My brother's fiancee in the U.S. filed a K1 fiance visa for him sometime in August. The case will expire in February. We just noticed awhile ago that his name was wrongly arranged in his passport, so he went to Abuja to get the problem fixed. On getting to Abuja he was told the new passport will be ready sometime in January and we don’t have much time since his case will expire in February. He's yet to fill his application online and get an interview date as a result of this findings. Please V.O. what do you advise?

Please my interview was a great success now it's been ten days and have not received any mails or sms please can I go to the dhl for pick up because have called DHL severally and there's no response pls can I go to the address because I wish I can celebrate my birthday with my husband this Saturday thank you

I hope U guys are are having a wonderful festive season?
My sister who is the first child of my parents filed for me and it's almost at the interview stage. I just realised some errors in the DS260 filled by the Lawyer handling the case from the beginning who happens to be my brother too and a US Citizen who practices in the US.

My Questions are thus;

1. If minor errors like city of birth, other name used are made because in my international passport, I have 2 names with my Last name but it was only my first name that was filled in the submitted DS260 leaving my middle name. So do I have to fill another DS260 or I should call the attention of the Consular to it during my interview?

2. My wife was denied student visa in 2014 but on the part where a question on have U been denied US visa was asked in the DS260 filled for my wife, the lawyer mistaken indicated "NO" though he didn't know of the denial. To have it corrected, do we have to fill another DS 260 or We should alert the Consular during the interview?

No aos,cos,eos was put on my passport with a two weeks stay it was my first time to the us the CBP officers delayed me for hours made me sign a consent form form drugs testing which they didn't do to cut the long story short it was a horrible experience I left on the exact date my holiday ended I didn't over stay my question is if I decide to visit again will I have to go through the same horrifying experience and what are the effects of the annotation on my next visit which is in a year or more than a year's time and lastly I have plans to visit Japan and the uk soon on an official trip from the office. will the annotation bar me from getting the visas to UK and japan?

The annotation is not a bar or ineligibility. It means that you were strongly suspected of immigrant intent, but not enough that they would deny you entry. If you tried to adjust status while in the U.S., you would be denied.

Keep in mind that I am a U.S. visa officer. If you want answers from the UK or Japan, you might want to consider asking the UK or Japan.

I cannot say what will happen during your interview. Your best course of action is to document a reasonable explanation as to why these discrepancies exist and be prepared for questions.

Regarding your wife, as always, it is in her interest to be truthful.

They were right to get the passport corrected. With a reasonable explanation for the delay, your case can be extended by the consular officer for four additional months at the time of the interview.

Is there a way you can find out when it is likely to be called for interview.

The case is a Family Fourth Preference (F4).

I will appreciate if you accept that i sent the info to you so you can check because we really need them to be here by febuary.

They have met their priority date and they have recieved their 60 days noticed for interview since august but no interview date yet from the embassy

You should check with USCIS (the agency that accepted the original petition) as they schedule most appointments.

Hello VO,

I applied for a B1/B2 visa and went for the interview but was denied. When I applied for the visa, I had a baby and so we applied as a family( me, hubby and baby), baby fell ill and so we missed out first appointment. We re applied afterwards again as a family but we lost our baby few weeks to the interview. During the interview,I was asked if i have a child, I answered I had one but lost her a few weeks ago. That was the point we were given the blue letter staying we weren't eligible.
I am gainfully employed and my husband too. We had our account statement and even came with baby's death certificate just to prove we were telling the truth. It wasn't fair denying us even when we weren't given the opportunity to prove anything.

I f we apply again, and fill no issues, hope this wouldn't seem like we lied the last time. How soon can we re apply.

This is a question for USCIS (the agency that accepted your original petition). Try asking there.

VO, Please, I have an approved I-140 Petition for EB2 visa. I am the petitioner and principal Beneficiary. Furthermore, NVC completed review of my documents an am waiting to be scheduled for and Interview at the US Consulate overseas. Currently I have an F1 visa on my passport obtained in June this year that will expire in 2018 as I am undergoing a Part time distance learning doctorate degree program in USA that have some residency portion. I plan to complete my degree in 2018.
sometimes last year I travelled with my wife and child to the USA on vacation and I enrolled my child in public middle school , while I came back to Nigeria. Then I never knew it was wrong to enroll my child on public school on B1/B2 visa. But when I wanted to visit my family two month later in the US , I was refused entry at POE. My B1/B2 Visa was cancelled without prejudice and was informed that I should not have enrolled my child in public school on B1/B2 Visa. Since I had a return ticket, I was returned back to my home country and found to be inadmissible.
In June this year, when I needed to Go to my school in the USA for my Doctoral residency, I applied for an F1 Visa which was approved after series of questions relating to the incidence I mentioned above.and I was able to travel to the USA for the residency program and returned after the program. I stayed for eight days and had no problem at POE. Moreover, at the visa interview for the F1 visa, I told the CO that I was very sorry and that if I had known it was wrong I would not have done it , moreover, when it was brought to my attention, and was refused entry at the POE, I made arrangements and withdraw my child from the school and returned him back to my home country , .
My question now, is when I am finally scheduled for my immigrant visa interview, since my child is also a beneficiary of my I-140 petition, I also plan to tell the truth of what happened, if I am asked questions relating this incidence. Are there other things I need to do to ensure approval of the immigrant visa for myself and that of my son? Any advice will be appreciated.

You should be prepared to answer these questions honestly and without too much prompting. Like most things, covering up the issue is often worse than the issue itself.

Good day

I am an F1 applicant. My ds160 was filled by me and i was refused visa in my first interview .i was not experienced and made an ommision on my educational background I hold a diploma in civil engineering and also did a 2year course in desktop publishing and computer operation. I filled a new ds160 and included my educational background.. After which i was approved at the interview and given a white collection paper and told to pick my passport in the next 3 working days.on tracking my visa status online... I saw refused and was told to check the paper i was given at the interview...im confused right now... What has gone wrong? It's day 3 after my interview ...no news ..

Well, you were allowed to enter the U.S. and then you returned to Nigeria. That's better than a lot of people. Keep up a good history of travel and you will be rewarded with more trust by the authorities.

Thanks I have cwop written on my DV visa, even thougH it expired around Sept 2012 but I came into the country b4 it expired. The cwop was written there this last July I went to Nigeria. I was thinking maybe because it an expired visa or could it be because the immigration form they gave me in plane I wrongly put NO when asked if i have MEAT In the qestionnaire. I told the immigration officer YES and It was when I got home I saw cwop but didn't know the reason it was written there .
I am a permanent resident though and i have green card but I want to know if I am OK to travel with it.

The company messaged me today that my application has been successful and I am scheduled for an interview with the company. I need to send them an email now, what should my email look like? Is it that I should tell them they should send a letter to the embassy here in Nigeria requesting me for an interview. Please I need your help. Thanks

The short answer is that the baby will need to have either a U.S. passport or an immigrant visa to travel to the U.S.

The long answer is it depends; the question is more complicated than it seems. If you, the petitioner, are a U.S. citizen and meet certain requirements, the baby may already be a U.S. citizen. In this case, instead of a visa, the baby will be issued a Consular Report of Birth Abroad (CRBA) and a U.S. passport. By law, we cannot issue a visa to a U.S. citizen. Contact LagosACS@state.gov.

If you are a legal permanent resident (LPR), we can add the baby to the original petition. Contact us at LagosIV@state.gov for further instructions and scheduling. Be aware that all immigrant visa applicants must come to the Consulate for an in-person interview. The baby should have a valid passport and a medical report. Your wife should also provide evidence of the relationship between herself and the baby. This includes a birth certificate, hospital records, photographs, and anything else you can think that can show that the baby is in fact hers. If she fails to provide sufficient evidence, the consular officer might suggest a DNA test as a last resort.

Please do not forward us any correspondence. USCIS is the agency responsible for processing your application and we, the Department of State, only get involved when the petition's been approved and arrives here at Post. You are, of course, welcome to query us about the petition once received. Until then, USCIS is your contact.

On your request for guidance on what the email should look like, that is a question for another forum.

If you already have your green card (I-551) then you do not need a visa. The visa allows you entry into the United States to begin processing your residency. It was likely CWOP'd because you are now a resident and not because of the meat.

Be sure you travel with your green card and ensure that it is still valid. We see far too many people who need emergency boarding foils (Form I-131A, Application for Travel Document (Carrier Documentation)) to return to the U.S. because of problems with their green cards - mainly because they traveled without a valid one. If this is the case, you will almost certainly have a delay in returning to the U.S. at great cost to you, in addition to the $360 (as of December 2016) for the boarding foil itself.

Dear vo,pls around 1997 I was denied an immigration visa to the US,in 2014 there about a friend introduced me to a travel agent who told me he had an associate in US embassy who assist him in procuring visa for his clients with some certain amount of money which I provided for him, he gave me different personal information which I used on my international passport, name,date of birth different from my original information which I used in my first interview,at the end I was denied again, but I wasn't given reason for my visa refusal unlike my initial attempt,now of recent my situation have change I've visited other country with my original information on my international passport which was the one I used at my first interview at the US embassy, now am willing to apply for US visa with my original information, I seek your advice in a case as this how can I go about it to clear myself from the inconsistent the travel agent have caused me,am deeply confused and disturbed looking at how carelessly I've given in to a fraudulent travel agent and the possible consequences I have to bear.thanks

Good day VO, I want to apply for immigrant visa soon i am 24years old and i am dating an American citizen who is holder than me she is 48years old we been dating up to a year now and communicate almost everyday she came to Nigeria in June and spend 2 weeks with me and things was fine with us so my question is 1. will the age difference be a problem with my Visa been approved and 2. which one is better should we file for spouse visa or fiancee visa and 3. can you give us the steps
