The Case of Frank Okon vs. Godswill Akpabio
Today (January 31), at the Federal Court in Abuja, the case on the matter of Godswill Akpabio and Frank Okon, as expected, was adjourned or postponed to March 6, 2012. The reason for the postponement is due to a request by Godswill Akpabio to allow his newly hired lawyers time to become acquainted with the case. Sources say Akpabio either has replaced his former lawyers, who were handling the case, or has hired a new attorney as a lead.

Whatever are the reasons for today's postponement of the case, analyst say the real reason is that Akpabio is exploiting and using all available loopholes at his disposal as tactics to delay the case until he is ready to vacate the Hilltop Mansion, which he has been occupying since April 2011, after he stole the people's mandate.

Those close to him say due to the pressure from Internet critics and all the pending court cases against him, Godswill Akpabio was prepared to resign his position as the governor of Akwa Ibom State a long time ago, but was advised by his closest confidante, particularly Emmanuel Enoidem and Don Etim, to stay on until he makes sure that he has saved enough money that would allow him defend himself against petitions filed by his opponents with the EFCC, SSS, and other security agencies in the country. Once Akpabio leaves the office, the Immunity Clause will no longer protect him from investigation and a possible prosecution, as the five former governors recently sacked by the Supreme Court are finding out.

Hope on the N150 billion Bond
Those very close to Akpabio say he is now counting on the pending application for a N150 billion Bond as his exit money. As soon as Akpabio receives this money, according to one inside-source, Akwa Ibom people will witness an unfolding drama. They will wake up one day to learn about the resignation of Akpabio, as they turn on their television sets and radios. "He will cite poor health as the main reason for his resignation."

Luckily for the people of Akwa Ibom State, the Action Congress of Nigeria (ACN) has sent a letter to the Director General of the Nigerian Exchange Commission alerting him of a planned lawsuit to stop the agency from approving the N150 billion Bond for Godswill Akpabio. Even if the Exchange Commission ignores the thread of a lawsuit and hastily approves the Bond for Akpabio, chances are that the matter will drag on in court for a long time, which means Akpabio may never be able to get his hands on the money. As one of the lawyers for ACN puts it, "As far as we have the law, Akpabio will never touch that money, because if he escapes with such a huge sum of money, Akwa Ibom people will be in perpetual debt to pay back to the financial institution with which the Bond was obtained."

Akpabio's Delaying Tactics
Meanwhile, while Akpabio is waiting for the money, he is using all versions of strategies to delay the two most important cases pending against him in two different courts and in two different cities and in two different States; the court in Abuja and the Tribunal in Uyo.

Despite the fact that there are precedents to the contrary, which the judges can lean on, Akpabio still went ahead and instructed his lawyers to argue at the Tribunal in Uyo that the 180 days time-period had expired, therefore, the dispute of the gubernatorial dispute between him and Senator Akpan Udoedehe should be dismissed. Analysts say it is very likely that the Tribunal will reject Akpabio's request. But, as another ploy to drag on the case until the Bond application is approved, Akpabio may appeal the decisions of the lower courts (the Tribunal in Uyo and the Appeal in Calabar) all the way to the Supreme Court in Abuja. These appeal processes take time and that is exactly what Akpabio wants.

On the matter of Frank Okon against Akpabio for forging a Certificate of Clearance to contest the last gubernatorial election, the court, or should I say the judicial, process has been nothing but a Russian roulette. Postponement after postponement seems to be the norm which many observers now find amusing. Ever since the case was filed, soon after the Governorship Election of April 26, 2011, several reasons have been issued by the court on why the case has to be postponed. Reasons have ranged from the wife of the Chief Justice being killed, to the trial judge being at a conference.

In December (or was it November?) 2011, when the court convened to hear the case, Akpabio's lawyers complained that they could not read the sworn testimony of Chief Nwodo, the former National Chairman of PDP, in which he stated that he never signed the Certificate of Clearance to clear Akpabio to contest the governorship election. The case was then adjourned till today (January 31, 2012). And today, there was a request by Akpabio asking the court for more time so that his newly hired lawyer could have time to process the case and review all available evidence and, as in the past, using and the case was adjourned till March 6, 2012. In March, only God knows what will happen.

Public Opinion
While Akpabio is playing the typical cat-and-mouse game, the people of Akwa Ibom State don't think all the manipulations and maneuverings of the judicial system is funny. What is funny is that Akpabio and his people have convinced themselves that the masses have no idea of what is going on. But the masses know and they are getting tired of all the nonsense. A man I contacted in Uyo said "The man (Akpabio) is not even in the State. He is always in Abuja or somewhere else. This means he is no longer interested in the affairs of the State. Why can't he just resign and let someone else do the job. The workers are not paid on time, unemployment is high, crime rate is accelerating, poverty is growing exponentially, and all these vices happen because of poor leadership. Let Akpabio leave so that we can have a leader who can take care of the State. That is all what we are asking for."

But Akpabio is not leaving, at least not until he secures himself, his future, and the future of his family financially. Akpabio knows that once he leaves the office, there will never be another opportunity for him to have access to the State Treasury for easy money. That is why the N150 billion Bond will give him the insurance of his life, even if it means spending a couple or more years in the federal penitentiary.

I am very surprised at how much people are ready to twist the truth or lie outrightly just to defend a bad case. Imagine the blatant falsehood contained in this article.
Ok let us address the issues raised by the author.
1. The N150b bond.
It is obvious the author is ignorant about public financing and how governance is run.For the sake of clarity and education let me say that the issue of sourcing the bond from the money market was not an after thought as the author would want people to believe rather it was a well thought out process which was captured in this year's budget. In public financing when the expenditure in a particular period exceeds the revenue, it becomes imperative to borrow to finance the deficit. So borrowing is a key feature of public finance, even the USA borrows money to finance her budget deficit. What has always been of concern to financial experts is the purpose for which the money is borrowed. If it is borrowed to finance the capital rather than the recurrent budget, then good and fine. In the case of the N150b bond in question, the purpose for it acquisition is clearly stated and it is tied to specific capital projects, am I certain that the author of the article bothered to find this out before putting pen on paper.
The second issue raised about the bond is the alleged intention of the Governor to run away with the money once it is procured. Quite laughable! How possible would that be? In today's global and technological advanced world how on earth will it be possible( assuming it is even been contemplated) to divert the funds from the state's account to the Governor's, wire it abroad and conceal it from being traced. It is obvious again that the author does not understand the basic working of financial and banking institutions.
