Yahaya Bello Wins Kogi Governorship Election by free2ryhme: 1:16am On Dec 06, 2015
The candidate of the All Progressives Congress (APC) in the Kogi State governorship election, Mr Yahaya Bello, has been declared the winner of the election.

Mr Bello, who is substitute to late Mr Abubakar Audu, defeated the incumbent Governor, Captain Idris Wada, of the Peoples Democratic Party who was seeking a second term in office.

Declaring the results of the historic election, which was concluded, with a supplementary election held on December 5, the Returning Officer of the electoral body, Professor Emmanuel Kucha, said the APC’s candidate polled 247,752 to defeat Captain Wada who got 204,877 votes.

Collation of the supplementary election results started late Saturday night, with the official of the electoral body giving a breakdown of results from the earlier election held on November 21.

After that election, the electoral body declared the election inconclusive and fixed a supplementary election for December 5.

After election results from the 21 local government areas were collated on Sunday, November 22, the candidate of the APC, late Audu, was leading while the incumbent Governor, Captain Idris Wada of the Peoples Democratic Party (PDP) trailed by a margin less than the number of cancelled votes.

The candidate of the APC had 240,867 votes while that of the PDP polled 199,514 votes.

But the election was declared inconclusive by the INEC, which said canceled 49,953 votes were higher than the margin between the leading candidate and the runner-up.

After the supplementary election of December 5, the APC’s candidate got additional 6,885 while the PDP candidate polled 5,363.

The substitution of the late candidate of the APC had triggered divergent views, as to what the Nigerian Constitution and the Electoral Act proscribe, when the death of a candidate occurs during an electoral process.

Most arguments have focused on section 33 of the Electoral Act.

It reads: “No political party shall be allowed to change or substitute its candidate whose name has been submitted pursuant to section 31 of the Act, except in the case of death or withdrawal by the candidate”.

Aggrieved by the statement of the Attorney General of the Federation and the Minister of Justice, Abubakar Malami’s, that was legal for the APC to substitute the late candidate, Captain Wada approached a court, questioning the substitution and the power of the INEC to hold the supplementary election. He also requested that he should be declared the winner of the election, since the leading candidate had died.

But the court dismissed the case, saying it lacked jurisdiction. The Federal High Court Abuja further stressed that issues relating to election could only be adjudicated by the Election Petition Tribunal.

The Kogi election is considered historic, as it is the first election that a party will substitute their candidate in the middle of the process.

Exercise in futility.
Waiting patiently for d courts to quash this sham of an election and order a rerun.

Why not dash him that his fairly new 18yr old wife too as part of d package?

Long expected, there was no way we would have given PDP a chance again in that state, we only had an effigy as a governor in that state for the past 4 years, in fact the past 16yrs of pdp was a disaster in kogi and if APC won't perform better, then we give kowa a chance shikena. Things must change & power must rotate, it's not any tribe's birthright...

One can only feel for Faleke that the laws conspired against him but there is NOTHING he can do about the situation. Even if he spends his entire savings on this case, I believe Yahaya Bello will be governor.

If not for the Electoral law that specifically demands that a candidate must have fully participated in his party's primaries to qualify for election, APC would have used Faleke as Audu's replacement.

The lesson of this Kogi election is that it's advisable to participate in the primaries that will throw up a substantive candidate (gubernatorial or presidential) even if your plan is to be deputy to the eventual winner. In the event that your principal kicks the bucket during election process, you will easily be made his replacement without much rancor.

Yes. My question was in the light of your statement about someone else inheriting another person's votes. Amaechi inherited 100% of PDP votes hence I used it as an example.

I feel for Faleke but he is just unlucky that the laws didn't favour his case.

The man that becomes the next governor of Kogi State is for the courts to determine. It's not yet uhuru for Bello.

But trust nigeria with tribalism mixed with religion......... I shake my head for the future of this nation. Now we must go to court

I beg top disagree with you. Faleke can claim the supplementary election that brought Bello in is null and void since he has written to INEC and APC to remove his name as a deputy governorship candidate for the supplementary election. INEC and the APC cannot force a candidate to run in an election, and since one cannot run in an election without a complete ticket it makes the election null and void.

Faleke can dispute INEC's claim based on the PVC's distributed and the difference between the votes of Audu/Faleke's and Wada's. Yes, the electoral act only recognises the registered voters but Faleke's legal team will challenge INEC to explain who is a 'Qualified Voter' on an election day. If INEC's argument only supports 'registered voters and not of the use of PVC's, INEC would have shot itself in the leg meaning that elections conducted using PVC's are meaningless and unconstitutional and as such INEC cannot force the electorates to produce a PVC before voting since what they recognize is the registered voters only.

Thirdly, can you claim Bello has fulfilled all the constitutional requirements? Did Bello take part in the more than 2,500 polling units where elections were concluded in November? Isn't that part of the constitutional requirement?

Lastly, when the returning officer for the elections was returning Bello as the winner, he did not say APC alone but said Alhaji Yahya Bello of the APC haven polled the highest number of votes and satisfied all constitutional requirements is thereby returned elected'? Did Yahya Bello in actual sense pull the highest number of votes?

From what I hear PDP may end up winning at the tribunal. Don't know if the APC eventually decided on a running mate for the Bello guy. Apart from involving in anti party activities simply becos he lost out to Audu at the primaries, he even didn't cast a ballot during the main election. His case is dat of monkey work, baboon com chop.
