A suicidal man tried to commit suicide by jumping from the roof of a building to his death. There was a net present on the ground and it would have saved him, but he was shot as he fell.

The gun which killed him was fired by an old man in the building from which the man jumped. This old man had the tendency to threaten his wife from time to time with an UNLOADED gun; the wife knew it was always unloaded and never took the old man seriously.

But, this time when the husband did his routine threat with the gun, it was loaded and the old man missed his wife and the bullet struck the suicidal man as he fell.

The suicidal man was the son of the old man; knowing that his father threatened his mother from time to time with the gun, he loaded the gun in order to kill his mother. The suicidal man loaded the gun 6 weeks earlier with the bullet which would ultimately kill him as he was falling.

The question is, upon these facts, was the man's death suicide or murder!?

It was an accident. If the suicidal man was alive, he would be sued for attempted murder/murder but he is not.

Neither murder nor suicide, but manslaughter.
