Please do you know whether this terms & conditions, you mentioned in your post, cover situations where the ATM machine debits the customer's account twice for a single withdrawal? Kindly advise as we have a case in hand and we are contemplating suing the bank for fraudulent withdrawal as the account has been compromised.

Not all terms of agreements are enforceable in court....some can be outrageous, predatory and unconscionable that the Judge can toss them even if you had signed them. That is why in some more sophisticated agreements... they insert a severability clause that goes sometime like..'if any part of this agreement is found to be illegal or otherwise unenforceable, the remainder of the agreement should still apply'

ill advice u bro dat there is a case and if u got d forfitude go for it and dont b detterd by d words of some mediocars here
GT BANK customers agreement does not or xpressly or impliedly cover such act directly. such damage could or might be justified from a collection of some ambigious sections well dat i may not hav all xplanations to just get d best idea from one or two lawers u might jst b d first to mk d difference cheers

Instead of suing, try a simpler approach - walk into the bank where it happened. Ask for a floor manager and explain your predicament. If they refuse to refund your money, then ask to see the branch manager. You never know, they might be nice and willing enough to compensate you. Or maybe i'm being naive, dunno undecided

I also have the mind of suing the stupid bank. Here is my story.

It happened after GTB changed ATM cards from "stripe" to "chip & pin" technology. I wrote the bank informing them that I don't want an ATM card, yet they debited my account to the sum of N1,050.00 and SMSd me that my ATM card is ready for collection. Was I mad when I got to the Bank and met a CSO who informed me that it is the Bank's policy to issue ATM cards to all account holders, irrespective of whether you want the card or not and to also debit the cost of the card from the account holder's account. I called GTConnect several times and laid my complain, for which I was told the same thing the CSO told me at the branch.

Since I have been forcefully issued a card and charged appropriately, I was like WTF, let me just get my card and start using it as there is no way I can seek redress.

On trying to activate the card, it refused to work. I went back to the branch's CSO who also tried and tried for weeks to no avail. I called GTConnect and got some stupid instructions on how to activate the stubborn card (things myself & the CSO had already done like over a hundred times). The CSO then asked me to return the defective card for a possible replacement at no extra cost. Alas, barely a week later, I was charged the sum of N1,050.00 from my account again for the new ATM card. I fumed to the branch amd met a CSO who was even more perplexed than myself as to the deductions and apologized profusely with a promise to 'see what he can do about the matter'. This time the card activated properly. But, I still need redress as to:

1. Forcefully issuing me an ATM card against my wish (I have a received copy of the letter indicating my wish).
2. Debit my account without due authorization from me.
3. Charging me for a defective ATM card they produced (making me pay for their error).
4. Making me incurr extra costs against my wish by charges incurred from costs of transportation and Phonecalls.
5. I lost valuable production time by transiting to and fro the bank the period the saga lasted.
6. Breach of trust by carrying out unauthorised deductions from my account.
7. General inconveniences.

What do you guys think? Can I sue their hasses for anything?

You might have a case, but the second time you were asked to end the card back for a free replacement do you have it in writing and signed by the bank? and hope you didn't fill and sign the ATM form cause if you did you don't have a case.

Get real clown.what did you lose through the action of the bank that you open ur mouth to even dream of suing them for up to 250mil. U no be small thief at all.patapata,assuming ur case even makes it to court which i strongly doubt,the best you can get is a refund of ur debited amt and possibly an extra 2k for ur t.p and troubles.
For ds country,na the big dogs get mouth.

Whenever you notice illegal or excess charges in your accounts,you should ask for a print out of your bank statement stamped by the bank,thereafter the account should be properly reviewed by you or a bank charge review specialist(I do this for a living).Thereafter any identified illegal or excessive charges should be documented and a letter sent thereafter to the Chief inspector of the Bank's head office in question and copy the MD and branch manager.after 2 weeks if there is no response,kindly forward a letter requesting for additional 100% of whatever excess or illegal charges to the Director,Consumer and financial protection department of the Central Bank of Nigeria(U.F shehu),endeavour to also copy the bank in question.

Leave the rest for the CBN to handle.

Though the banks are truely stupid.. Their was a time i withdrew 20,000 and they debited my account and their stupiid atm didnt give me anymore.. And after i complained they said they are going to reverse it within 24hrs.. Buh dey didnt until after 3month when i dint even need it anymore..

Buh seriously u got one bad joke man hehehe u want festus keyamo for 1000 and still get 250mil.. Seriously that cracked up.. very funny guy

Earlier this month I went to GtBank to withdraw money through their ATM and their network went off only for my card to get stuck inside,I could'nt wait for their useles network to come back ,

After waiting for more than 30min, I left only to come back the next day for my card,mind u I reported that issue dat same day before I left,on d next day I was told I have a RETRACTED card which means I have to apply for another card,I did thinking its free ooh since its not my fault,the card came out after 2 weeks and the useles bank debited my account to the sum of #1050.
My annoyance here is not that I can't afford to dash them that money but why wil dey have debited my account without telling me, knowing fully well, that the fault is not mine.

I need a strong charitable lawyer like FESTUS KAYAMO do any of u know how I can reach him please.

Mr. Poster, Retracted cards can always be collected back without having to apply for another, i was a staff of the prestigious GTBank and i can assure u that u cnt sue them for even 1kobo, ur fault was impatience and before filling the application form for a new card, there are terms and conditions with u must meet and they include having a certain amount in your account; besides u did not make good inquiries before applying for a new card. we have seen cases that are worse than yours. like i said before, u cnt even sue them for a cent. just admit that u have made a mistake, though it was as a result of their network failure which is widely acceptable [Network can fail anytime]. So think of something else or try and contest for the Gulder Ultimate search if u'r seeking a short-cut to make it.

Ur friend did everything right till he contacted a stupid law undergrad.
He should have filed his case in court and gotten a court date.

It is the courts duty to determine complicity in the matter(if the coke was actually from cocacola or not) and not a cocacola rep.

Going to cocacola is the dumbest thing to do...cocacola would have come to them.



My GTB guy....u have a case ooo...I'm sure the card was missing in there possession that's why they ask you to get a new one.GTB is liable for not producing your card that got stuck due to no fault of urs.

Get a good lawyer...u'll get damages at least.

What terms and conditions says @OP has to pay #1050 for the seizure of his card by GTB ? It's not as if the card got EXPIRED to warrant a replacement but it only got retracted for other reason which the @OP wants to know. All these charge and bail lawyers on NL are very funny.

I think you'll lose the case because they have themselves covered somewhere in their terms of service(TOS). That's why it's always imperative that your read the TOS of any company you want to sign up with.

Great poster don't be discouraged go ahead and sue. If you do not win , at least for the b=nuisance value the bank will sit up. Though I love GT bank but they have not done well this time if your story is the FULL version.

Let me just mention that even if you get the the services of a lawyer free of charge , it is still quite expensive to go to court in Nigeri. have a good budget of not less than 250k for the filing and all the processes.

I think service providers will get more careful when they see nigerians are ready to enforce their rights. Thieving companies like Multilinks should get ready

My sis works for a bank's legal dept...and I know for a fact that banks are coughing out millions to settle out issues like this.

Interesting. My dad is a lawyer and he won a similar case against Fanta with a couple of millions involved when I was younger.

Assumin the OP has a legit case, how does losing 1050naira translate to sueing for 250mill naira?

Unless you can prove to the court that seizure of the card or debited cash resulted into other significant loses than ran into millions, otherwise , you will be seen as a thief.

I have seen and heard people talk about sueing for million even when loses to them is just 200naira. Mind you, you cant sue on behalf of everyone else that has similar cases.

A lot of less greedy and logical customers make their case known and sometimes get reward for their manner of approach. All I can deduce from all these hundreds of million naira suits from 1000 naira loses are bloody opportunits
