The Chief of Defense Staff is appointed by the President and reports directly to the Minister of Defense. He is nothing more than an errand boy for the President and the Minister of Defense.



And those other ones are appointed by the governors. If you don't understand something, can you just do a little research. They talked about service chiefs and here you are mentioning the NSA, Minister of Defense. Are those service chiefs

Someone who has accused people falsely of using alternate accounts to like posts is here doing the same thing he accused others of. He boasted of being so religious about the Nairaland rules which made him 'unbanable' but here he is breaking one of the major rules and going in the path that got him banned in the first place.

I guess his life starts and ends on Nairaland.

Not really, I experience the same on my phone. Especially when on 4G and phone temperature is slightly higher.

There was a day that the external temperature was very high that my phone was so hot that my charging speeds dropped to 190mA

Well I don't know much about these things but I've been using and charging my phone at the same time for 3 years now and I always check the speed while charging. It has never gone below 700mA except the cable is bad.

...Election Petitions are *suis generis*, meaning that they are unique, have a life of their own, have special character and are governed by procedures peculiar to it.

It is a time conscious trial.

Under the 1999 Constitution as amended and the extant Electoral Act, 2010 as amended, the chances of the Supreme Court overruling itself in an Election Petition it has conclusively
*decided and disposed of* and in the particular case of Imo State is nil and non-existent.

We make this strong statement because among other things-

(a) there is no statutory provision for it, and

(b) the lapse of the almighty sixty days constitutional timeline within which the Supreme Court must hear and dispose of Election Petition appeals from the date of delivery of the judgement of the Court of Appeal has foreclosed any such novel window.

It is instructive that the Court of Appeal sitting in Abuja handed its judgement in the Imo Governorship Election Petition Appeals on 19 November 2019.

The Supreme Court in turn disposed the appeal on 14 January 2020.

Going by computation of time therefore, embarking on a street protest on 19 January 2020 and orally asking the Supreme Court to overrule itself is plain mischief calculated to embarrass and denigrate the integrity of the eminent Law Lords.

The sixty days timeline for disposing election petition appeals is a constitutional provision and a non-negotiable part of our electoral laws that must be rigidly obeyed as it is said to stand firm and unmoveable like the *Rock of Gibraltar.*


Even as the Oracle of the law, the Supreme Court is not entitled to rewrite, amend, add or subtract from constitutional provisions.

They must give effect to constitutional provisions however harsh or unsavoury the result may be.

That is what the Supreme Court held in its 2012 decision in the controversial Imo Governorship Election Petitition *PDP V GOVERNOR OKOROCHA & 10 OTHERS* in Suit No. SC/17/2012 delivered on 2nd March 2012.


It is important to further enlighten that the old case of *ADEGOKE MOTORS LTD V ADESANYA* (1989) 13 NWLR (Pt. 109) being bandied around here and there and cited as authority for the Supreme Court to overrule itself is inapplicable in the 2019 Imo Election Petition matter or any Election Petition matter.

This is because the said ADEGOKE CASE (Supra) is not an election petition matter.
It was a 1989 decision that did not have the contemplation of the mandatory requirement for conclusion of election petition appeals in the Supreme Court within 60 days as provided for in the present 1999 Constitition of Nigeria as amended
.


It remains to be said that in sync with their constitutional powers and relying on clear constitutional provisions and our electoral laws, the Supreme Court has disposed of the 2019 Imo Governorship appeals and can never revisit it.

This is again supported by the decision of the Supreme Court in an Election Petition case *PDP V GOVERNOR OKOROCHA & 10 OTHERS in Suit No. SC/17/2012 delivered on 2nd March 2012,* where Odili, JSC, held in a most profound manner and characteristic candour as follows-

*"...What is to be disposed has in a way hit the rock and can go nowhere else. That is to say the legal dispute or process has reached its final destination and is at grand finale...."*


We can then conveniently restate that when the Supreme Court finally disposes of an election petition, the legal dispute has come to a full and final stop at the last legal and judicial bus stop because of the special nature of election petitions and its time sensitive nature.

It is in public interest that there should be an end to litigation-

*Interest rei publicae ut sit finis litium* which is an alternative Latin phrase for *expedit rei publicae ut.*

Remember always that the Supreme is final but not infallible.

A new normal is possible!

Chairman of Peoples Democratic Party (PDP) in Imo State Charles Ezekwem has defected to All Progressives Congress (APC).

In a letter of January 25, Ezekwem said his decision to abandon PDP followed approval by his supporters and circumstances facing his party.


The letter reads: “In view of the prevailing circumstances within my party, vis-a-vis my present standing as chairman of PDP in Imo State, and after due consultations with my family and with the approval of my supporters, I tender my resignation as chairman and member of the party in my Okigwe ward.

“I thank the people who elected me as their chairman. I sincerely regret the inconveniences the party faced. I thank the party for the support they gave me and the opportunity to serve in that capacity.”

An official of APC described Ezekwem as a big catch.

He said: “We’ve shifted the celebration of Ezekwem’s defection to a later date because of the tragic death of one of us, Ndubuisi Emenike. But I can assure you Governor Hope Uzodinma will officially welcome Ezekwem into the party in a large ceremony.”

He added that a former senator on PDP platform would soon join APC to give credence to the fact the Imo is an APC state.

Ezekwem’s resignation follows the defection of PDP’s Deputy National Auditor Regis Uwakwe to APC following Uzodinma’s victory at the Supreme Court.

Nine Assembly members defected to APC. Four left Action Alliance (AA); two from All Progressives Grand Alliance (APGA) and three from PDP.

PDP has accepted Ezekwe’s resignation. A statement by Publicity Secretary Damian Oparah reads: “The attention of Peoples Democratic Party in Imo State has been drawn to the resignation of the Chairman, Charles Ezekwem.

“The party accepts the resignation, and notes that this is a trying time for the party and its members. We thank Ezekwem for his selfless services to the party.

“We wish Ezekwem well in his future political endeavours, and assure him that if he needs to return our umbrella will still be big enough to accommodate him.”

let me brief you with history

in 2006/2007 Andy Ubah won at supreme Court against Peter Obi as governor but Peter Obi seek review and capitalized on some flaws in the judgment and the judgment was overturned to his favor
not only that he reclaimed his mandate
he made the supreme court ban any election in Anambra State till his first term completes
that was what brought about change in election time table in Anambra.
though i doubt if this sick illiterate sharia judge will allow justice to prevail but the verdict that gave Uzodinma the seat is filled with self indicted flaws that will so damage the reputation of the judiciary in the future because SANs will be making reference to the flawed judgment in the future.

all Ihedioha needs to do is to hire some competent lawyers not those tozos he worked with.
he really gat a strong case only if Supreme Court will allow justice to prevail.

The Supreme Court did not overturn its own judgment in that case. It was Peter Obi that won at the Supreme Court and Uba approached the Supreme Court for a review but his case was thrown out with the Supreme Court maintaining that its earlier judgement on the case stands.

If you don't have any valid ID card then you can do an affidavit. Just a local government office near you. There are guys doing it there. Explain what you want to them and they will do it for you for about 500 naira.

For those of arguing blindly, get the meaning of the term 'duplicate original' first.

"Duplicate original means an exact copy with signatures created by the same impression as the original, or an exact copy bearing an original signature, or in the case of an electronic transaction, an electronic version with electronic signatures."

What else do you want the Appellant to prove again.

It was not a lifetime blunder when Akabueze was commissioner in Lagos. This is the same Kabiru Ahmed who has served in various capacities in Lagos since 2001. He was first appointed by Tinubu as chairman of LASPEMA in 2001. If no blunder has come out that since then I wondee how it's going to be a blunder. Please tell us something else
