The trial of the leader of the Indigenous People of Biafra (IPOB), Mr Nnamdi Kanu, which was expected to continue on Tuesday morning has been adjourned.

Kanu’s counsel, Chuks Muoma (SAN) applied for stay of proceedings pending the hearing and determination of the appeal filed by them challenging the ruling of the court delivered on March 7 granting the request of the Federal Government to shield witnesses.

Justice James Tsoho has therefore adjourned ruling on the stay of proceedings to April 26.

A Federal High Court in Abuja had on March 7 granted the application by the government to shield its witnesses in the trial of the self-proclaimed leader of the Indigenous People Of Biafra, Mr Nnamdi Kanu and two others standing trial for alleged treason.

According to the prosecutor, the witnesses claimed they had been threatened by associates of the accused persons should they testify in the court, stressing that they would only testify if they were assured of their personal safety.

There is no sensible judicial system in the world where witnesses are allowed to wear masks and testify against accused. How does a Defense lawyer scrutinize the witness masquerade?

Go and read John Grisham's The client, even if mafia lords are hunting for your head, you must testify as a witness OPENLY, that's non-negotiable. This will be fair to both the Defense and prosecution team.

After testifying the Govt can then allow you go into a Federal Witness Protection Program if you feel unsafe. That's how a sound federal judical system works.

The Defense also needs to scrutinize the Witness, how do they ask the important questions to a maquerade during scrutiny? It is their job to try and discredit the witnesses just as the prosecutors discredit the accused and if you don't allow them do it. Then the Judge is being biased. He has already condemned the accused ab initio.

The Banana republic, Zoo of Africa have thrown judicial sanity to the dogs.

Just to enlighten you and expose you folly

Witness protection is protection of a threatened witness or any person involved in the justice system, including defendants and other clients, before, during, and after a trial, usually by police. While a witness may only require protection until the conclusion of a trial, some witnesses are provided with a new identity and may live out the rest of their lives under government protection.

Witness protection is usually required in trials against organized crime, where law enforcement sees a risk for witnesses to be intimidated by colleagues of defendants. It is also used at war crime trials.

[b]Quota system illiterate, I thought you zombies say kanu is running an organised 'criminal/terrorist organisation' and the witnesses are afraid of them? Why are you approbating and reprobating at the same time?

What I expected a sane and intelligent person to do was to debunk intelligently and show us where the American Judicial system or any sane democractic judicial system allows witnesses to become masquerade when testifying. I will give you money to buy 25 litres of fuel if you do that. I promise.

At least it will help your quota system brain spend more time in classrooms than fighting in fuel queues. grin

The photograph you attached there, is to prevent photo-journalists and paparatziz from taking the picture of the witness but once in the courtroom the judge and lawyers will see his face and ask him the neccesary questions!

You don't wear masks in US courtrooms buddy even your muslim women wearing face-covering hijabs are not allowed to do so in the courtroom. Illiterate zombie!

What is meant by ‘Witness Protection’?
by FindLaw UK

Witness protection is often required when witnesses are fearful of giving evidence because they believe that they or their family may be at risk of harm if their identity is revealed to the defendant or their associates during or following criminal proceedings.

If prosecutors or police are informed that a witness in proceedings is fearful of giving evidence, they must liaise in order to arrange appropriate protection to assure the witness that they can give evidence without facing any repercussions.

Under certain circumstances, the courts can take special measures to protect vulnerable and intimidated witnesses, including those who are afraid of giving evidence and victims of a sexual offence. These special measures may range from asking the public to leave the courtroom whilst they give evidence to the relocation and full identity change of the witness.

‘Intimidated’ witnesses

If witnesses in criminal proceedings are considered to be ‘intimidated’ then special measures can be taken under the Youth Justice and Criminal Evidence Act 1999 (YJCEA). These may involve screening the witness from the defendant, allowing them to give evidence by live television link and allowing them to give evidence in private. In order for a witness to qualify as ‘intimidated’, the courts will consider various factors including the circumstances of the offence, behaviour displayed towards the witness by the defendant or his associates, and the age and background of the witness.

Reporting Restrictions

Under the YJCEA, adult witnesses can be made the subject of a reporting restriction, which means that matters relating to them cannot be included in any publication during their lifetime if it is likely to identify them. Under the Sexual Offences (Amendment) Act 1992 (as amended), anonymity in the press should be granted to the victim of a rape or other sexual offence listed in the act.

Hearings in private

Under some circumstances, hearings can take place in private, with the public excluded from the courtroom. This is known as holding a trial in camera.

Oga sharap!
In that your picture, the witness wears the mask to prevent paparatzis and photo-journalists. Once he gets into that courtroom, he removes that mask as the lawyers and judges must see his face and ask him the neccesary questions.
How do you interview a witness when you are not even sure he is even the one?
The only concession here is that Judges can decide to hold the hearing privately. Ordering everyone else out of his courtroom.
Masquerades don't give legal testimonies.
