President Muhammadu Buhari has approved the compulsory retirement from office of Hon. Justice Lambo Akanbi of the Federal High Court, Port Harcourt.

The judge was sent on compulsory Retirement with immediate effect after the National Judicial council (NJC) suspended him and recommended his retirement to the President for misconduct.

In a press statement, the Acting Director of the NJC, Mr Soji Oye, said the NJC made the recommendation to the President after its 74th meeting held on the November 4 and 5.

Shell Petroleum Company of Nigeria had made several allegations against Justice Lambo which were contained in a petition sent to the NJC.
The allegations include, the unilateral appointment of one Mr Emeka Nkwo as a referee and valuer in about three suits despite not been proposed by parties in the suit.

The judge also heard and concluded a case without dealing with a notice of preliminary objection on the jurisdiction of his court.
Justice Akanbi also sat on a case in the Federal High Court Yenagoa without the fiat of the Chief Judge of the Federal High Court who had already transferred a new judge to the state.

PMB promised he would build institutions and allow them to function. Sheu Garba was asked by a channel tv presenter on fuel scarcity, the man said he would advise the question was directed to NNPC that institution of government should be allowed to work.

Where am I going? NJC is an institution of government which was created , vested with enormous power and responsibilities among which is strengthen the structures and integrity of the rule of law; preserving and improving justice. Now that a judge has been found guilty and recommended for dismissal from service by NJC the rest now lie with the president and his person whether he would allow the impunity to continue or not. We have so accustomed to abuse of power and process for so long that majority find it difficult to recognize right things in our system. Right is seen as being wrong and vice vasa.

On the last note, majority of comments here where the commenters attacked the step took by the president were borne out of nothing but hatred for the occupier of seat of president. They know what is right and how things should go but will never give credit to the man for job well done.

Wrong headline!!!! The sanction on the Judge was imposed by the NJC.The president cannot take such decisions without the NJC.

The Nigerian Presidency has released a statement, saying a little above two billion Naira, not an outlandish six billion, has so far been spent on maintenance of the presidential air fleet between May and now.

The amount spent, the government said, included salaries and repayment of old debts.
In a statement in Abuja on Tuesday, Garba Shehu, the Senior Special Assistant to the President (Media and Publicity) ”expressed frustration at what he described as a fictional report that has caused the government a lot of negative reviews especially in the online media”.

The statement added, “The government is focused on solving the many major issues our country faces in the areas of the economy, corruption and security. Yet almost every week, the Presidency has to also deal with the distractions which do nothing but distract from the task of government.”

”Referring to documents he had requested from the Operational Office of the Presidential Fleet after his attention was drawn to the speculative report, Malam Shehu pointed out that the sum of N2.3 billion was released to the Presidential Air Fleet (PAF) by the office of the Accountant General of the Federation between May and November 2015. This includes releases for personnel cost, overhead and capital expenditure out of the sum of N5,190,381,386.00 appropriated for PAF on the 2015 budget.

”The documents also showed that the sum of N2,127,103,086.66 had so far been expended, leaving a balance of N172,568,912.34 from the amount released.



“However, the sum of N149,062,791.12 was transferred from the PAG’s operation account to the Treasury Single Account, following the President’s recent directive,” he said.

”He added that the sum of N23,801,122.17 remains unutilised out of the funds so far released. During the period 31 May 2015 till date, the Fleet expended the sum of N1,358,910,962.75 to settle outstanding liabilities carried over from last year till May 2015. Furthermore, the sum of N500 million was refunded to the office of the National Security Adviser, NSA for financial support rendered to the Fleet prior to release of funds from the OAGF.

”Thus, the Fleet expended the sum of N449,081,037.25 within the last months comprising N98,500,218.00 for operations, N165,373,176.91 on training and N85,500,116.75 on personnel medicals and overhead. Additionally, the sum of N99,715,493.51 was expended on aircraft maintenance, spares, and subscription services required for operations.

“Any of these documents could have been made available had the newspaper reached out to me or to any one of my colleagues. The damage to the image of government and the good management of the Presidential Air Fleet could have been avoided,” he said.

”The Senior Special,Assistant also put the number of aircraft on the Presidential fleet at 10, not 14 as cited by that report.

”He gave the inventory in the spirit of openness as transparency instituted by the Buahri administration as made up of:

PAF-AIRCRAFT INVENTORY

1. 1× 737 BBJ

2. 1× G550

3. 1× G500

4. 2× Falcon 7X

5. 1× HS 4000

6. 2× Agusta139

7. 2× Agusta 101

Total aircraft holdings 10.”‎

Seems some people hv a tough time to comprehend simple issues!! U think the president can just retire a judge by his own will, d guy as clearly stated was following d recommendations of the NJC, a body which under section 292(1)(b) has d powers to recommend a sack, but if his removal was based on section 292(1)(a) then u might question his decision, my friends this period is d one in which d constitution operates. If my memory serves me right did GEJ reinstate Justice Ayo Salami, when the recommendation to that effect was made by the NJC in May, 2012. Guys let's be realistic and try to call a spade a spade. Stand to be corrected, cus I'm not a lawyer, neither am I a law student, but I can read and understand
