Dr. Iyabo Obasanjo-Bello, daughter of former president Olusegun Obasanjo and senator representing Ogun senatorial district, has been named in a controversy surrounding N3.5billion contracts in the power sector.

In a matter which has gone before the International Court of Arbitration in Paris, France, her business partner, M. Schneider, an Austrian company, has petitioned the Presidency and the Economic and Financial Crimes Commission (EFCC) over what it called the “fraudulent, corrupt and criminal nature involving Senator (Mrs) Iyabo Obasanjo-Bello (alias Mrs Damilola Akinlawon), then serving as a Commissioner with the Ogun State Government”.

The Austrian company alleged that Iyabo Obasanjo “fraudulently” presented herself as Mrs Damilola Akinlawon while entering into contractual agreement with it to float a company which put in bids for contracts in the power projects embarked upon by the government headed by her father.

In the petition dated 30th August 2007 and copied to other anti-corruption agencies like the ICPC, Code of Conduct Bureau and Chairman of the Senate Committee on Ethics, M. Schneider of Austria alleged that Iyabo concealed her identity and presented herself as Mrs Damilola Akinlawon with the “sole consideration of shielding her father, former President of Nigeria, from being perceived as having breached relevant laws in the award of power projects indirectly to her daughter”.

The company pleaded with the anti-corruption agencies to investigate the case with a view to ascertaining whether Nigeria’s laws were broken by Iyabo “acting either for herself or on behalf of the then President”.

Many letters exchanged between the parties indicated that the business which has pitched its promoters against each other was packaged by an acquaintance of the Obasanjo family, Prince Albert Awofisayo, who is also chairman of Vamed Engineering Ltd which got contracts to refurbish 17 teaching hospitals in the country for N27billion.

The involvement of Iyabo in the power project was said to have been at the instance of Awofisayo who in several correspondences with M. Schneider of Austria allegedly insisted that the involvement of Obasanjo-Bello was the guarantee that the company would secure the power project contract.
Awofisayo had entered into negotiation with M. Schneider of Austria to set up a Nigerian company named M. Schneider Energy (Nig) (MSEN) Ltd as a special purpose company to secure power project contracts in Nigeria.

In an e-mail message to Mag Andreas Altenhuber, Managing Director of M. Schneider of Austria, dated June 1st, 2006 and presented as exhibit in the petition to the EFCC by the Austrian company, Awofisayo had explained that “the reason for inviting Akiya [a company owned by Iyabo Obasanjo-Bello and one of her siblings, Busola] was the strategic role Akiya could play in M. Schneider Nigeria’s affairs in seeking for projects and facilitating Government’s approval”.

For this strategic role, Akiya was given 10 per cent equity in the company at incorporation. Akiya was also to collect a 10 per cent commission on any contract secured for M. Schneider (Nig) Ltd.

M. Schneider Nigeria eventually won two of the bids for power projects while it was on the line to win another two before disagreement among its shareholders put spanners in the works.

The company was awarded the contracts relating to Substations in Benin North and Line Bay at Obudu respectively at values totalling over 15 million euros in offshore cost and over N762 million in local cost.

The breakdown of the contracts is: Lots 19-2-Offshore Price, 13,595,940.31 euros and local price of N569,440,123.00. The second contract, Lot 20-2 has a price of offshore 2,077,416.34 euros and local price of N193,535,970.00, bringing the total value to 15,673,356.60 euros and N762,976,093.00.
However, a disagreement over money sharing and control of the company soon set in and the parties to the business deal soon landed themselves in court.

The contracts were eventually cancelled.

The partners are now trading blames on who was responsible for the cancellation. The Nigerian partners blame it on the intransigence of the Austrian company and are demanding compensation through the Arbitration panel. The Austrian company on the other hand is blaming it on the decision of the Nigerian partners to register another company, Translational Energy Nig Ltd which they had hoped would execute the contract to the exclusion of the Austrian company.

The Austrian company is now claiming compensation for loss of the contract.

Awofisayo approached the International Arbitration Panel in France to get reprieve. Akiya (Nig) owned by Obasanjo-Bello and one of her siblings, Busola also approached the Arbitrators to make similar claims.

In his Request for Arbitration before the International Court of Arbitration, Otunba Awofisayo, to justify his request for a refund of the money which he claimed to have spent to facilitate the contracts, admitted that MSEN did not possess the requisite experience or record of performance to secure the contracts.

“The claimant expended a lot of money on building a very strong profile and goodwill for the new company in Nigeria since the company, MSEN, was unknown in Nigeria and had never undertaken any power transmission in Nigeria and had never undertaken any power transmission and Substation projects in Nigeria or possessed any track record of performance of such projects anywhere in the world,” he said.

M. Schneider of Austria objected to these demands of Awofisayo and Obasanjo-Bello on the ground that all the agreements signed by the parties in the deal were null and void. Schneider contends that the agreements are not valid because Awofisayo who invited Obasanjo-Bello into the deal conspired with her (Iyabo Obasanjo-Bello) to hide her true identity while claiming to be Mrs Damilola Akinlawon.

The company provided several evidence to prove that the woman who signed agreements with them purporting to be Mrs Damilola Akinlawon was actually Obasanjo-Bello. These include an application by Otunba Awofisayo to the Austrian Embassy in Nigeria for Schengen Visa for Obasanjo-Bello and Busola Obasanjo. The Austrian company argued that it was this visa that Iyabo Obasanjo utilised to visit Austria to sign contract papers with it in December 2005.
The company also attached records of Renaissance Penta Vienna Hotel with the names of Obasanjo-Bello and Mr Richard Awofisayo as evidence that the person who signed contract papers with them was actually Iyabo Obasanjo-Bello and not Damilola Akinlawon.

In the record, Obasanjo-Bello was recorded as staying in the hotel between 14 and 18 December 2005. Mr Awofisayo stayed in the hotel between 12 -18 December 2005. Also, the Austrian company attached eight photographs of the agreement signing ceremony between Nigerian promoters of the company and M.Schneider of Austria in December 2005 featuring Obasanjo-Bello dressed in a cream jacket.

M. Schneider attached a Certified True Copy of the Memorandum and Articles of Association of Akiya Nigeria Limited in which only Obasanjo-Bello and her sibling Busola Obasanjo were listed as directors. M.Schneider is contending that there is nobody listed as Mrs Damilola Akinlawon as a director of Akiya Nigeria Limited contrary to the claims by Otunba Awofisayo and Akiya Nigeria Limited that the said Mrs Damilola Akinlawon is a director of Akiya Nigeria Ltd. representing the company on the board of M.Schneider Nigeria.

Relying on these pieces of evidence, the Austrian company claims that both Obasanjo-Bello and Awofisayo wilfully deceived it and contravened several aspects of the Nigerian law which makes the agreements with them null and void.

The Austrian company indicated in its petition that EFCC had investigated the matter in 2006.The company claimed that the underlying dispute “culminated in our being frustrated out of Nigeria after investing in excess of one million Euros”.

Has she been declared guilty by a competent law court, but you have called her a thief. Following your rule of law and due process, you have no business making such statements.

Yes we all have issues with OBJ and want to see him indicted but your contradicting principles is just alarming.

Read it for yourself. You read one part and didnt bother to read her defense, what Mr. Rule of Law you really her. It is clear your rule of law stand was nothing in real terms but similar to the AG subjective and protective.

I hope its gettting clear to the blind that the advocates of this so called rule of law in Nigeria know close to nothing of what they are talking about.

Rushing into judgement on an case reported in the newspaper is definitely not a fair way to judge matters. However if I read the story well, the actors in the matter went to international arbitration court and the expartriate lost. Likewise, they have their day in the local court and they also lost. Don't you guys think that this two hallowed institutions would not have collaborated with Iyabo and Awofisayo against the Austrian so called expartriates? Please do not visit the sin of the father on the daughter as this will be inimical to the rule of natural justice.

@ babasin all you have stated is your opinion which in this case really should be considered dodgy.

The issue is quite clear don't attempt to cloud it, legally has she done anything wrong like say impersonication etc. What law has she broken. Seun asked you to provide the penal code/constitution you havnt done that.

Please do your research and when or if you find something (because i suspect they knew exactly what they were doing .i.e not breaking the law) inform the house, not with this your ill informed arguement.

Of course, she and her friends definately knew what they were doing they never thot the deal will go bad. The intent is clear, it was to gain using her position as commissioner and the presidents daughter, but you just wait and see how the rule of law will be used to play this out.

Also, Prince Albert Awofisayo, the former chairman of the Nigerian subsidiary of the company, has dismissed allegations levelled against him by the company.
Both of them spoke in separate interviews with THISDAY yesterday.

“The company put in bids for the power projects without any input from me. It went through a normal, transparent process. I didn’t even know anybody at NEPA, so I could not have influenced anything. The company won the contracts. It is true that I used a pseudonym. It was Prince Awofisayo who funded the whole project. I did not put in a penny and I did not receive a penny from it.
“The truth will come out someday. This is pure blackmail. Because their business relationship has gone bad now, they now want to drag me in an unnecessary controversy. This is unfair. They are trying to use the media to destroy me because I am Obasanjo’s daughter. Does it mean because I am Obasanjo’s daughter, I cannot do anything again in this country? I have worked hard all my life. I am a PhD holder by dint of hard work. Does it mean I cannot even do anything again in my life without people trying to make a big issue out of it?”
Prince Awofisayo told THISDAY he was out of the country but would speak on the controversy as soon as he returns.
He said the Austrian company had resorted to blackmail because of its failure to prove its case in a court of law.
“I am the sole promoter, financier and initiator of M. Schneider Energy Nig. Limited,” he said. “Iyabo is someone I have known for a long time. I wanted her to be part of the business and I invited her. Reluctantly, she agreed to join. What these Austrian guys are doing is unfair. They just want to blackmail the woman. When we couldn’t forge a good working relationship, our deal collapsed. I took them to the International Court of Arbitration and I won. They went to the court in Nigeria and lost, yet they are trying by all means to blackmail everybody. I have all the documents with me. We will sit down and discuss everything when I return to Nigeria. I am not saying don’t write your story, but you owe me the duty of getting all the facts right. They have lost every case against me, that is why they are resorting to blackmail.”

I find it alarming that peeps can even be asking babasin to prove his stance on Iyabo obj's fraud allegation.
How can one assume another identity solely because they have an interest in a contract being awarded to another party all because of their presence in the government albeit through being a commissioner of a state or better still, the daugther of the then standing president.

Aren't public office holders suppose to show good morales, lay good examples and at least follow good diligence when it comes to managing public money (i know this is not the case in naij).

Me thinks she is guilty for even changing her name as that just doesn't seem right with the current image of naij in today's world.

Isn't it the same things 419 or yahoozee peeps get arrested for by EFCC (assuming different identity for the main purpose of defrauding unsuspecting muguns)?

One voice peeps as dats just the way forward.

I don't think anything is going to come out of investigation dats if it even gets to that stage but an outcry will definitely help in many ways than we can even understand

But we must not fight corruption with any hidden agenda, be it tribal, ethnic,
religion, personal hatred or whatever
When we fight this evil with open mind, without grudges or sensationalism
then we are on the right path
We should not rush to judgement from what an agrieved partner
has alledged. When the going was good, did they complain?.
Good for all us that the contract has been cancelled

Please, please let us remove our personal biases from this evil
We should be intelligent enough to analyse the corruption problems

Granted that Senator Iyabo's actions in this transaction is deplorable and she should not have been involved in this type of deal; which she readily acknowledged herself.  We should be careful not to transfer the hatred that we collectively have towards her father to her.  The real culprit is Chief Awofisayo who went and recruit a company that has no experience in the power sector to bid and won, and then out of greediness tried to scheme the company out of the contract.

The real issue really is the tendency of us Nigerians to always associate ourselves with foreign companies to the detriment of the indigenous ones, even those foreign ones that have no iota of experience in the project, and then we clothe them with our connection to get the contract.  I am not against using expatriates to gain a competitive advantage, but for crying out loud, use a company that is well versed and experienced in the project.  The bane of our problem and I have witnessed this time and time again, is that we will bring someone/company  that has no experience, confer on them an expatriate status and get a shoddy job done, paid them below the premium cost of the contract so as to pocket more money as "gains".  That my friends is the greediness of the Nigerian factor.

Notice that I use "we" in this response, all Nigerians have this same mindset.

The EFCC act that was cited above, if read and understood correctly states ", any person who by any false pretence, and with intent to defraud, "  The key interpretation is the intent to defraud, yes Senator Iyabo impersonates another person, hence false pretence; however, it doesn't appear that she or her company did it with the intent to defraud.  Both companies enter into a contract to bid and both of them misrepresented themselves; Shneider did not posses the required experience to perform the contract, and Akila also misrepresented the facts surrounding the ownership of their company.  The Court or the arbitration panel should be the one to rule on this.

I believe M. Sheneider is just playing to the gallery on this one and trying to tap into the sentiments that most Nigerians have for the person of Obasanjo and not on the merit of their case.  We need to be careful not to join with them in this naked dance at the market place.

Look before u leap. Anti-Obasanjo's please this is fresh story wait for media like me i am just reading this and i cant make any judgement base on news paper cos they are agent of blackmailing.
