theres nothing a court of law can do about this case, the justice will either throw the case out of court or the juridiction of the court to hear such a case will be challenged being that a commisioned officer cannot face a court of law, the officer has swarn an oath of office at commission renouncing his right to be tried at a court of law , so he can only be tried by a panel or court martial headed by top military officers.

usually in this kind of situation in the armed forces they will play football with the issue  i.e the navy board will say only the head of state can make the final decision, the head of state will say only the chief of naval staff can make the final decision, the chief of naval staff will say only the chief of defence staff can make the decision, the cheif of defence will say only the chief of personnnel can make the decision,

then next they will say its a defence issue, then they will say no its a navy issue, then they will say no its presidency issue then they will create a new joint panel comprising other armed forces, and the joint panel will waste time deliberating then they will call the officers involved

then the officers will start accusing each other they will say they where trained by thier instructor at academy how to beat and punish people and that their instructor should be summoned but they will say hes dead etc

after playing football for awhile  they will then say uzoma and the officers involved should go for psychiatric evaluation! before you know it the story will die down , this is the system in the armed forces and yar adua is familar with it himself, after all his brother was in the system so he knows,  and I'm sure he will play along lol

i guess you are talking about the good ( ) old days of "Fellow compatriots, I Brigadier XYZ. . ."
This case will be another litmus test of which laws are supreme in Nigeria- the military service rules or the constitution of Nigeria.
In case you are not aware, there is a rare case going on of soldiers effectively suing for non-receipt (read embezzlement) of their peacekeeping entitlements. Yet, condemned death row men have sued the government for keeping them waiting for too long!
Lest you forget Atiku successfully sued Obj and PDP over his harrassment and planned sack as VP as well as denying him a slot on the presidential election ballot!
We are making progress, albeit slowly and Okere's case will be another milestone in that journey- God willing.

Call me naive but sometimes I wonder why the world need military and still people preach love and peace.

That woman is scarred for life and she'll never forget nor forgive. I wish I was there to kill the military officers. How could you do that to a woman? You supposed to let her be a woman and leave her alone.

This is not ot justify what has happened however in making judgement it is imperative for us to be objective.

1. Why do u think the Navy chaps decided to pick on that particular lady out of all the commuters in lagos.

2. Why did the video man not present 100% of the event to the public, rather only the after effect of her aggressive act was shown. Why sensor the video.

3. What do u have to say about the recorded conversation from MTN btw her dad and the Admiral. Well of course no one will care to know about that because that is being objective.

1. Gen Peatraus the US commander in Iraq was never in any operation/war b4 Iraq. So be adviced not every Admiral, General, or Marshal is opportuned
to see war even in the US so it is not a criteria.

Navy Redeploys Arogundade, 20 Others

Rear Admiral Harry Arogundade, the naval officer who was at the centre of the storm that trailed the molestation of Miss Uzoma Okere, by naval ratings in Lagos last year has been redeployed to the Defence Headquarters as Director of Plans.
Until his new posting, Arogundade was the Flag Officer Commanding Logistics based in Warri, Delta State.
Arogundade�s redeployment was among twenty other new postings announced by naval authorities in Abuja yesterday.
The molestation of Miss Okere and the nonchalant attitude by Arogundade and the Nigerian Navy was trailed by vociferous campaigns by concerned Nigerians, forcing the defence headquarters to constitute an investigative panel.
Though, the panel�s report has not being made public, many suspected that it influenced yesterday�s redeployment of Arogundade.
Earlier, the vociferous protest had forced military authorities to stop the use of horsewhips by its officers and men while the use of siren was restricted to military chiefs only.
Addressing newsmen yesterday, Director of Naval Information, Commodore David Nabaida said 21 senior officers made up of Rear Admirals and Commodores, were redeployed to new assignments to boost the operations of the Navy.
He said the redeployment of the senior officers was deliberate as it formed part of the career development programme of the service, adding, �At senior level, there is a need to move officers round to prepare them for holding command, training and staff appointments.
Among the deployed officers was Rear Admiral Owocho F Oketa who replaced Rear Admiral Arogundade as Flag Officer Commanding, Logistics Command while Rear Admiral Good Omoohwo Akpollo takes over as the new Chief of Administration at the NNQ.

Customs officials kill conductor, provoke riot

Officials of the Nigerian Customs Service on Wednesday allegedly gunned down a bus conductor identified as Arinze Nwachukwu at the former Asaba-Onitsha toll gate.

The alleged killing caused a stir on the highway and created a -prolonged traffic jam from Abraka market, Asaba to the bridgehead.

This caused a spillover in Onitsha, Anambra State as it temporarily blocked access to the Niger Bridge

It was gathered that Arinze, the only child of the Nwachukwu from Aguleri, Anambra East Local Government Council, was murdered at 7.30 am while in a bus with registration number XC 220 JJC.

Eyewitnesses who spoke to our correspondent gave two versions of how the customs officials on duty at the toll gate fired a shot that killed the 25-year old conductor.

One source claimed that the anti-smuggling agents fired shots at an Onitsha-bound luxury bus after attempting to stop the bus without success.

One of the bullets was said to have hit another Onitsha-Asaba bus, a Mitsubishi L-300 driven by a man simply called IBB, whose conductor was Arinze.

The bullet, the source said, pierced the door behind the driver and penetrated the chest of the conductor.

The source said there was no passenger in the bus, adding that both the driver and the slain conductor were on their way to carry passengers at Asaba when the incident happened.

Our correspondent gathered that the bullet created a wide hole on the bus.

It was learnt that the driver narrowly escaped death as another bullet hit the edge of the vehicle’s door, above the glass, but could not penetrate.

Another eyewitness said the bus was filled with passengers who scampered for safety when the bullet hit the conductor.

It was gathered that after the dastardly act, the customs officials fired several shots into the air to scare onlookers and also paved the way for their escape through the swampy bush close to the River Niger.

The source said that the customs officers pulled their uniforms to avoid identification.

It was also learnt that some onlookers had trailed the trigger-happy men, but could not get them. The sympathisers, however, vented their anger on a customs official vehicle, Peugeot 504 Saloon, which was burnt beyond recognition.

The remains of Arinze covered with traffic jacket were kept in the ill-fated bus hours after the incident, but were later taken to Area ”B” Police Division, Delta State along Asaba-Onitsha Expressway.

As at press time, a crowd of sympathisers and protesters, besieged the police division.

The killing of Arinze sparked off violent protests as commercial drivers and conductors, especially those who plied Asaba-Onitsha route took over the highways wielding weapons and chanting solidarity songs.

Scores of rioters barricaded the highways, created gridlocks on the busy road for hours and defiled all the efforts by the policemen to pacify them.

The scene attracted squads of anti-riot policemen, men of the Nigerian Security and Civil Defence Corps and the Joint Military Task Force who were put on the alert to avert possible escalation of the protest.

Justice Opeyemi Oke of a Lagos High Court yesterday fixed ruling for March 11, 2009 in the preliminary objection filed by Rear Admiral Harry Arogundade and the Nigerian Navy challenging the jurisdiction of the court to hear a suit instituted by Uzoma Okere and Abdullahi Abdulazeez who were allegedly assaulted by six naval ratings in the convoy of Rear Admiral Arogundade.
The plaintiffs who had dragged Arogundade, unknown naval ratings and the Nigerian Navy before the court for assault are demanding N100 million as damages against the defendants.
At the resumed hearing of the suit yesterday, counsel to the respondents , Lawrence Imolode, from the chambers of Bolaji Ayorinde (SAN) argued that the court lacked competence to hear the matter hence the suit should be struck out.
Besides, he urged the court to strike out the notice of motion set down for hearing arguing that the applicants did not seek the leave of the court for the hearing of the origination summons dated November 14, 2008.
In their notice of preliminary objection brought pursuant to order 1 rule 2; order 2 rule 2(1) (3) of the Fundamental Rights Enforcement Procedure and Section 91 of the Armed Forces Act 23 Cap A20 2004, the respondents argued that the plaintiffs failed to file and serve a verifying affidavit in addition to the originating summons.
Imolode submitted that the applicants failed to comply with the Fundamental Rights (Enforcement Procedure) Rules 1979 in that she failed to file and serve a verifying affidavit in addition to the Notice of Motion set down for hearing.
Further the respondents contended that the Nigerian Navy was not served the Originating Summon at its headquarters located at Plot 1092 Mohammed Buhari Way, Area 7, Garki Abuja.
Responding, counsel to the applicants, Omotola Rotimi (Mrs), argued that the applicants had fully complied with the Fundamental Human Rights Enforcement Procedure Rules.
Rotimi who is the Director of the Office of Public Defender (OPD) submitted that the applicants filed an application seeking leave of Court on November 11, 2008 and same was granted allowing the applicants to file and serve motion on notice for their fundamental human rights.
On the issue of none service, she urged the court to take judicial notice of affidavit of service filed by the applicants and discountenance the submission of the respondents.
She urged the court to assume jurisdiction and hold that the respondents had been duly served.
They urged the court to declare the acts of the respondents in torturing; stripping her naked, ruthless brutalising and unlawful arrest and detention of the applicants without any justification unlawful and unconstitutional.
They prayed the court to compel the respondents to issue unreserved apologies to them for the violation of their fundamental human rights in at least four print and electronic media.
The plaintiffs are also seeking for an order perpetual injunction restraining the respondents and their agents from horsewhipping motorists and putting them in apprehension through reckless driving in siren -blaring convoy.
They want the court to declare that the respondents’ prevention of using her Mitsubishi Colt marked MQ 34 KJA on public roads amounts to discrimination, harassment and infringement on her right to freedom as guaranteed by the 1999 Constitution.
They equally prayed the court to declare that she and other motorists are entitled to equal treatment and access to public roads without any discrimination.
The plaintiffs further prayed the court to declare that the acts of intimidation, violence and reckless driving by the respondents on the public roads under the pretext of being military officers, violate her and other road users’ rights to movement and dignity of human person.

Assault: Uzoma Okere wins round one

JUSTICE Opeyemi Oke of a Lagos High Court, on Wednesday, dismissed the preliminary objection of Rear Admiral Harry Arogundade and the Nigerian Navy, challenging the jurisdiction of the court to hear a suit by Miss Uzoma Okere.

The lady was reportedly assaulted by six naval ratings attached to the convoy of Arogundade on November 3, 2008 on Muri Okunola Street, Victoria Island, Lagos.

Okere and Abdulahi Abdulazeez had dragged Arogundade, NN and Unknown Naval Ratings to court and demanded N100m damages.

But the defendants had filed objection, claiming that the court lacked the jurisdiction to hear the suit.

In her ruling, Justice Oke held that a prima facie case had been established against Arogundade, NN and Unknown Naval Ratings.

The judge also awarded N25,000 costs against the defendants.

Justice Oke also berated Arogundade and other defendants for wasting the time of the court, saying that the objection lacked merit.

She said, “I hold that the Notice of Preliminary objection and the grounds upon which same is brought is mere waste of the time of the court and it is brought in bad faith to delay the hearing of the applicants‘ suit for the enforcement of their fundamental human rights.

“I hold that the preliminary objection has no leg on which to stand or knee caps to crawl before this court. It is hereby dismissed with N25,000 costs against the respondents.”

The judge further held that Okere and Abdulazeez had duly complied with the provisions of Order 1 Rule 2 (3) of the Fundamental Rights (Enforcement Procedure) Rules 1979.

She further held that since the court was satisfied that a prima facie case had been made, the court had no alternative than to grant leave to the plaintiffs to enforce their rights.

She said, “I have exercised my discretion on this application for leave for the enforcement of applicants’ fundamental rights judiciously and judicially, that a prima facie case has been made.

“I further hold that the applicants did comply with the preliminary steps for the enforcement of their fundamental rights.”

Regarding the issue of service, which the NN and Unknown Naval Ratings claimed was not properly effected, the court held that the defendants had been duly served with the originating summons, affidavit in support and the verifying affidavit.

The court also held that the contention of the defendants that the NN was not served with the originating summons at its headquarters at Plot 1092, Mohammed Buhari Way, Area 7, Garki, Abuja, was misconceived.

She pointed out that the NN and Unknown Naval Ratings were aware of the suit having been served through their Lagos office and represented by a lawyer.

The court held that the Lagos office of the NN had the responsibility to pass the information to the defendants, saying that to declare otherwise would only make a ridicule of the law.

Justice Oke later adjourned the case till March 18.

A Lagos High Court yesterday dismissed an application filed by Rear Admiral Harry Arogundade, and the Nigerian Navy, challenging jurisdiction of the court to hear a suit instituted by Uzoma Okere.
Okere was assaulted by six Naval ratings in the convoy of Rear Admiral Arogundade.
In her ruling, presiding judge, Justice Opeyemi Oke, while dismissing the preliminary objection, held that a prima facie case had been established against the respondents, adding that the objection was brought in bad faith, to delay the case and a ploy to waste the time of the court.
Besides, Justice Oke held that the applicants had duly complied with provisions of Order 1 Rule2(3) of the fundamental Rights (Enforcement Procedure) Rules 1979 and the court being satisfied that a prima facie case had been made, grants them leave to enforce their rights.
“I hold that Notice of Preliminary objection and the grounds upon which same is brought is mere waste of the time of the court and it is brought in bad faith to delay the hearing of the applicants’ suit for the enforcement of her fundamental human rights.
"I hold that the preliminary objection has no leg on which to stand or knee caps to crawl before this court. It is hereby dismissed with N25,000 cost against the respondents," the court ruled."
