As an aside,in some Western countries,kids under the age of 16 can't be charged for rape even if they did it broad daylight. then you must not have heard of the teenage boys a while back who raped a young girl in a school bathroom. they were underaged too but they got dealt with. there are laws even for underage 'criminals'. they might not go to prison but there's always juvenile hall. Nobody is saying under aged never get charged for rape.You raised the point that the girl was 11,which I noted was irrelevant in so far as her partner was 15.So the question of her being 11,or the hypothetical 3 year old,was pointless. If the events establish rape,which they don't,then her age would become irrelevant.If the events don't,as in this case,then the ages of the parties becomes relevant.You can then ask in the latter,whether one of the parties was of the age of majority and if so,this render the other's "consent" invalid. If she had sex with a 18 year old,whether she consented or not,it becomes statutory rape.If she had sex with a fellow under age,her consent or lack of one becomes relevant This is where you have failed to persuade me,that the facts as outlined by her will secure a conviction.It won't. We can debate the rest of the mountain of illogic you espouse to no avail. The law makes having sex with an underaged girl a crime not because underaged girls don't have sexual feelings (we all know they feel the stirrings) but because the pregnancies, stds and trauma that MAY come with it is beyond what they can deal with at such a tender age. Tripe. Its also illegal to have sex with a 15 year old boy so where does that leave us? You know why it doesn't amount to a sexual assault of the 15 year old?Because his partner is 11. |

You don't have a point. If I took my 9 year old daughter to Iran and some grown man has sex with her with her consent,it won't be rape. Contrary to your nonsense earlier,its extremely difficult to establish rape even where the victim alleges rape.Practically impossible if the "victim" says she wasn't raped.That,madam is the way life is. |

Its relevant in the sense that,just like the story on this thread,that something seems patently wrong to us doesn't make it criminal.Sleeping with a 9 year old girl is horrible,but in certain places its not a crime. 9 year olds and other under aged kids having sex,especially in the circumstances recounted here, is wrong.But alleging rape,a crime, is quite baseless in this scenario in as much as we disapprove of what happened. |

A 21 yr old who recently got out of prison. He was given a 10 year sentence for receiving oral from a 15 year old, when HE was 17 years old. His got out on parole for good behavior after 4 years.
Under Georgia Law, oral sex or intercourse with anyone under 16 is considered aggrevated child molestation even when occuring consensually between teens a few years apart in age. If a 17 year old can go to jail for getting oral from a 15 yr old, I don't even want to know what the maunlove's so called love interest would have gotten.
