Breaking: Police teargas Students, arrests NANS president for protesting unilateral sack of 13 VCs

The National President of the National Association of Nigerian Students (NANS) Tijani Usman was Thursday arrested by security operatives after leading a protest to challenge the unconventional sack of 13 university Vice Chancellors and their unilateral replacement by the President Muhammadu Buhari administration.
Only nine of the 13 had exhausted their tenures.
The security agency which descended violently on protesters and journalists arrested Usman while leading a blockade of the entrance of the Federal Ministry of Education. They were sitting at the entrance of the ministry when policemen began to teargas them.
The students who described the sack and replacement as illegal called for the reversal of the developments.
The Minister of Education, Adamu Adamu told reporters thereafter that no decision of the government will be reversed because somebody somewhere feels aggrieved.
“Some have made presentations and reservations and they are being looked at,” he said.
On Wednesday, Civil rights organisations shut down the entrance of the National Assembly and Ministry of Education in Abuja where they submitted petitions asking Buhari to rescind the sack.
The protesters described the sack as illegal.
Chairman of the coalition, Bassey Williams Etuk, called on President Muhammdu Buhari to relieve the Minister of Education, Mallam Adamu Adamu, of his appointment “because he knows nothing”.
According to Etuk, the sacking of the VCs and their replacement with people mostly from the North violated the federal character principles.
One of their placards reads: “Six Professors were taken from Bayero University, Kano as replacement… Haba! Why?”
They chanted solidarity songs, including: Adamu must go, reinstate the sacked VCs now and Nigeria needs a better administrator in the Education Ministry.”
A petition to the President of the Senate, Dr. Abubakar Bukola Saraki, and the Speaker of the House of Representatives, Yakubu Dogara, was received on their behalf by the National Assembly Deputy Sergeant-At-Arms, Dennis Maaji.
The group gave the Minister 48 hours to reverse the sack and resign his appointment “because he doesn’t seem to understand the working of University system and administration”.
Etuk said the coalition would be heading to court to stop the sack as the tenure of five of the sacked VCs were yet to expire.
The protesters also barricaded the Federal Ministry of Education located at the Federal Secretariat, Abuja.
Etuk said: “The minister does not have any right to call for the sack of 13 Vice Chancellors.
“Nine of the 13 sacked Vice Chancellors, their tenure was to expire this last Monday.
“But four, their tenure is still running.
“Some have two years, some have one year and six months.
“What he did, which is most disrespectful to the laws of the land, is that he appointed six people, his friends, from one university.
“He appointed six professors from one university, Bayero University, Kano, and he posted them to different tertiary institutions.
“Not only that, he also appointed two professors from Katsina State, making it eight friends from the just two states in North.
“We came here to tell him that Nigeria is not a sectional country.
“We are one indivisible Nigeria, nobody should separate us.
“Nobody should play sentiments with our economy and education sectors.
“The academic community has been here even before the minister was born.
“He cannot come and change it.
“Our appeal to him is to honourably reverse the decision
“Let’s agree with him that what he did was wrong, that he did it in a haste.
“We are here to tell him that he should please reserve that decision within 48 hours with immediate effects.
“If does not do that under 48 hours, we will call for his resignation.”

Did the NANS President obtain police clearance before the protest?

I strongly doubt it, else there would be no grounds for his arrest, for the stated reason, by the Police authorities.

The issue of police clearance has been dealt with by the court and so holding a peaceful protest is legal.

If he did not receive police clearance prior to the protest, his arrest is quite valid as he would be constituting a public nuisance and flouting the laid down process for embarking on a public protest of any kind.

Police permit is not a requirement of law before anyone exercises fundamental right of peaceful protest. This is the true position of law in Nigeria

“Persons desirous of convening or collecting any assembly or meeting or of forming a procession in any public resort must apply and obtain the license of the governor. The governor can delegate his powers to the Commissioner of Police of the state or to other police officers. Persons aggrieved by the decision of the Commissioner of Police may appeal to the governor and the decision of the governor shall be final and no further appeal shall lie therefrom".

Now, again I ask; Did the NANS President get authorization for his protest?

Many thanks. I really appreciate your conviction to hold opinion. However, I must be quick to further refer you to a Court of Appeal decision in the case of IGP v. ANPP (2007) 18 NWLR pt. 1066 pg. 457. Particularly on the provision you cited above

In the case cited above, it was held that the provisions of the Public Order Act, which prohibit the holding of rallies or processions without police permit are unconstitutional having regard to section 40 of the 1999 Constitution and Article 11 of the African Chatter
