According to electoral act 2010, for a candidate to be declared a winner of gubernatorial election, he/she must satisfy the following conditions: 1. Have the highest number of eligible votes 2.win 2/3 ofLG in the state.3. And get at least 25% of votes in all the local government. Although other candidates are first and second they do not satisfy the electoral act hence,the fresh election

The Court of Appeal sitting in Yola, on Wednesday dismissed
a suit instituted by one Umar Ardo challenging the
nomination of Governor Murtala Nyako as the PDP
candidate for the governorship election held in the state
during the 2011 general election.
In its lead judgement read by Ignatius Igwe, the court
upheld the judgement of the lower court which declared
Mr. Nyako the candidate of the PDP.
It held that Mr. Ardo has failed to prove, before it, that he
participated in the primary election.
The judge also held that Mr. Ardo lacks the constitutional
powers to challenge the outcome of elections, though
controversial, that he did not participate in.
The Appeal Court, however, agreed with the plaintiff that
the process that nominated Mr. Nyako was flawed. It ruled
that Mr. Nyako was not duly nominated as stipulated by the
provisions of the electoral act 2010 as amended, the PDP
constitution, and the constitution of the Federal Republic of
Nigeria.
The judge, however, held that the court was constrained by
section 31 sub section (1) of the electoral act 2010 as
amended to order for fresh election.
He therefore dismissed the appeal.

Sum time one begin to question the intergrete of inec...who are prideing themselves as an independent body,may be it has nt occur to dem dat contemporary nigeria is no longer a baby wit milk teeth...for crying out loud every one knw inec as pdp in disguise or perhaps a clone pdp..hw many election will the court nullified!!! Well why need for another election since d election dat brought him in has a candidate who came first!! And d candidate should be allowed to serve his complete tenure...and the inec chief should serve a jail term and all those who collaborated in dat scam!!!(Dat was actually on d contrary...who owns d court dat will trial dem if perhaps)sumtym d situation in dis country jst got me fantasising for allien invention frm space to take ova....since our leaders ar nt pragmatic.
