Am not a lawyer.

However from experience, this is how it works.

The man was tried for a criminal offence and found guilty. The owner of the money can now go ahead and file a case against him to recover the money. Such cases are usually open and close cases because of the earlier conviction for the crime. If the person can't pay, he court can give other to carry his properties.

If the owner don't institute another case to recover his money, nothing for him. Criminal cases are undertaken to punish only, not to restore injured party to his property.

Lawyers should quote me so i can know if am right or not

I have a friend who owns a betting shop and his staff did exactly what you did and he arrested the offending staff.
What you did is setting your employer's business back.
Its a case of defrauding your employer and you got jailed for it. Case closed.
He can go still back to court to ask for his money to be recovered, you are not fully out of the debacle sad

And you think the money could not have been stolen from him?

Don't know...but would think that's the end of the case since that's how they usually end.....guilty/not guilty...if guilty fine/imprisonment or both. But how much more did you need to pay back if the fine was 10K? Why would you choose to go to prison instead of paying the fine?...is prison conditions now luxurious? Hope you learn not to spend money that don't belong to you.
I didnt spend the money. I didnt know how the money got missing from the system. Ask anybody that work as a cashier with bet9ja on how shortage come about.

All of you guys saying he should not pay are mad. Would you be happy if someone misappopriated 132k out of probably less than 500k business? That is the problem with our judiciary system, they should have simply told him to refund the money by serving him or through other means instead of one useless jail of 10k option.

Op, dont put yourself in a serious trouble you wont be able to get out of. An employer that get time to take you to court because of 132k can do anything to retrieve his money if you refuse to comply with his term or pay him off.

For the owner to recover his money, he need to institute a civil case to recover the money, the conviction from the criminal case will help him. You are not seeing it that the money may have been stolen from him?

Being a criminal case, the options opened to your boss was to either settle out of court while u pay the debt as agreed or proceed with the charge (which was what he choose to do). Thus, proceeding with the charge impliedly means he has nullified the earlier agreement.

As an ex-convict, u have served ur term by paying the fine ordered by the court. It is wrong for anyone to harass you again for the money u earlier "stole" or negligently misplaced.

You are ending free man now bro.

Yes but you know how far some people can go when talking about money. Besides, the money was stolen under his care/custody, so he has no excuse whatsover.

Note: not that i"m heartless or not pity him, i just hate careless employees since i lost a large sum of money due to their carelessness.

I explained to my manager which he later-on called the owner of the shop on phone and i was arrested after receiving slaps from him.

At the police station i paid #30,000 and was taken to court 4 days later and the judge keep postponing the case until last month when the prosecutor asked that we settle the case amicably and out-of-court. We agreed that i will resume back to work and he will be deducting his money from my salary until its complete.

On getting to court to present the agreement maf I was jailed 6 months or #10,000 fine. I spent 21 days in prison without my family knowing my whereabout.

But bros, you claimed to be in jail fr 21 days last month, yet your Nairaland account was active during same period, you even posted some jokes within that time, is it that we now have active wifi in Nigeria prisons? This prison story you are joking with....there is God o

The lawyer was my lecturer in school during my National Diploma days. He was surprised to see me in court and asked what happened and i explained to him. He actually offered free service to me without collecting a dime.

Stay away from that environment, let the case die down.

Thats a kangaroo trial. That trial and judgment was planned and executed.

If the court can advocate for amicable settlement, why did it turn to send you to jail?
The court can get a lawyer for you if you dont have. Whenever you are in a dire situation like this, ask for the leave of the court for you to get a lawyer to defend your case. Some lawyers present at the court will defend you when you ask for their assistance. The absence of a lawyer defending you made your case worse. Dont pay him if the court verdict does not touch on it.

There are a lot human rights issues in your case if you can find a good lawyer to defend your case. It is a civil case and did you pay the police N30,000 as bail or pay part of the debt? There is no law that empowers the police to act as a debt collection agency.

Having been convicted, you cannot be tried for the criminal aspect of the situation to wit fraud. However you are still liable to your employer for the money. He can sue you to recover the money from you.
