Bode George

Two days after former President Olusegun Obasanjo accused President Goodluck Jonathan of condoning corruption, a panel of judges at the Supreme Court of Nigeria today quashed the conviction handed Bode George a Peoples Democratic Party chieftain earlier jailed for corruption by a Lagos High Court.

The court discharged and acquitted Mr. George claiming that prosecutors at the Economic and Financial Crimes Commission (EFCC) had no evidence of Mr. George's intention to commit fraud at the Nigeria Port Authority (NPA) where as chairman of the NPA board he was caught presiding over a contract bazaar the bled the nation of Nigeria.

A panel of judges headed by a controversial judge, John Afolabi Fabiyi JSC, ruled that the charges of "contract splitting" upon which Mr. George was convicted is unknown to law.

The pattern of today's quashing of George's conviction was similar to that of a Lagos Court of Appeal ruling which similarly quashed a death sentence conviction of Major Hamza Al Mustapha's for the murder of Alhaja Kudirat Abiola in 1994. In Lagos, a panel of Court of Appeal cleared former Chief Security Officer of late maximum dictator, Sanni Abacha Mustapha of murder charges under controversial circumstances. Al Mustapha later wrote a letter thanking President Jonathan for arranging his judicial pardon.

Al Mustapha case was handled by the same lawyer, former president of the Nigeria Bar Association , Joseph B Daudu was Al Mustapha's lawyer in the Lagos case. Mr. Daudu, a senior advocate of Nigeria, also played a lead role in securing Mr. George's freedom today.

Since leaving prison a few years ago, Mr. George had been closely linked to President Jonathan, even sometimes openly bragging that his conviction will be upturned.

This is the season of quashing and clearing.

The report did not mention the quashing of Alamieyeseigha's conviction. Never in the annals of Nigeria's democracy have more convictions been quashed and individuals cleared than now.

More and more convictions are being quashed and cleared under the corruption-friendly administration of the Chief Quasher himself, Conviction Clearer Quashluck JonaClear.

Nigeria may be on the brink of being quashed and cleared!

Definitely, if James Onanefe Ibori was convicted here and sentenced in Nigeria, the conviction would also be quashed.

Different ways to make the convicts relevant for the 2015 general election from pardoning a criminal to discharging and acquitting after sentencing to death and now quashing of conviction.

It is curious that the 'quashing' Court says contract-splitting is 'unknown to law'.

See excerpts from the Public Procurement Act 2007:

Fundamental Principles Section 16(4).
37. The appropriate methods, procedures and contract award for public procurement of goods and works shall be subject to the prior review thresholds as may be set from time to time by the BPP.

38. Value for money obtained through efficiency, fair access to bids and transparency, shall remain the main objective of the Procuring Entity.

39. Contracts shall not be split into smaller units in order to avoid competitive bidding or be distributed among various lots to different bidders to enlarge bidder participation at the cost of lesser economy and efficiency.

I thought it was an exaggeration when it was said that it is somebody's destiny to bankrupt Nigeria.

BREAKING: Supreme Court upturns Lagos High Court conviction of Bode George

By Wale Odunsi on December 13, 2013

@waleodunsi

The Supreme Court of Nigeria, Friday morning quashed the conviction of a Peoples Democratic Party chieftain, Bode George by a Lagos High Court.

The apex court, in discharging and acquitting George, stated that the Economic and Financial Crimes Commission (EFCC) had no evidence that he committed fraud at the Nigeria Port Authority (NPA) as alleged.

According to the judges led by John Afolabi Fabiyi JSC, the charges of “contract splitting” filed against George was unknown to the law.

The judgement, which no doubt will raise more dust from anti-corruption activists and Nigerians, was not unexpected as the politician himself once said his conviction would be overruled.

(1)Governor Bode George (2)Senator Bode George (3)Rep Bode George take your pick, he is now free to contest elections in Lagos State.

He can always pull an Atiku by joining the Labor party and running for the Governor of Lagos, so that they can Pull an Obi/Anambra techinique on APC. He'll be rewarded, upon his return to PDP after the elections, with an Ambasadorial job. cheesy

When there is no law, then there is no sin.
If there is nothing like ' contract splitting' in our law, then EFCC erred in trying get him convicted by all means.

I no fit shout. The onus now rest with the prosecution to prove that contract splitting has either led to lesser economic efficiency and negative affected the principles of competitive bidding before it becomes an offence.

Some of you are hopelessly daft. Can you establish that the president influenced the SUPREME COURT judgment? If not, then why drag his name into the matter?

At least we had proof that the disgraced Justhief Salami, former President of the Appeal Court, was influenced by Tinubu to facilitate favourable rulings for ACN in Osun and Ekiti (thanks to MTN call logs). Is there any evidence that Goodluck Jonathan was in touch with the Supreme Court justices prior to this judgment?

Of course this was going to be the outcome all along as the judge that jailed him erred in law. EFCC’s evidence was flawed and inconclusive but i guess the case was politically influenced in Lagos then.

Shady work by EFCC and inept judgement by the the lower courts will always be thrown out by the supreme court. I followed the case when he was initially jailed and most of the evidence against him should have been thrown out by the presiding judge.

I am not in any way saying Bode George is not corrupt cos 99% of Nigerians are.. What i am saying is that the court need solid and impeccable evidence to convict people and not rely on emotions or political interference as displayed in this case

Sincerely lets eVen leave GEJ out of this for sometime.

I have never liked Bode George but sincerely I am really surprised that of the gamut of allegations that the prosecution worked on, it was just for contract splitting they convict the guy. I would have expected very strong/compelling grounds of obvious corrupt dealings.
