Do u suggest he returns back to Nigeria after our marriage? Or he stays here while I file for adjustment of status for him?
My fear is if he returns back to Nigeria after our marriage, it might be hard for him to get a k1 visa or it could take a very long time before its approves
However,I also read it somewhere that if I file for him after our marriage and he returns back to Nigeria, that my petition will be abandoned, I read it somewhere that even if he falls out of status and I file for him after our marriage that all his sins will be forgiven
Pls clarify me on this . will he not have problem coming back to me here in the US if he returns back to Nigeria after our marriage ? I'm afraid I don't want to loose him.

If you are already married you would be applying for an IR-1/CR-1 visa for alien spouse, and yes, that is the proper way to do this. Or you can travel to Nigeria and marry there, but you would still required a IR-1/CR-1. Or, you file for a K-1 prior to your marriage and get married in the U.S. once it is approved.

You have to choose the option that works best for you and your partner. Just understand that travelling on a B1/B2 and adjusting status is not the proper use of the visa class and you would be knowingly abusing the system if he intended to stay.

Welcome back VO.
I had a successful immigrant visa interview on 2nd October, I was told the visa will be ready in 2 weeks, now it's been 3 weeks and no sign of it being ready for pick up.
it's been issued on 6th October.
my birthday is on 1st November, I would love to celebrate it with my husband. that will be the best birthday gift ever from nvc.
waiting anxiously for your kind response.

I had a successful interview on 2nd October, my interviewer told me that my visa will be ready in 2 weeks time, it's 3 weeks now and it's not ready for pick up.
my case status shows "issued" on 6th October till date it hasn't changed.
please what is going on?

There is no such thing as a 2-year immigrant visa. You need to submit a petition and have a qualifying relationship to submit a petition for immigrant visa. I recommend you read more about the process here: http://travel.state.gov/content/visas/en/immigrate/immigrant-process.html

Fine. Thanks. 6 months is good enough for her. She won't be staying there for more than 5 months. She will go, come back and reapply. Can I still buy a house there for her when she has a B1/B2 visa? I don't want to pay rent or hotel bills. I have houses in Nigeria, Dubai and UK. Anytime a family member travels, to any of these places on holiday, they stay at my place. It saves a whole lot of cost.

We will be married here in the US by December when he visits, and by January I will ask him to return back to Nigeria so as not to abuse his b1b2 visa while I file for him outrightly, but I just hope once I file for him, the petition will not be abandoned due to the fact that he returned back to Nigeria. I don't wish my husband -to-be gets stranded there in Nigeria after his return, and I will never go to Nigeria for any reason.

But to answer your question, port of entry refers to the airport, seaport, or land border crossing where you enter the United States. Either way, the answer is "Yes," you have been refused a U.S. visa.

If your husband has a valid B1/B2 visa he can use it to travel and visit you. A petition is not abandoned until you fail to respond to USCIS after they have made efforts to contact you for over a year. Your husband should be in Nigeria while the petition is being processed, so this does not constitute abandonment.

Please I have a question.....
I am a 38 years old pastor, I married a Nigerian Lady in 2009 here in Nigeria and we had 3 kids ( ages 7,5,3 )
About 2 years ago, we all applied for a B1B2 visa as a family and we were all granted the visas, and we all travelled as a family to the US that year, spent just 2 weeks after we returned back home.
Unfortunately, after our return to Nigeria, I had a little misunderstanding with my wife over a small issue, she got angry and angrily travelled to the US with my 3 kids without my consent. I expected my wife and kids to return but they did not, and she did not even contact me. I tried to get her on Facebook, she told me that I should forget about her, that she and her kids are in the US now for another life that she is not returning back home. What I used to know is that she had a b1b2 visa with my kids which they all used to travel to the US but I was surprised when she told me that she and my kids have moved on with their life in the US.
By now, their visas will have expired and they are still in the US. I mailed the US embassy about it several times but I got no reply
My question is how possible is it for my wife and kids to be in the US till now ( over a year now ) still on visit visa ? Or could she have adjusted her status in the US with my kids? Could she have filed a divorce in the US without my awareness?
Since she has decided not to return to me here, I have decided to file a dicource to enable me remarry..
Loneliness has been affecting my health, i have developed chronic insomnia and Hypertension.
Could she have adjusted her status to a LPR

If your wife is in the U.S. on a B1/B2 visa, she is there illegally.

It is unlikely that someone under these circumstances would be able to adjust status and that is usually a process that takes a long period of time. I can't really comment on her ability to divorce you without your knowledge since each state in the U.S. has different laws.

My wife is presently in Nigeria and she is planning to return back to the state by next month and file I-130 petition for me. My worried here now is that she has only stayed 2yrs not up to 3yrs in the state and her status is LPR by DV2.

However, if possible she was ask to submit her Copy of Tax Transcript for the past 3yrs when she had only stayed 2yrs plus in the state, please kindly advice on what to do and will you advice we just wait for her 3yrs stay to be up so that she can be able to make available her 3yrs Copy of Tax Transcript on request?

Secondly, she is carrying our baby and by God grace she is likely to deliver within the first quarter next year, can I apply for B1/B2 visa to go see her and our baby before or after she put to bed while I-130 petition is in progress?

Any advice, experience will be greatly appreciated.

Thank you very much. Pls if I happen to know where she resides in the US, will I find it easy to pass through the POE on my B1B2 visa without having issues with them ? I mean if they ask me questions about my wife at the poe and I am not able to answer correctly, like what is she doing in the US, etc.... These I can't answer as my wife has refused to tell me what she's doing there, but jus for the sake of seeing the kids is the reason for going basically. Won't I have issues at the poe if I can't answer such questions, and I claim I want to go and see her ?

Hello LagosNIV, please help me with this one more question. I'm currently processing my wife's F2A visa and a copy of my wife's POLICE REPORT is part of the documents I'm requested to send to NVC. But the question is that the Nigeria police report expires after 90days. Does she still present the original expired police report during her interview because I believe her interview may not fall within 90days? Or do I not send it to NVC now until her interview date is close by? I'm confused about this please.

If she has only been in the U.S. for two year then she can only provide two years of tax document - the VOs understand this and you can explain during your interview if for any reason it is unclear to them.

Also, you can apply for the B1/B2 but there is no guarantee that it will be granted.

If she is complying with all applicable laws, she can visit. She cannot remain in the U.S. for more than 6 months on a B1/B2 visa.

It will likely take many months before the application clears through NVC and your wife is scheduled for an appointment. She will need a new police report at the time of the interview.

I don't know the answer to that - the petition has to be cleared and approved by USCIS - a different agency - before we can conduct interviews.

You should follow the detailed instructions that you have been provided. They do not require you to bring a printed copy of your DS-260.

Recently a family in Alabama has invited me to live with them. I am hoping to start making preparations for my move next year.
