.

(2.3) For information purposes, I am happy to inform you that, The Board Of Directors in CCNL had filed the following processes and Mobil Producing Nigeria Unlimited had replied accordingly.

(3.0) Duties & Responsibilities Of The Supreme Court Of Nigeria

(3.3) In recent times, I have received hundreds of calls from the CCNL Patentees both in Nigeria and Oversea putting series of pressures on me to fix a new hearing date for the pending case before the Supreme Court of Nigeria.

(3.4) It is neither the duty of the CCNL Marketing manager, Yusuf Nurudeen, nor the responsibility of The Board Of Directors in CCNL to fix hearing date for cases before the Supreme Court of Nigeria.

(3.5) It is the sole responsibility of the Supreme Court of Nigeria to fix hearing date for cases listed before it as demonstrated by Honourable justices Uwa in the case between Bajoga v. Government, F.R.N.2007, when he said and I quote him verbatim.

It is the court`s duty to fix hearing date of the motion on notice after granting leave. An applicant has no role to play in the fixture of such hearing dates.

(4.0) Conclusion

(4.1) From the above authority of Justice Uwa, it is obvious that the fixing of hearing date for cases before a court of competent jurisdiction is not the duty of any litigant but the responsibility of the court.

(4.2) Asking me (Yusuf Nurudeen) or The Board Of Directors in CCNL to fix hearing date for a case before The Supreme Court of Nigeria is like asking us to take over the responsibility of the court.

(4.3) As the court pleases, & on the discretion of the court, the court shall notify The Board Of Directors in CCNL the next or new hearing date of suit sc./69/2011 through an instrument of the court called HEARING NOTICE.

(4.4) The moment a new hearing notice is issued by the court, I shall notify all the CCNL Patentees on the social media.

Comandclem`s BOD Members Resisted
The Activities Of Intruders To Elongate And Disrupt
Appeal In The Supreme Court Of Nigeria.



(1) The Board Of Directors (BOD) in Comandclem Nigeria Limited has resisted the activities of some intruders (enemies of patentees) to elongate and disrupt the ongoing appeal against Mobil Producing
Nigeria Unlimited in the Supreme Court Of Nigeria .


(2) Pieces of information at my disposal show that there were unreasonable agitations and unjustifiable pressures emanating from some intruders (enemies of patentees) on the Board Members in Comandclem Nigeria Limited to hire the services of a legal academician, Professor Bankole Sodipo to suspend the professional services of the CCNL`s famous leading legal Counsel, Aiku Babatude (SAN) in the case against Mobil Producing Nigeria Unlimited ongoing in the Supreme Court Of Nigeria .


(3) It is on record that this legal academician , Professor Bankole Sodipo , is a legal counsel of a party sought to be joined (Oyewo Muideen Adekunle-a fake Patentee from Kwara State), who requested the Honourable Justices of the Supreme Court of Nigeria

(i) to make him (Oyewo Muideen Adekunle) a second inventor after the first & true inventor, King Professor CJA Uwemedimo,

(ii) to elongate the appeal of CCNL for additional 90 days,

(iii) to make him (Oyewo Muideen Adekunle) the representative of all the CCNL Patentees


(4) In a letter written by the BOD in CCNL, copied The Registrar, Litigation Of The Supreme Court Of Nigeria , dated 22 nd of January, 2015, addressed to this legal academician , Professor Bankole Sodipo, he was advised in his interest not to appear for CCNL in any court in view of the conflict of interest involved.


(5) The question is,

“Can a lawyer who represents a party (a party sought to be joined) in a legal suit also be a lawyer that will represent the opposing party (appellants) in the same suit pending before the Supreme Court of Nigeria in view of Rule 10 (b) of the Legal Practitioners Act, Chapter 207, Laws of the Federation of Nigeria?”


Note: Rule 10 (b) of the Legal Practitioners Act, Chapter 207, Laws of the Federation of Nigeria states as follows.

10. Adverse Influences And Conflicting Interests.

(b ) “ It is unprofessional conduct to represent conflicting interests, except by express consent of all concerned given after a full disclosure of the facts. Within the meaning of this rule, a lawyer represents conflicting interests when in respect of one client of whom he presently contends the interests of that client touch or concern confidences of another client to whom the lawyer at the same time, owes a duty of service.”


(6) On behalf of the CCNL`s Patentees, we appreciate the committed efforts of the CCNL`s BOD Members to resist the activities of intruders (enemies of patentees).

Reasons Why Royalties
Have Not Been Paid To Patentees

(1) On 7th of February, 2011, King Professor CJA Uwemedimo, the Chairman and Chief Executive Officer of Comandclem Nigeria Limited, officially dismissed the General Manager of his company Pastor Monday Akpan in a letter written to that effect.

(2) Out of annoyance and wickedness, Pastor Monday Akpan (dismissed staff of CCNL) filed A Notice of Withdrawal on 24th of March, 2011 with the official signature of Professor Tony Ukam ESQ (former CCNL`s Lawyer) to revenge his dismissal from the company.

(3) On 5th of May, 2014, Honourable Justice Walter Samuel Nkanu Onnoghen (JSC) dismissed CCNL`s Appeal because of the Notice Of Withdrawal allegedly written by Professor Tony Ukam ESQ (former CCNL`s Lawyer).

(4) On 11th of August, 2014, CCNL filed A Restoration Application/Motion to set aside the ruling delivered on 5th of May, 2014, and to restore the dismissed appeal against Mobil Producing Nigeria Unlimited.

(5) On 22nd of October, 2014, Mobil Producing Nigeria Unlimited resisted The Restoration Application/Motion filed by CCNL on the ground that Pastor Monday Akpan (dismissed staff of CCNL) was the staff of CCNL that filed the Controversial Notice of Withdrawal.

(6) Specifically, in paragraph 4 (xiv) of The Counter Affidavit filed by Mobil Oil in the Supreme Court of Nigeria, Eyimofe Atake (SAN), lawyer of Mobil Oil, confessed that Pastor Monday Akpan was the staff of CCNL that filed the Controversial Notice of Withdrawal but failed to serve them, when Eyimofe Atake (SAN) said and I quote him verbatim.

“That contrary to the facts deposed to in paragraph 5(ii) of the applicants` affidavit, on 24th March 2011 when the said Notice was filed, a Pastor Monday Akpan gave the Registry of this honourable court an undertaking that he would serve the notice on the respondents in their offices. There is now produced and shown to me, the Notice of Withdrawal marked “SI 1” showing at the bottom part of the Notice, the undertaking by Pastor Monday, Akpan”.

(7) The decision whether or not to restore the CCNL`s Appeal dismissed on 5th of May, 2014 shall be made by the Honourable Justices Of The Supreme Court Of Nigeria in the next hearing date yet to be fixed.
(cool Orphans, widows, market cleaners and poor Nigerians who have invested in the patented invention of King Professor CJA Uwemedimo for years would have been receiving their respective royalties/profits ever before now if not because of the Notice of Withdrawal filed by Pastor Monday Akpan (dismissed staff of CCNL) to dismiss the CCNL`s Appeal before the Supreme Court.

(9) When King Professor CJA Uwemedimo was alive, he had cursed Pastor Monday Akpan (dismissed staff of CCNL) for anti-company`s activities.

(10) CCNL is a God`s Project, no human being can destroy it.

(11) Pastor Monday Akpan (dismissed staff of CCNL) will never see peace again because he had attempted to destroy the Project of the Almighty God, Comandclem Nigeria Limited.

(12) So shall it be. Amen.

Below this Notice of withdrawal, Pastor Monday Akpan wrote as follows.

“I Pastor Monday Akpan undertake to serve the respondent in their office”. Signed and dated with even phone number.

The letter of dismissal of Pastor Monday Akpan is also attached.
