THE national secretary of the Peoples Democratic Party (PDP) and former governor of Osun State, Prince Olagunsoye Oyinlola, with the Osun and Ekiti state chapters of the party, on Tuesday, applied to the Federal High Court sitting in Abuja for the withdrawal of the N150 billion suit they brought against telecommunications firm, MTN Nigeria, over alleged unethical handling of call logs of the suspended president of the Court of Appeal, Justice Ayo Isa Salami and chieftains of the Action Congress of Nigeria (ACN).

The discountenance notice, dated June 4, 2012, contained no reasons.

Justice B.B Aliyu consequently struck out the suit, which also had the Nigeria Communications Commission (NCC) as co-defendant, despite the protestation of counsel for the MTN, Adetunji Oyeyipo.

Nigerian Tribune also gathered that MTN had also filed an appeal, challenging the decision of the court to strike out the suit.

The appeal was consequent upon the plaintiffs’ move to file a fresh action against MTN and NCC over the same issue.

It was learnt that the suit was withdrawn by the plaintiffs to pre-empt the defendants from using technicalities to knock it off.

The defendants were reportedly planning to explore certain provisions in the Act setting up the NCC to raise technical issues regarding the

suit, which could give them an edge if the court wanted to consider the issues raised in the suit on technical grounds.

The technical issues were hinted in the preliminary objection brought against the withdrawn suit by the defendants.

The plaintiffs had also commenced the process that would culminate in the re-filing as prescribed by the Act setting up the NCC, in relation to filing complaints against telecoms operators in the country.

The plaintiffs have subsequently written a fresh letter to MTN, raising issues of alleged unethical conducts in the handling of call logs during the National Judicial Council (NJC) probe of alleged corruption in the top echelon of the judiciary.

The suit was struck out because PDP/Oyinlola applied for the withdrawal of the suit because they want to file another suit against MTN and NCC over the issue.

of all newspapers u quoted "TRIBUNE" a very biased newspaper, wat do u expect 4rm PpleDecevingPple(PDPs) mouthpiece! "They withdrew d case to avoid it being knocked-out based on technicalities..." dis only shows dat there's sumtin fundamentally wrong wit d plaintiffs(Oyinlola and Oni) and it also shows how desperate pple can be in d pursuit of injustice!
