The North Gauteng high court has ordered the South African government to prevent Sudan president Omar Al-Bashir from leaving the country pending the urgent application to compel SA to arrest him for war crimes.
The Southern African Litigation Centre brought the application for an order compelling SA to issue a warrant for Al-Bashir’s arrest on Sunday after the International Criminal Court called for Sudan’s President Omar al-Bashir to be arrested on Sunday at a summit of African leaders in Johannesburg.

Isabelle Ellis‚ for the SA government‚ asked for the matter to stand down until 3pm to allow the state to prepare the answering affidavit and heads of argument. She said she had only received the applicant’s papers at 10am this morning and has not had a chance to get proper instructions.

Ellis argued that there was a cabinet decision to adopt the AU’s resolution not to comply with the ICC’s call to arrest Al-Bashir.

The applicants lawyer Isabel Goodman agreed that the matter stand down for three hours on condition that Judge Peter Fabricius grants an interim order preventing Al-Bashir from leaving the country.

 The ICC indicted Al-Bashir for war crimes in 2009 for his role in the 2003 conflict which resulted in the death of more than 300‚000 people and displaced 2.5-million people‚ according to United Nations.

A South African court has issued an interim order preventing Sudanese President Omar al-Bashir from leaving the country.

It says Mr Bashir will have to stay until the court hears an application later on Sunday on whether he should be handed over to the International Criminal Court (ICC).

Mr Bashir is in Johannesburg for an African Union summit.

He faces war crimes and genocide charges by the ICC.

The High Court initially said it would issue its ruling on Sunday. But it later postponed the hearing until Monday, when the summit is due to end.

Can't be done.South Africa cannot hand over Bashir.
The repercussions would be felt all over.
Bashir committed war crimes, but it would be left for a subsequent Sudanese govt to repatriate him or not, not to a foreign govt he was allowed to set foot on.Its like kidnapping a foreign president,it's not done.

My thoughts exactly.
Omar al-Bashir is a war criminal who must face justice, but the Sudanese leader was in South Africa on a diplomatic ticket and mission. Arresting him wil be the most irresponsible act of any government.
Even the USA have failed to arrest the Iranian leader on there soil on several occasion.

That's why Nigeria is a safe haven for thief's/murderers during Charles Taylor issue obj took him. I commend the SA government on that, the blood of innocent souls that died wants justice.
OBJ took Charles Taylor in to restore peace to the war-torn county. He also handed Taylor over to the Liberian govt, which later sent him to the Hague to face war crime charges.
Obasanjo displayed a high level of diplomacy and commitment to peace building.

The west are true hypocrites, they should first ask for FW De Klerk for apartheid crimes before prosecuting Bashir. I still don't think they have the balls to arrest him, it will lead to a diplomatic crisis between the two countries.

Africa should walk out of the ICC en mass. If that court was fair George Bush should have been arrested for destroying entire continent in the guise of war on terror.
