The Final Solution to Corruption in Nigeria


When Corruption has become so routine that even seasoned thieves and corruption God-fathers ( Like our dear friend Umaru Dikko ) see it as madness. It is time the Nigeria state face reality and re-invents an ingenious way to stop this monster called corruption otherwise we would all be consumed by it.  EFCC is fighting a loss battle her Chairman has been quoted and I quote “ saying some of our political leaders have mental problems and need Psychiatric help” ,   It is time to get back to the drawing board and look for a more practical solution. That Solution is what I call the Final solutions just like the Nazis when they were hell bent on eradicating the Jews they had to dig deep and involve the some of the finest brains in Germany to come up with an ingenious way of dealing with the Jews problem which they see as the cause of all their problems. I am not in anyway advocating or in support of what Nazi Germany did, but what I am interested in is the word Final. Final means all other methods have been tried and failed we shall try one more last solution and if it did not work we might as well give up. Nazi Germany believes the problems of their society had to do with the Jews and to their thinking they came out with what they thought was the final solution. Today Nigerians need a final solution to the Corruption which has become endemic and it is crippling the nation. Electricity discovered in the mid 1850’s and today 2009,  159 years after its discovery Nigeria cannot not boast of constant supply of electricity despite all the technologies available today. This is an un-acceptable situation.

Final Solution


1. The Federal Government should establish a new ministry or Agency called the Federal Vetting Agency or Federal Asset Declaration Agency  either of those names will do.

2. The Agency should have a Chairman based in Abuja and 36 Commissioners based on each of the states of the federation.

3. The aim of the agency is to Vet all political office holders from councillors to the presidency.

4. All future political office holders should declare their assets in an asset register before they can run for an elective post.

5. The Agency should have a web site which should be made public, people can check what the assets of prospective candidates running for various offices. People who have chosen to run for public office should be scrutinized by the public.

6. The Agency will issue each political office holder a certificate after verification has been concluded, this certificate should have been received 3 months to the commencement of elections.

7. A recent case that I read on the Net about the Governor of Ebonyi State buying 5th hand peageout 305, 11 years ago and now he is worth N80 billion will not happen in future.

8. With this method 90% of the resources of each state and local government will be spent in those states and LG.

9. The EFCC should be incorporated into this new Agency and will be the prosecution arm of the agency. They will investigate any case of misappropriation or allegation of fraud.

10. I think this method will eradicate 90% of fraud and embezzlement. A man before he became a Governor has one house and all of a sudden after he becomes a Governor has houses in every city will be questioned on how he came to acquire such wealth in short space of time. If he cannot provide a good reasons how he got the this sudden wealth, the agency will be given the power to sell those properties and the proceeds put back into the coffers of the state or LG, or Federal Ministry as the case may be.


Conclusion – Those of you in power today tell Yaradua to establish this Agency in time so that we as a nation can reap the full potential of Democracy. We are tired of the system as it is we have found the FINAL SOLUTION.

Educate yourself on what is on ground before going off spouting a 'final solution'

The Code of Conduct Bureau already carries out majority of the functions you listed, the only difference is that the evidence is not made public.

There is no 'final solution' in creating more bureaucracy - we have enough bodies to fight corruption as it stands. We just need to arm them properly and begin to see them perform.

    The Code of Conduct Bureau and Tribunal Act, Chapter 56 LFN 1990 gave the Bureau the mandate to establish and maintain a high standard of public morality in the conduct of Government Business and to ensure that the actions and behaviour of public

    officers conform to the highest standard of public morality and accountability. To implement the above mandate, Section 3, part 1 of the Third Schedule to the 1999 Constitution of the Federal Republic of Nigeria has provided an enabling legal environment for the Bureau to:

    (a) receive declarations by public officers under paragraph 12 of part 1 of the Fifth Schedule to the Constitution.

    (b) examine the declarations in accordance with the requirements of the Code of Conduct or any Law;

    (c) retain custody of such declarations and make them available for inspection by any citizen of Nigeria on such terms and conditions as the National Assembly  may prescribe;

    (d) ensure compliance with and, where appropriate, enforce the provisions of the Code of Conduct or any law relating thereto;

    (e) receive complaints about non-compliance with or breach of the provisions of the Code of Conduct or any law in relation thereto, investigate the complaints   and, where appropriate, refer such matters to the Code of Conduct Tribunal.

    (f) Appoint, promote, dismiss and exercise disciplinary control over the staff of the Code of Conduct Bureau in accordance with the provisions of an Act of the  National Assembly enacted in that behalf; and   

    (g) Carry out such other functions as may be conferred upon it by the National Assembly.

There is nothing bad in having an Agency dedicated to Asset verification of political office holders, except you are in support of the status quo as it stands. If as you said the Code of Conduct Bureau is doing exactly what I pointed out as to the powers of this new Agency then the allegation against the Govenor from Ebonyi State should be straight forward you just comapare what he declared in the asset register with what he has in reality. Is dead simple and its a no brainer.

I am not in support of the status quo, I simply pointed out that your 'solution' involving creating another body will not help if it is not empowered. In light of the fact that a body exists for this same function, a new one is not needed.

The allegation is straightforward, but WHO made the allegation? Has it been reported to the appropriate quarters or is it just sensational journalism on the pages of newspapers?

I know Orji Uzor Kalu was prosecuted (or an attempt at prosecution) by the COCB, so there is a way of using existing systems. Let those with allegations+evidence report to the COCB.

Not exactly - you cannot arrest someone simply because they have more cars than 5 years ago. Evidence and proper investigation should be carried out to establish guilt or what not

A potential issue with such a declaration is the right to privacy. I do know they are public officials, but even they are entitled to some level of privacy.

I have nothing against your idea in principle, just the workability of it.

I remember years ago a freind of mine was working for a shop in central london, the shop had a policy of each staff should have a maximum of £10.00 in there pockets which the shop beleif is more than enough for lunch expenses. This freind of mine was going to work one morning and met one chap that was owing him £20.00, so he asked for his money, the chap paid up. But my freind had forgotten about the company policy he just shoved the money into his pocket and went to work. Checks are not done everyday but routinely, he was unfortunate checks was carried out on the day he had this extra £20.00 on him. He explained to his boss what happened that morning, his boss told him you know the policy, its either you keep the £20.00 and consider today as your last day with us or give up the £20.00 and still have a Job with us, he had to forfeit the £20.00.



The essence of this story is any money found on a public officer that cannot be traced will have to be forfeited to the state. This will eradicate bribery, for e.g somebody gives you N1 MILLION in other for his firm to win a contract, the public officer in concern cannot tell you where the money came from, that money will be given to the state, and if he say it is a gift from Mr A that could be construed as bribery which is a sackable offence so either way the public officer has to adhere to the principle of honesty, sincerity and just plain truth
.

The salaries of public officers should be made public, cars does not drop from the sky, how many million Nigerians would like to wave a magic wand and all of a sudden they will have more cars than say 5 years ago. We want real proper public servants who will come and serve and know their is no monetry gain in being a Governor.

The post of a Governor must be made less attractive your every whim is under public scrutiny. Umaru Dikko even said it recently that public office is not for making money which I agree with if you want to make money go and become a businessman or something. Its the people's money every kobo must be scrutinize if anybody does not like it they should not seek public office.

The big problem with your final solution is that you creat another bureaucracy to police and "monitor" and watch over officials---WRONG. If you do, you will simply have added another layer of bribe takers to the mix. Since we can't bring angels down from Heaven to monitor corruption for us the best and proven weapon for fighting corruption is:

1. For the short term- Exposure, transperancy, publicity---nothing concerning money should be hidden.

2. Education/cultural/attitude change--- unless the young people understand and appreciate the advantages of honesty, you can preach till the cows come home, they will end up corrupt like their parents, uncles, or next door neighbor who suddenly got rich quick without working hard at all.

We need to reach a point where a son could honestly turn his parents in for corruption, and vis visa.

Nigeria: Judge Orders Police to Pay Driver N2 Million

The Lagos police command is to pay N20 million as damages for the illegal detention of one Mr. Olalekan Ifonlaja, a taxi driver who was nabbed by the police for allegedly carrying guns concealed in bags of beans.

Justice Mufutau Olokoba of the Ikeja division of the Lagos High Court handed down the order Wednesday. Mr. Olalekan Ifonlaja was arrested in November, last year when men of the Rapid Response Squad (RRS) of the state police command searched and found guns concealed in bags of beans belonging to a passenger he was carrying to Berger, an outskirt of Lagos. The purported owner of the bags of beans bolted away while the search was going on and the police subsequently arrested Olalekan.

He was paraded before the media as a dealer in arms and was detained by the police at Alausa, with no proper charge brought against him. In an affidavit contained in a motion ex-parte seeking the enforcement of his fundamental human rights, his counsel claimed Olalekan was exposed to health hazards, regularly beaten up by inmates and tortured by policemen who were bent on forcing him to own up to the crime. In the motion ex-parte filed before the court, Olalekan sought a declaration that his continuous detention by the police from 10 November, 2008, till date was unconstitutional and unlawful. He also prayed the court to compel the police to pay him N20 million as damages for the inhuman treatment he was subjected to since his arrest. The plaintiff based his demands on the premise that he did not commit any offence that could warrant his detention, degrading treatment and parade as a criminal before the media.

Now if the various institutions in society upheld their end of the deal would corruption be as rampant a vice as it currently is in Nigeria? All that is needed is just a couple of examples to point at so people know that justice is probable hence as has been stated continuously enforcement is the problem hence should the question not be - "how do we ensure better law enforcement"? What examples can we point to in Nigeria whereby corrupt public officers have been thrown in jail? NOT ONE, and I stand to be corrected (please don't mention Alams, he did not see the inside of a Nigerian jail and was under "house arrest"wink.

Imagine if the police force and its officers where subjected to discipline in law courts, etc, and punished under the law, would such behaviours that have become synonymous with the Nigerian Police Force flourish as much as they currently do? The Nigerian society does not tolerate justice and to get justice you (the people) need to demand it. Such a thread will continue to ask thesame question ten years from now and for eternity unless the understanding begins to take root that there is no way around the people getting more involved in the way they are governed and hence fighting for their rights.

This looks so good on the paper, however, i dont see such working.
1. people in power will declare their assets now and that is easy to do, however, while in power, they can buy and run shows with other people's name and once they out of the office, they will get all back in some form or the other.

2. Leaders in Nigeria can even over-estimate what they worth all because, they soon, they will be so rich that they will be able to buy Nija.
3. People in the new agency like u call it, are not in there to watch train passes by, they are there to make money and they said, the way to every man's heart is their pocket, show most of them real money and they will betray the govt that gave them jobs.

There is still no final solution to the corruption in Nigeria cos:
1. Even the kids in the wombs knows the goodness of money.
2. Nigerians like to show off, and without money, it is not possible, so they will do all possible to make the money.
3. Everyone looks for opportunity to make money and lil bribe will do for them.

We need a better policing first before the so called agency of yours. All corruption in this country strive as a result of bad policing.
The nigerian police,i suppose,would be among the worst in the world. If the police does not know the difference between right and wrong how would they be able apprehend criminals? Majority of the present police employee would have to go.
We have so many unemplyed graduate who are very willing to replace them.
Lets start with that and see the difference.

Nigeria's is a peculiar case that requires its own peculiar solution, most public officers cannot seprate the public funds from private funds, that is where the assets register will be useful.

I read from BBC - Dimeji Bankole was accused of securing a loan to pay himself and members of the house inflated salaries and he was cleared because apparently he didn't break any laws.

From my understanding, the prosecution are clutching at straws trying to hit him with a charge but meet constant 'legal' interference I might add which delay the process.

If borrowing money to pay yourself a salary when there is already suitable (and generous) remuneration established for your position isn't illegal then I can assume the current problem with Nigeria is the failure of it's legal system.

The issue of public officers who have clearly attained wealth by questionable means wouldn't seem so flimsy if the law was iron clad.

I think there is a solution here - and I also think it's simple.

An iron clad bill signed into the constitution enforced by Nigerians to be the basis of a public officer being cleared for service.
You can make them pledge to enforcing the bill as a premise for them winning your vote. Every single officer.

Once this has been established a judge can no longer throw out corruption cases like theyre nothing, it will be clear that the law has been broken, money has been obtained illegally and the only question will be the length of the sentence.

At the same time, if this isn't already the case EFCC should be empowered to seize monies, offices and businesses if they are in any way linked such cases. By the time Dangote's production is halted because of one random governor they will know how to speed up judicial processes to ensure these criminals are prosecuted.

They currently only need the motivation to do so.
