The bank is not liable for confidential information shared by customers to a third party. It doesn't matter whether the customer thinks the third party is the bank. They say it everytime and it's simple enough.

This is a matter for the police.

Going by your logic, I can collude with someone to "defraud" me, then I go to my bank and create a scene, then my bank will give me half of the money because they have insurance. I thought this government was meant to be fighting corruption.
Jesus!!!

That was a sarcastic question.

What I simply meant was the bank is not supposed to give her any money. Prolly invite the EFCC to investigate...and answer a few questions but that's about it.

DB can spin this around positively by paying the woman, even if they know they are not at fault. Such gesture will be applauded by the public, and win DB many customers. How much is N500k after all, to a bank that makes billions? They should put on their thinking cap.

I just realized from peoples' comments that most folks in here are terrible. Where will the bank get the money to refund Mama from?.

This cut across banks currently in Nigeria. People short chain themselves from happenings in the society and look for who will take a bullet for their idiocy. I had heard of this incidence trice within the few times i had visited banking halls of 2 distinct banks this year.

False. If they try it, I'll go and claim my 25M was taken. I can also help them get applause from the public.

They are not liable to begin with. I doubt if the manager is authorized to cushion the effect of her ignorance and also I think it is foolish to encourage banks to give money either in part of in whole. It is business not a charity and they have to do that for a very long lousy of people. It is an unfortunate case, they can only wish her the best.

Don't mind the drunk illiterate.

I knew the bank will come up with a very well orchestrated denial story and wont accept liability in any way, if Diamondbank is a responsible bank that cares about customers, the right thing to do is give mama at least half of the money while they investigate and try to recover the money. What if that money is the only hope for that old woman, do you expect her to die of hunger while they keep speaking big big grammar? angry

Ps-All you professors in Liability assessment mentioning me, if the old woman was hypertensive and died of stroke right there in the bank premises and the news got out like "Diamondbank customer dies in bank after account was emptied" we will know how denying liability will help their growth angry

Why would you use ‘orchestrated' and ‘deny liability' if you know that they are not the fault to begin with.

I am sure the organisation can come up with lots of exceptional cases they have experienced. Besides, the banking industry is a sensitive one, the bank manager cannot dish out money because of ‘exceptional cases'. I am certain that feel really bad for what happened even though it is not their fault but you shouldn't go about writing as if it was their fault to begin with.

This hasn't ruined the bank for me because I know why. You are misinforming others and that is not nicesad

Do you know what that will have done to the image of the bank? angry

It is truly unfortunate. I can't begin to imagine what she is going through but it doesn't mean we should become entitled. They can choose to do whatever they want to do.

A pensioner, Mrs Comfort Ashaye was allegedly chased away by Diamond Bank manager in Ikeji, Lagos after she went to lay complaint of her accumulated pension of N572k which disappeared from her account

President/Founder of Consumer Advocacy Foundation of Nigeria CAFON, Sola Salako Ajulo shared the story yesterday seeking investigation and refund for the woman.

We have now obtained the alleged true story of what really happened. Read the report from a Diamond Bank staff below…

Our customer (comfort Ashaye) came to the branch sometime in march this year to transact and was told she had insufficient bal of N2 on her account..she expressed confusion and pain. The branch mgr took her into her office to comfort her and get better clarity on her account status. Upon further probe, it was discovered numerous mobile app withdrawals from her acct in excess of N500k. She was.asked if she had permitted/authorized any transaction by any means. She said no but informed of a certain male that called her asking for her BVN details. She also informed she hardly used her phone as its always under her pillow at home. Though she had the phone with her that fateful day and she showed the branch manager and DB staff the no that called her, which was a privately owned no (080). Further investigations led the DB staff to call the no which was answered but the guy also hung up as quickly as he picked it. Mamas phone also showed evidence of a 4 digit code- her mobile app pin in her sent msgs to this same unknown no. She claimed that she lived alone and all her kids lived elsewhere. However, DB promised to investigate further to assist urgently. Her subsequent visit after the easter break was with her son who came and he caused a scene witnessed by customers at the banking hall. He rained abuses, threats, causes and even called DB fraudulent. The bank security team came Into.the hall due to.this and with the DB staff tried to calm him and mama also joined to plead on his behalf. The DB branch team confirmed to mama that the matter had been escalated to the fraud unit in the bank and the unit had identified one od the fraudulent withdrawals to an account at fidelity bank and they were contacted to block the acct.although the funds had been moved since and the account owners unreachable. Following that feedback to mama ashaye, the branch was visited by an investigative journalist, who wanted our side of the story before going public. As per their policy, he was asked to get the customers introductory letter as the customers information was private. however he was informed of what transpired at mama’s initial visit and the fact that she was. called by an unknown person and her pin sent to.the same number. The journalist expressed surprise as these details were unknown to him and he reiterated that he could use same number to track the criminals as he had successfully done in the past. He collected the branch manager details and promised to come back to the bank within 2 weeks, but was not heard from him again. The investigation was also concluded and customer was fully briefed of their negligence and the bank was not liable but she maintained that she won’t take that, accusing that there must be an insider. This matter was since concluded in April after the son’s threat to deal with the bank.

One of the major reasons anyone keeps their money in the bank is for 'safety' and this means no one else should be able to access the money, the fact that another person (a fraudster) was able to empty mama's accout whether due to her negligence or not means means the bank has also failed in its duty of keeping mama's money safe. I am almost certain the only reason the bank even released a statement is because the news went viral if not they will have kept turning the old woman in the circle of 'investigation' and big grammar till Only God knows when...... I remember when i was debited for a failed transaction, it took months for me to get my money back for an action that wasn't my fault, imagine if i had a medical emergency and that money was needed to save my life? This woman is an old woman that has retired, imagine if she didn't have any kids and that money was her only hope, all i am saying is the responsible thing for them to do is to look for a way to cushion the effect of the situation because whether they like it or not, both parties are at fault.......

The fraudster was able to to empty Mama's account because of her ignorance and not the bank's. Don't try to spin any tale please. I am very familiar with the situation of pensioners in Nigeria. I can very well imagine what she is going through.

They have NO moral, financial or legal responsibilility to cushion the effect at all. They were not a party to the communication, don't put this on them However you could say they could give her some money in as a gesture of goodwill.

Failed transaction is a different scenario entirely. Don't bring that into this.

I don't know how some people reason? Why are you blaming the old woman?
If you have had issues with Nigeria banks especially if you are nobody then you won't blame the old woman child? Nigeria Banks aid fraud.

Those fraudsters are very professional, you would believe there are actually calling from your bank. They have called me thrice, thank God I know there tactics and of course, I'm well informed.
The old woman fall victim because she wasn't well educated in regards to the new fraudulent trend happening this days.
This is an eye opener to educate our Old Man and Old Woman.

fidelity bank is now bank of criminals, they use their bank for all sorts of fraud. i think fidelity is also protecting its criminals customers.
I had a dealing with a dude banking with them, he turned out to be a fraudster, i filed a police report, the account was flagged, i initiated another transaction with him so as to get him, he gave me a different account number of the same fidelity bank. i later realized he was using multiple accounts with same fidelity, yet the bank keeps mute. ole bank.

Cheap emotional blackmail will not help your growth either.
As unfortunate as it is, the old woman was negligent in giving out her BVN,PIN etc and is totally at fault for divulging her secret bank account information to ANYBODY let alone a stranger OVER THE PHONE.
Haba
Wrong is wrong and the woman is wrong
PS If any so called " son of mama" is stupid enough to go to the bank and make a scene,he should be promptly arrested and prosecuted.
What arrant nonsense,if he cared so much about his mama, then he would have found a way to be there for the woman so this incident wouldn't happen in the first place

Okay. If that is truly the case, then you have a very strong point there and there is ground for lawsuits.

People are warned daily never to give put bank details but some have chosen to remain ignorant. The children were also foolish because they didn't caution their mother about these kind of fraudulent activities.
My question is didn't she get alerts after the withdrawals. She also waited a long time before notifying the bank. Let them(her and her children bear the loss. It payment for their foolishness and carelessness.
